POROZUMIENIE

między Rządem Rzeczypospolitej Polskiej a Rządem Republiki Rwandy o podejmowaniu działalności zarobkowej przez członków rodziny członka misji dyplomatycznej lub urzędu konsularnego,

podpisane w Warszawie dnia 24 lipca 2026 r.

3) „członek rodziny” oznacza osobę pozostającą w następującej relacji z członkiem misji dyplomatycznej lub urzędu konsularnego:

a) małżonek,

b) dziecko do 21 roku życia,

c) dziecko do 25 roku życia, pobierające naukę w pełnym wymiarze w instytucji kształcenia wyższego,

d) dziecko z niepełnosprawnością fizyczną lub umysłową, niezdolne do samodzielnego utrzymania się.

Artykuł 3 Procedury

l. W przypadku, gdy członek rodziny zdecyduje się podjąć działalność zarobkową w Państwie przyjmującym, misja dyplomatyczna Państwa wysyłającego złoży odpowiedni pisemny wniosek do Protokołu Dyplomatycznego Ministerstwa Spraw Zagranicznych Państwa przyjmującego („Protokół Dyplomatyczny ”).

2. We wniosku, o którym mowa w ustępie 1, należy wskazać członka rodziny zamierzającego podjąć działalność zarobkową oraz następujące informacje: |) nazwa potencjalnego pracodawcy oraz adres jego siedziby;

2) miejsce wykonywania działalności zarobkowej;

3) nazwa stanowiska i podstawowe obowiązki;

4) podstawa prawna wykonywania działalności zarobkowej (np. umowa o pracę).

3. - Protokół Dyplomatyczny, po potwierdzeniu, że członek rodziny spełnia warunki określone w niniejszym Porozumieniu, niezwłocznie poinformuje misję dyplomatyczną Państwa wysyłającego o udzieleniu zgody na wykonywanie działalności zarobkowej w Państwie przyjmującym przez członka rodziny.

4. Członek rodziny będzie zwolniony z wymogu uzyskania zezwolenia na wykonywanie działalności zarobkowej w Państwie przyjmującym innego niż zgoda, o której mowa w ustępie 3.

Artykuł 4 Uznawanie kwalifikacji

1. Porozumienie niniejsze nie stanowi podstawy do automatycznego uznania kwalifikacji zawodowych, tytułów naukowych lub innych kwalifikacji członka rodziny. Ich uznawanie będzie odbywać się zgodnie z prawem Państwa przyjmującego lub postanowieniami właściwej umowy międzynarodowej wiążącej Państwa tych Stron.

2. Porozumienie niniejsze nie umożliwia członkowi rodziny podejmowania działalności zarobkowej na stanowiskach, które zgodnie z prawem Państwa przyjmującego mogą być zajmowane wyłącznie przez obywateli tego Państwa.

Artykuł 5 Immunitet od jurysdykcji cywilnej i administracyjnej

Jeżeli członkowi rodziny przysługuje immunitet od jurysdykcji cywilnej iadministracyjnej Państwa przyjmującego na mocy Konwencji wiedeńskiej o stosunkach dyplomatycznych lub Konwencji wiedeńskiej o stosunkach konsularnych, albo innej umowy międzynarodowej wiążącej Państwa Stron, immunitet ten nie będzie obejmował czynów lub zaniechań popełnionych w związku z wykonywaniem przez niego działalności zarobkowej.

Artykuł 6 Immunitet od jurysdykcji karnej

Jeżeli członkowi rodziny przysługuje immunitet od jurysdykcji karnej Państwa przyjmującego na mocy Konwencji wiedeńskiej o stosunkach dyplomatycznych lub innej umowy międzynarodowej wiążącej Państwa Stron:

l) Państwo wysyłające wnikliwie rozważy pisemny wniosek Państwa przyjmującego o uchylenie immunitetu członka rodziny w odniesieniu do jakiegokolwiek działania lub zaniechania pozostającego w związku z wykonywaniem przez niego działalności zarobkowej, z wyjątkiem szczególnych okoliczności, w których Państwo wysyłające uzna, że uchylenie immunitetu godziłoby w jego interesy. Jeżeli immunitet nie zostanie uchylony, członek rodziny utraci zgodę na wykonywanie działalności zarobkowej, o której mowa w Artykule 3 ustęp 3 oraz może zostać poproszony przez Państwo przyjmujące o opuszczenie jego terytorium;

2) uchylenie immunitetu od jurysdykcji karnej nie jest rozumiane jako rozciągające się na wykonanie wyroku, do czego wymagane jest odrębne uchylenie immunitetu. W takich przypadkach Państwo wysyłające wnikliwie rozważy pisemny wniosek Państwa przyjmującego o uchylenie takiego immunitetu.

Artykuł 7 Systemy podatkowe i ubezpieczeń społecznych

Członek rodziny wykonujący działalność zarobkową podlega przepisom podatkowym, o ubezpieczeniach społecznych oraz ubezpieczeniu zdrowotnym, obowiązującym w Państwie przyjmującym, w odniesieniu do wszystkich kwestii związanych z wykonywaniem działalności zarobkowej w tym Państwie, z uwzględnieniem postanowień umów międzynarodowych wiążących Państwa

obydwu Stron.

Artykuł 8 Wygaśnięcie zgody na wykonywanie działalności zarobkowej

Misja dyplomatyczna Państwa wysyłającego niezwłocznie poinformuje Protokół

Dyplomatyczny o zmianach statusu członka rodziny, określonego w Artykule 2

punkt 3, wykonującego działalność zarobkową.

Zgoda na wykonywanie działalności zarobkowej przez członka rodziny jest

ważna do dnia, w którym:

1) utracił on status określony w Artykule 2 punkt 3, lub

2) nastąpiło zakończenie pełnienia funkcji w Państwie przyjmującym przez członka misji dyplomatycznej lub urzędu konsułarnego, od której zależy status tego członka rodziny, lub

3) nastąpiło rozwiązanie lub wygaśnięcie umowy dotyczącej wykonywania działalności zarobkowej przez członka rodziny,

" z zastrzeżeniem ustępu 3.

W przypadkach, o których mowa w ustępie 2 punkty 1 i 2, na pisemny wniosek członka rodziny, Państwo przyjmujące może wyrazić zgodę na przedłużenie okresu obowiązywania zgody na wykonywanie przez niego działalności zarobkowej o rozsądny okres.

Każda istotna zmiana w wykonywaniu działalności zarobkowej przez członka rodziny wymaga udzielenia nowej zgody, zgodnie z procedurą określoną w Artykule 3.

Artykuł 9 Zmiany Porozumienia

Każda ze Stron może wystąpić na piśmie, w drodze dyplomatycznej, o dokonanie zmiany całości lub części niniejszego Porozumienia. Każda zmiana niniejszego Porozumienia uzgodniona przez Strony wejdzie w życie w trybie przewidzianym dla wejścia w życie niniejszego Porozumienia i będzie stanowić jego integralną część.

Artykuł 10 Rozstrzyganie sporów

Wszelkie rozbieżności lub spory wynikające z interpretacji lub wykonywania niniejszego Porozumienia będą rozstrzygane ugodowo, w drodze dypłomatycznej, w ramach konsultacji lub negocjacji między Stronami.

Artykuł 11 Wejście w życie

Porozumienie niniejsze wchodzi w życie po upływie 30 (trzydziestu) dni od daty otrzymania, w drodze dyplomatycznej, późniejszej z notyfikacji, którymi Strony poinformują się nawzajem o spełnieniu wewnętrznych wymogów prawnych niezbędnych do jego wejścia w życie.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF POLAND AND THE GOVERNMENT OF THE REPUBLIC OF RWANDA

ON ENGAGEMENT IN GAINFUL OCCUPATION BY MEMBERS OF THE FAMILY

OF A MEMBER OF A DIPLOMATIC MISSION OR CONSULAR POST

The Government of the Republic of Poland and the Government of the Republic of Rwanda, hereinafter referred to as the "Parties", have agreed as follows:

Article 1 Authorization to engage in gainful occupation

Members of the family of a member of a diplomatic mission or consular post of one Party assigned to official duty in the territory of the State of the other Party shall be authorized, on a reciprocal basis, to engage in a gainful occupation in the receiving State, in accordance with the law of that State and the provisions of this Agreement, provided that they form part of the household and are dependent on that member of a diplomatic mission or consular post.

Article 2 Definitions

For the purpose of this Agreement:

l) *gainful occupation” means any form of remunerative employment, other for-profit activity, or the fulfilment of a function on the board of a legal person conducting business;

2) *member of a diplomatic mission or consular post” means an employee of the sending State performing the functions of a diplomatic agent, consułar officer or member of administrative and technical staff of the diplomatic mission or consular post in the receiving State, pursuant to the definitions contained in Article | letters (e) and (f) of the Vienna Convention on Diplomatic Relations, done at Vienna on April 18, 1961 ('Vienna Convention on Diplomatic Relations”), or in Article 1 paragraph 1, letters (d) and (e) of the Vienna Convention on Consular Relations, done at Vienna on April 24, 1963 (Vienna Convention on Consular Relations”), respectively, who is not a national of the receiving State and does not possess the right of permanent residence in it;

3) "member of the family” means a person related to a member of a diplomatic mission or consular post as:

a) spouse,

b) child under 21 years of age,

c) child under 25 years of age who is in full-time attendance at a postsecondary educational institution,

d) physically or mentally disabled child who is incapable of providing for himself/herself.

Article 3 Procedures

If a member of the family wishes to engage in a gainful occupation in the

receiving State, the diplomatic mission of the sending State shall submit the

appropriate request in writing to the Diplomatic Protocol of the Ministry of

Foreign Affairs of the receiving State (*Diplomatic Protocol”).

The request referred to in paragraph 1 shall identify the member of the family

wishing to engage in a gainful occupation and shall also contain the following

details:

1) Name of the prospective employer and address of his/her office/headquarters;

2) Place of engagement in gainful occupation;

3) Job title and main duties for the position; 4) Legal basis for engagement in gainful occupation (e.g. employment

contract).

The Diplomatic Protocol, after verifying that the member of the family meets the conditions defined in this Agreement, shall inform the diplomatic mission of the sending State, as expeditiously as possible, that the member of the family concerned is authorized to engage in a gainful occupation in the receiving State. The member of the family shall be exempted from the obligation to obtain an authorization to engage in a gainful occupation in the receiving State, other than the authorization provided for in paragraph 3.

Article 4 Recognition of Qualifications This Agreement does not provide the member of the family with the possibility to demand automatic recognition of their professional credentials, scientific titles or other qualifications. The recognition thereof shall be carried out pursuant to the domestic law of the receiving State or any other applicable international agreement binding on the States of those Parties. This Agreement does not authorize the member of the family to engage in a gainful occupation in positions that under the domestic law of the receiving State may only be held by nationals of that State.

-g— Article 5 Immunity from civil and administrative jurisdiction

the case that the member of the family enjoys immunity from the civil administrative jurisdiction of the receiving State, in accordance with the Vienna

Convention on Diplomatic Relations or the Vienna Convention on Consular Relations, or any other applicable international agreement binding on the States of the Parties, such immunity shall not apply with respect to any act or omission carried out in connection with their engagement in a gainful occupation.

Article 6 Immunity from criminal jurisdiction

In the case that the member of the family enjoys immunity from the criminal jurisdiction of the receiving State, in accordance with the Vienna Convention on Diplomatic Relations or any other applicable international agreement binding on the States of the Parties:

1) The sending State shall give serious consideration to any written request of the receiving State to waive such immunity of the member of the family in respect of any act or omission in relation to their engagement in a gainful occupation, except in special circumstances in which the sending State considers that the waiver is against its interests. In situations where immunity is not waived, the member of the family shall lose his/her authorization to engage in a gainful occupation provided for in Article 3 paragraph 3 and may be asked by the receiving State to leave its territory;

2) The waiver of immunity from criminal jurisdiction shall not be understood as extendable to the execution of a sentence, for which purpose a specific waiver shall be required. In such circumstances, the sending State shall give serious consideration to any written request of the receiving State to waive the latter

immunity.

Article 7 Fiscal and Social Security Systems

The member of the family engaged in a gainful occupation shall be subject to the fiscal, as well as social and health security regimes of the receiving State for all matters connected with their gainful occupation in that State, subject to the provisions of international agreements binding on the States of both Parties.

Article 8 Termination of Authorization

The diplomatic mission of the sending State shall inform the Diplomatic Protocol, as expeditiously as possible, about any changes in the status of the

member of the family engaged in a gainful occupation, as defined in Article 2, point 3. 2. - Anauthorization to engage in a gainful occupation by the member of the family, shall be valid until the day: 1) when he/she loses his/her status, in accordance with Article 2, point 3, or 2) the conclusion of official duty in the receiving State of the member of a diplomatic mission or consular post from whom the status of the member of the famiły is derived, or 3) the termination or the expiration of the contract of the member of the family for engagement in a gainful occupation, without prejudice to paragraph 3.

3. - Inthe cases provided for in paragraph 2, points 1 and 2, at the written request of the member of the famiły, the receiving State may agree to extend the validity of his/her authorization to engage in a gainful occupation, for a reasonable period.

4. - Any substantial change in a gainful occupation of the member of the family requires new authorization, in accordance with the procedures provided for in Article 3.

Article 9 Amendments

Each Party may request in writing, through diplomatic channels, the amendment of the whole Agreement or its part. Any amendment of this Agreement agreed upon by the Parties shall enter into force in accordance with the procedure for the entry into force of the Agreement and shall be an integral part thereof.

Article 10 Dispute Settlement

Any discrepancies or disputes arising in connection with the interpretation or implementation of this Agreement shall be settled amicably, by way of consultations or negotiations between the Parties, through diplomatic channels.

Article 11 Entry into Force

l. - This Agreement shall enter into force 30 (thirty) days after the date of receiving, through diplomatic channels, the latter notification in which the Parties inform each other of the completion of their internal legal procedures required for the entry into force of this Agreement.

2. This Agreement is concluded for an indefinite period.
