UmowA między Rządem Rzeczypospolitej Polskiej a Rządem Węgier o wzajemnej reprezentacji wizowej, podpisana w Krakowie dnia 14 marca 2014 r.

Artykuł 2

Działając na podstawie artykułu 1 niniejszej Umowy, Umawiające się Strony przestrzegać będą odpowiednich przepisów prawa Unii Europejskiej, w tym dyrektywy 95/46/WE Parlamentu Europejskiego i Rady z dnia 24 października 1995 roku w sprawie ochrony osób fizycznych w zakresie przetwarzania danych osobowych i swobodnego przepływu tych danych, oraz prawa wewnętrznego Umawiającej się Strony podejmującej czynności w ramach reprezentacji na rzecz Drugiej Umawiającej się Strony.

Artykuł 3

Działając zgodnie z postanowieniami artykułu 1 niniejszej Umowy, Umawiająca się Strona podejmująca czynności w ramach reprezentacji na rzecz Drugiej Umawiającej się Strony postępować będzie z taką samą starannością, jak przy wydawaniu wiz lub przyjmowaniu danych w swoim własnym imieniu. Z wyjątkiem przypadków określonych w kodeksie wizowym, żadna z Umawiających się Stron nie będzie ponosić odpowiedzialności za czynności podjęte w ramach reprezentacji na rzecz Drugiej Umawiającej się Strony.

Artykuł 4

Konsultacje w sprawach wniosków wizowych przyjętych przez Umawiającą się Stronę w ramach reprezentacji na rzecz Drugiej Umawiającej się Strony, które wymagają zasięgnięcia opinii organu centralnego Drugiej Umawiającej się Strony lub organu centralnego innych państw członkowskich, przeprowadza Druga Umawiająca się Strona.

Artykuł 5

1. Umawiające się Strony zawrą porozumienia wykonawcze, w których określą przedstawicielstwa dyplomatyczne i urzędy konsularne właściwe do wykonywania postanowień niniejszej Umowy oraz niezbędne techniczne i finansowe szczegółowe zasady współpracy.

Reprezentacja może być ograniczona do jednej lub kiłku części procesu wydawania wiz, w szczególności do udzielania informacji wizowej, umawiania terminów osobistych "wizyt w konsulacie, przeprowadzania rozmów, przyjmowania i przekazywania aplikacji wizowych wraz z dodatkową dokumentacją, zbierania danych — włączając w to dane biometryczne — i pobierania opłat.

Artykuł 6 Kwestie sporne dotyczące interpretacji i stosowania postanowień niniejszej Umowy będą rozstrzygane przez Umawiające się Strony w drodze dyplomatycznej.

Artykuł 7

Umawiające się Strony mogą dokonywać zmian w niniejszej Umowie w dowolnym czasie w drodze wymiany not dyplomatycznych.

Agreement between the Government of the Republic of Poland and the Government of Hungary

on mutual visa representation

The Government of the Republic of Poland and the Government of Hungary, hereinafter referred to as "the Contracting Parties”,

recalling the trustful cooperation between the Polish and the Hungarian consular services, characterized by mutual confidence,

acknowledging the fact that simplification of visa-issuing procedures is in the common interest of the Contracting Parties,

taking into consideration the European Union law in the field of Common Visa Policy and its future activities in this area,

have agreed as follows:

Article 1

1. The Contracting Parties shall represent each other in the process of examining applications and issuing visas pursuant to the Regulation (EC) No 810/2009 of the European Parliament and of the Councił of 13 July 2009 establishing a Community Code on Visas (Visa Code), hereinafter referred to as "the Visa Code”, in accordance with the European Union ław, this Agreement and the implementing arrangements. concluded pursuant to Article 5 of this Agreement, hereinafter referred to as "implementing arrangements”.

2. When performing the actions defined in paragraph 1, the diplomatic missions and consułar posts of the Contracting Parties shall assist each other.

Article 2

Acting pursuant to Article 1 of this Agreement, the Contracting Parties shall respect the European Union law, including Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and the relevant regulations of internal law of the representing Contracting Party.

Article 3

The Contracting Party representing the other Contracting Party pursuant to Article 1 of this Agreement shall act with the same diligence as when issuing visas and receiving data on its own behalf. With the exception of cases specified in the Visa Code neither Contracting Party shall bear responsibility for actions performed when representing the other Contracting Party.

Article 4

Consultations concerning visa applications received by the representing Contracting Party, requiring the opinion of the central authorities of the represented Contracting Party or of the central authorities of other Member States shall be conducted by the represented Contracting Party.

Article 5

1. The Contracting Parties shall concłude implementing arrangements by way of an exchange of notes, in which they specify the diplomatic missions and consular posts competent to implement the provisions of this Agreement, and the essential technical and financial particulars of cooperation.

2. Representation may be limited to one or several parts of the process of issuing visas, in particular to providing visa information, making appointments for personal visits at the consulate, conducting interviews, receiving and transferring visa applications with supplementary documents, collecting of data, including biometric data and receiving payments.

Article 6

Any disputes concerning the interpretation and the application of the provisions of this Agreement shall be resolved by the Contracting Parties through diplomatic channels.

Article 7

The Contracting Parties may amend this Agreement at any time by way of an exchange of diplomatic notes.
