Minister Obrony Narodowej Rzeczypospolitej Polskiej i Ministerstwo Obrony Narodowej Republiki Libańskiej, zwane dalej Stronami;

Biorąc pod uwagę wolę Rzeczypospolitej Polskiej udzielenia pomocy Republice Libańskiej w zapewnieniu warunków bezpiecznego 1 stabilnego rozwoju;

uzgodniły, co następuje:

Artykuł 1

Niniejsza Umowa określa zasady, na jakich Minister Obrony Narodowej Rzeczypospolitej Polskiej przekaże nieodpłatnie Ministerstwu Obrony Narodowej Republiki Libańskiej amunicję, broń strzelecką i sprzęt wojskowy, zwane dalej uzbrojeniem, zgodnie z ilością i specyfikacją określoną w Załączniku nr 1.

Artykuł 2

l. Uzbrojenie zostanie przekazane Ministerstwu Obrony Narodowej Republiki Libańskiej na podstawie Protokołu zdawczo-odbiorczego, sporządzonego "według wzoru określonego w Załączniku nr 2.

2. Przekazanie uzbrojenia nastąpi w całości na terytorium Rzeczypospolitej Polskiej, w miejscu i terminie uzgodnionym przez Strony.

Strony wyznaczą upoważnionych przedstawicieli odpowiedzialnych za przekazanie uzbrojenia w imieniu Ministra Obrony Narodowej Rzeczypospolitej Polskiej oraz przyjęcie uzbrojenia w imieniu Ministerstwa Obrony Narodowej Republiki Libańskiej.

4. Użytkownikiem końcowym uzbrojenia będą Libańskie Siły Zbrojne.

Artykuł 3 Załączniki nr 1 i 2 stanowią integralną część niniejszej Umowy. Artykuł 4

Ministerstwo Obrony Republiki Libańskiej oświadcza, że przekazane uzbrojenie nie będzie, bez wcześniejszej zgody Rządu Rzeczypospolitej Polskiej, reeksportowane, sprzedawane lub w inny sposób przekazywane użytkownikowi końcowemu, innemu niż wskazany w Umowie. W tym celu Ministerstwo Obrony Narodowej Republiki ' Libańskiej ' przedstawi oświadczenie końcowego użytkownika, poświadczone przez właściwe władze Republiki Libańskiej.

Artykuł 5

Ministerstwo Obrony Narodowej Republiki Libańskiej zobowiązuje się do wykorzystania uzbrojenia, będącego przedmiotem niniejszego Umowy, zgodnie z obowiązującymi międzynarodowymi konwencjami w sprawie przestrzegania praw człowieka.

Artykuł 6

Minister Obrony Narodowej Rzeczypospolitej Polskiej przekaże Ministerstwu Obrony Narodowej Republiki Libańskiej uzbrojenie nieodpłatnie, w ramach pomocy dla Libańskich Sił Zbrojnych.

Artykuł 7

l. Ministerstwo Obrony Narodowej Republiki Libańskiej będzie odpowiedzialne za transport uzbrojenia z miejsca jego odbioru na terenie Rzeczypospolitej Polskiej, w czasie którego uwzględnione będą obowiązujące na tym terenie przepisy dotyczące przewozu ładunków niebezpiecznych, a także poniesie związane z tym koszty.

The Minister of National Defence of the Republic of Poland and the Ministry of National Defence of the Lebanese Republic, hereinafter referred to as the Parties;

Taking into account the willingness of the Republic of Poland to aid the Lebanese Republic to assure the conditions of a secured and stable development;

Have agreed as follows:

Article I

This Agreement defines the rules of free of charge transfer of ammunition, small arms and military equipment, hereinafter referred to as the armament, according to the quantity and specifications defined in Appendix 1, from the Minister of National Defence of the Republic of Poland to the Ministry of National Defence of the Lebanese Republic.

Article 2

l. The armament will be delivered to the Ministry of National Defence of the Lebanese Republic on the base of the *Delivery-Reception Protocol”, prepared according to the sample described in Appendix 2.

The transfer of the armament will take place entirely on the territory of the Republic of Poland, in the place and date agreed upon by the Parties.

3. The Parties will designate authorized representatives who will be responsible for delivery of the armament, on behalf of the Minister of National Defence of the Republic of Poland, and for receiving of the armament, on behalf of the Ministry of National Defence of the Lebanese Republic.

4. The end user of the armament will be the Lebanese Armed Forces (LAF).

Article 3

The Appendixes l and 2 constitute the integral part of this Agreement.

Article 4

The Ministry of National Defence of The Lebanese Republic certifies that the transferred armament will not be re-exported, sołd or in any other way transmitted to an end user different than shown in this Agreement without the prior consent of the Government of the Republic of Poland. Accordingly, the Ministry of National Defence of the Lebanese Republic will present "the End User Certificate” certified by the appropriate authority of the Lebanese Republic.

Article 5

The Ministry of National Defence of Lebanese Republic takes the obligation to use the armament being the objects of this Agreement, in accordance with international conventions concerning the protection of human rights.

Article 6

In the framework of the contribution to the Lebanese Armed Forces, the Minister of National Defence of the Republic of Poland will transfer the armament as a donation to the Ministry of National Defence of the Lebanese Republic.

Article 7

|. The Ministry of National Defence of the Lebanese Republic will be responsible for the transport of the armament from the place of reception on the territory of the Republic of Poland, during which all the binding rules concerning the transport of dangerous items will be taken Into account and will cover all related expenses.

2. The Minister of National Defence of the Republic of Poland shall prepare the armament for transport and deliver it to the place of reception on the territory of the Republic
