Understanding en the amendment to the Agreement on financial cooperation between the Government of the Republic of Poland and the Government of the People's Republic of China, done on September 29, 2000 in Warsaw

The Government of the Republic of Poland and the Government of the People's Republic of China, henceforth called the *Contracting Parties”, with a view to continue the constructive economic co-operatton between the Republic of Poland and the People's Republic of China, have agreed as follows:

Article I

In accordance with Article 10 of Agreement on financial cooperation between the Government of the Republic of Poland and the Government of the People's Republic of China, done on September 29, 2000 in Warsaw, changed by five Understandings on the amendment to the Agreement, concluded by the Contracting Parties, the latest of which entered into force on April 11, 2007, the Contracting Parties agreed that on January 31, 2009, the following amendments to the above mentioned Agreement come into force:

1. In Article 1 paragraph 2 of this Agreement words: "The credit shall be utilised by January 31, 2009” shall be repłaced with: *The credit shall be utilised by January 31, 2011.”.

2. In Article 5 of this Agreement words: "The repayment of each credit utilisation will take place in 28 equal, semi-annual consecutive instalments paid in cash in US Dollars on May 15" and November 15” in a given year after a two year grace period from the date of the credit utilisation” shall be replaced with: "The repayment of each credit utilisation will take place in 36 equal, semi-annual consecutive instalments paid in cash in US Dollars on May 15" and November 15" in a given year after a 2 year grace period from the date of the credit utilisation”.

3. In Article 6 paragraph 1 the words *at the rate of 0,96%”, will be replaced by the words: * at the rate of 0,8 % p.a.”.

Article 2

The Understanding shall be approved in consistence with laws of each Contracting Party, and shal! enter into force on the date of signing. The Understanding shall continue in full force and effect until all obligations of both Contracting Parties arising from this Understanding are fulfilled.
