Rozporządzenie Ministra Infrastruktury z dnia 9 września 2004 r. w sprawie certyfikatów potwierdzających spełnienie przez pojazd odpowiednich wymogów bezpieczeństwa lub warunków dopuszczenia do ruchu

Rozporządzenie określa: 1) rodzaje oraz wzory certyfikatów potwierdzających spełnienie przez pojazd odpowiednich wymogów bezpieczeństwa lub warunków dopuszczenia do ruchu, zwane dalej „certyfikatem”; 2) terminy ważności certyfikatów; 3) dokumenty, na podstawie których certyfikaty są wydawane i wznawiane. 8 2. Ustala się następujące rodzaje certyfikatów: 1) certyfikat potwierdzający spełnienie przez przyczepę lub naczepę odpowiednich wymogów bezpieczeństwa, którego wzór określa załącznik nr 1 do rozporządzenia; 2) certyfikat B potwierdzający spetnienie przez pojazd odpowiednich wymogów bezpieczeństwa dla pojazdu ekologicznego i bezpiecznego, którego wzór określa zatącznik nr 2 do rozporządzenia; 3) certyfikat B potwierdzający spetnienie przez pojazd odpowiednich wymogów bezpieczeństwa dla pojazdu EURO 3 bezpiecznego, którego wzór określa załącznik nr 3 do rozporządzenia; 4) certyfikat potwierdzający spetnienie przez pojazd odpowiednich warunków dopuszczenia do ruchu, którego wzór określa załącznik nr 4 do rozporządzenia. 8 3. 1. Certyfikat jest wydawany, z zastrzeżeniem 8 4, po przedłożeniu następujących dokumentów: 1) certyfikatu A dla pojazdu ekologicznego i bezpiecznego lub EURO 3 bezpiecznego, wydanego przez producenta lub importera będącego upoważnionym przedstawicielem producenta pojazdu, potwierdzającego spełnienie przez pojazd odpowied- 2) Rozporządzenie wdraża dyrektywę 96/96/WE z dnia 20 grudnia 1996 r. w sprawie zbliżenia ustawodawstw państw członkowskich dotyczących badań przydatności do ruchu drogowego pojazdów silnikowych i ich przyczep (Dz. Urz. WE L 046 z 17.02.1997, z późn. zm.). nich wymogów w zakresie emisji i zadymienia spalin oraz poziomu hałasu zewnętrznego; 2) zaświadczenia wydanego przez producenta lub upoważnionego przedstawiciela producenta pojazdu albo kserokopii świadectw homologacji przedmiotów wyposażenia i części pojazdu potwierdzającego wyposażenie pojazdu w odpowiednie układy i urządzenia, o których mowa w certyfikatach, albo wyciągu ze świadectwa homologacji typu pojazdu, jeżeli zawiera informacje dotyczące posiadania przez pojazd takiego wyposażenia; 3) zaświadczenia o pozytywnym wyniku z przeprowadzonego badania technicznego pojazdu; 4) kserokopii dowodu rejestracyjnego pojazdu; 5) pisemnego oświadczenia właściciela lub użytkownika pojazdu potwierdzającego wyposażenie pojazdu w zalegalizowany przyrząd kontrolny (tachograf). 2. Przepisów ust. 1 pkt 1 i 5 nie stosuje się do przyczep i naczep. 3. Przepisu ust. 1 pkt 3 nie stosuje się do pojazdów, co do których nie upłynął rok od daty ich pierwszej rejestracji. 8 4. W przypadku pojazdów, co do których uptynął rok od daty ich pierwszej rejestracji, zamiast dokumentów, o których mowa w § 3 ust. 1 pkt 2, dopuszcza się przedłożenie zaświadczenia o pozytywnym wyniku z przeprowadzonego badania technicznego pojazdu, potwierdzającego wyposażenie pojazdu w odpowiednie układy i urządzenia, o których mowa w certyfikatach. 8 5. W przypadku braku możliwości uzyskania dokumentów, o których mowa w § 3 ust. 1 pkt 2, na żądanie organu wydającego certyfikat, należy przedłożyć zaświadczenie z oględzin i badań pojazdu wykonanych przez jednostkę upoważnioną do przeprowadzania badań homologacyjnych stwierdzające wyposażenie pojazdu, dla którego ma być wydany certyfikat, w odpowiednie układy i urządzenia. 8 6. Certyfikat zachowuje ważność przez okres 12 miesięcy od daty jego wydania i podlega wznowieniu. Nr 205 8 7. 1. W przypadku wznawiania certyfikatu należy przedłożyć kserokopię dotychczasowego certyfikatu oraz dokumenty, o których mowa w § 3 ust. 1 pkt 2—5. 2. W przypadku braku kserokopii dotychczasowego certyfikatu dopuszcza się możliwość przedłożenia zaświadczenia, wystawionego przez jednostkę wydającą certyfikat, potwierdzającego jego wydanie. 3. Przepisy § 4 i 5 stosuje się odpowiednio. 8 8. 1. Certyfikaty wydane na dotychczasowych zasadach zachowują swoją ważność przez okres, na jaki zostały wydane. 2. Certyfikaty, o których mowa w ust. 1, podlegają wznowieniu zgodnie z przepisami niniejszego rozporządzenia. 8 9. Traci moc rozporządzenie Ministra Infrastruktury z dnia 30 kwietnia 2004 r. w sprawie certyfikatów potwierdzających spełnienie przez pojazd odpowiednich wymogów bezpieczeństwa lub warunków dopuszczenia do ruchu (Dz.
