2.2 Sprawy związane z funkcjonowaniem organów związanych z obronnością w obu Państwach oraz dialog między wojskowymi instytucjami badawczymi;
2.3 Współpracę w dziedzinie wzajemnego wykorzystania umiejętności w obszarze badań i oceny związanych z obronnością;
2.4 Wymianę informacji i opinii w dziedzinie polityki zbrojeniowej;
2.5 Badania i rozwój dla potrzeb produkcji i dostęp do materiałów obronnych, wspierane przez inicjatywy obydwu Stron zmierzające do zwiększenia udziału przemysłów Rzeczypospolitej Polskiej i Republiki Kolumbii.
Artykuł 3 Środki współpracy
Współpraca określona w artykule 2 będzie przeprowadzana na podstawie szczegółowych porozumień zawieranych przez upoważnionych przedstawicieli Stron. Współpraca ta będzie wykonywana zgodnie z prawem Rzeczypospolitej Polskiej i Republiki Kolumbii.
Artykuł 4
Kwestie administracyjne
Organami właściwymi w sprawie koordynacji i nadzoru nad wykonywaniem niniejszego Memorandum o Porozumieniu są: - ze Strony Rzeczypospolitej Polskiej: Minister Obrony Narodowej we współpracy z ministrem właściwym do spraw gospodarki; - ze Strony Republiki Kolumbii: Minister Obrony Narodowej i Generalne Dowództwo Sił Zbrojnych.

Artykuł 5 Bezpieczeństwo
Strony zgadzają się, że działania podejmowane na podstawie niniejszego Memorandum będą podlegały przepisom odrębnej umowy o ochronie informacji
niejawnych.
Artykuł 6 Sprzedaż na rzecz stron trzecich
6.1 Sprzedaż na rzecz stron trzecich wspólnie uzyskanych opracowań i sprzętu będzie wymagała uprzedniej zgody obu Stron.
6.2 Udzielanie licencji na produkcję wspólnie uzyskanych opracowań i sprzętu w trzecim państwie będzie wymagała zgody obu Stron.
6.3 Dostęp państw trzecich do opracowań i sprzętu wspólnie uzyskanego na mocy niniejszego Memorandum o Porozumieniu będzie regulowany przez odrębne
porozumienia.
Artykuł 7
Zobowiązania finansowe
Niniejsze Memorandum o Porozumieniu nie stwarza zobowiązań finansowych dla Stron oprócz tych, które dotyczą niezbędnych kosztów administracyjnych wykonywania niniejszego Memorandum o Porozumieniu.
Artykuł 8
Spotkania i wymiana informacji
8.1 Strony, jeżeli będzie to możliwe, będą przeprowadzać coroczne spotkania naprzemiennie
w Rzeczypospolitej Polskiej i Republice Kolumbii pod przewodnictwem państwa

goszczącego w celu określenia i uszczegółowienia obszarów współpracy oraz przygotowania i zatwierdzenia harmonogramów prac.
8.2 Jeżeli coroczne spotkanie nie będzie mogło być przeprowadzone, Strony wymienią niezbędne informacje poprzez organy, o których mowa w artykule 4.
Artykuł 9
Rozstrzyganie sporów
Wszelkie spory dotyczące interpretacji lub wykonywania postanowień niniejszego Memorandum o Porozumieniu będą rozstrzyganie wyłącznie poprzez bezpośrednie konsultacje między Stronami i we wszystkich przypadkach powinny być rozwiązywane w drodze wzajemnego porozumienia.
Artykuł 10
Postanowienia końcowe
10.1 Niniejsze Memorandum o Porozumieniu wejdzie w życie 30 dni po jego podpisaniu.
10.2 Niniejsze Memorandum o Porozumieniu jest zawarte na czas nieokreślony. Może być ono wypowiedziane przez każdą ze Stron w drodze pisemnej notyfikacji. W takim przypadku Memorandum o Porozumieniu utraci moc 6 miesięcy od dnia otrzymania takiej notyfikacji.
10.3 Niniejsze Memorandum o Porozumieniu może być zmienione w każdym czasie w drodze wzajemnej pisemnej zgody Stron. W takim przypadku ustęp 1 będzie odpowiednio stosowany.
10.4 Wypowiedzenie lub wygaśnięcie niniejszego Memorandum o Porozumieniu
nie będzie miało wpływu na szczegółowe porozumienia, o których mowa w artykule 3.

The Minister of National Defence of the Republic of Poland and the Minister of National Defence of the Republic of Colombia, hereinafter referred to as the "Parties",
- considering that the President of the Republic of Poland and the President of the Republic of Colombia signed a Joint Declaration in 2002;
- considering cooperation in the field of defence to be a vital element of security
and stabilisation and of particular significance for the cooperation;
- emphasizing mutual understanding between the Republic of Poland and the Republic of Colombia and the need to develop comprehensive cooperation, especially in the important part of defence industry;
Have reached the following:
Article 1 Objective
The Parties wish to create an interinstitutional framework for the expansion of cooperation in the field of conventional defence technology with the goal of strengthening defence capacities through better use of existing resources. With this goal in mind and with the goal of strengthening defence industry capacities, the Parties shall seek to promote cooperation in research, development, production, new technologies and access to defence materials.
Article 2 Areas of cooperation
Cooperation between the Parties shall cover, but shall not be limited to the following
areas:
2.1 Technology transfer and technical assistance for the manufacture of arms, munitions and explosives.
2.2 Matters related to the functioning of the agencies related to defence in both States and dialogue between military research institutes.

2.3 Cooperation in the field of reciprocal use of skills in the field of test 8 evaluation related to defence.
2.4 Exchange of information and opinions in the field of industrial defence policy.
2.5 Research and development for the needs of production and access to defence material with both Parties supporting initiatives aiming at the increase of the participation of the industries of the Republic of Poland and the Republic of Colombia.
Article 3 Means of cooperation
The cooperation described in Article 2 shall be carried out on the basis of specific agreements concluded by the Parties authorized representatives. The cooperation shall be executed in accordance with the laws of the Republic of Poland and the Republic of Colombia.
Article 4 Administration
The authorities competent for coordination and supervision of this Memorandum of Understanding are: - For the Republic of Poland: The Minister of National Defence in cooperation with the minister competent in economy matters; - For the Republic of Colombia: The Minister of National Defence and the General Command of the Armed Forces.
Article 5 Security
The Parties agree that the activities to be undertaken under this Memorandum of Understanding shall be subject to a separate agreement on protection of reserved information.

Article 6 Sales to third parties
6.1 Sales to third parties of jointly obtained developments and equipment shall require prior approval by both Parties.
6.2 Granting licences for production of jointly obtained developments and equipment in a third country requires prior approval from both Parties.
6.3 The access of third parties to developments and equipment jointly obtained under this Memorandum of Understanding to shall be governed by separate agreements.
Article 7 Financial obligations
This Memorandum of Understanding shall not create financial obligations for the Parties except those related to the necessary administrative costs of the execution of this Memorandum of Understanding.
Article 8 Meetings and exchange of information
8.1 The Parties may hold annual meetings alternatingly in the Republic of Poland and in the Republic of Colombia under the chairmanship of the Host State to define and specify the areas of cooperation and prepare and approve schedules of work, if possible.
8.2 If the annual meeting cannot be held, the Parties shall exchange the necessary information through the authorities mentioned in Article 4.
Article 9 Settlement of disputes
Any dispute related to the interpretation or application of this Memorandum of Understanding shall be settled exclusively by means of direct consultations between the Parties, and shall be solved in all cases by mutual agreement.

Article 10 Final provisions
10.1 This Memorandum of Understanding shall enter into force thirty days after its signing.
10.2 This Memorandum of Understanding is concluded for an indefinite period. It may be terminated by any of the Parties through a written notification. In such case the Memorandum of Understanding expires six (6) months from the date of the receipt of such notification.
10.3 This Memorandum of Understanding may be amended at any time by a mutual written consent of the Parties. In such case the paragraph 1 shall apply adequately.
10.4 Termination or expiration of this Memorandum of Understanding shall have no
effect on specific agreements mentioned in Article 3.
Done in Pada DO. on 0)--2]-90I0 in two original copies, each in the Polish, English and Spanish languages, all texts being equally authentic. In case of any discrepancy regarding their interpretation, the English text shall prevail.

Articulo 2 Areas de cooperación
La cooperación entre las Partes incluira, pero no se limitara a las siguientes areas:
2.1 La transferencia de tecnologia y asistencia tecnica para la fabricación de armas, municiones y explosivos.
2.2 Asuntos relacionados con el funcionamiento de los organismos en relación con la defensa en ambos Estados y el dialogo entre los institutos de investigación militar.
2.3 La cooperación en el ambito de la utilización reciproca de habilidades en el campo de prueba y evaluación relacionada con la defensa
2.4 Intercambio de información y opiniones en el ambito de la politica industrial de defensa.
2.5 Investigación y desarrollo para las necesidades de producción y el acceso a material de defensa con ambas Partes apoyando las iniciativas, con el objetivo de aumentar la participación de las industrias de la Republica de Polonia y la Republica de Colombia.
Articulo 3 Medios de cooperación
La cooperación descrita en el articulo 2 se llevara a cabo sobre la base de acuerdos especificos celebrados por los representantes autorizados de las Partes. La cooperación se Ilevara a cabo de conformidad con las leyes de la Republica de Polonia y la Republica de Colombia.
Articulo 4 Administración
Las autoridades competentes para la coordinación y supervisión de este Memorando de Entendimiento son:

- Por la Republica de Polonia: El Ministro de Defensa Nacional en cooperación con el ministro competente en materia de economia; - - Por la Republica de Colombia: El Ministro de Defensa Nacional y el
Comando General de las Fuerzas Armadas.
Articuło 5 Sequridad
Las Partes acuerdan que las actividades que se Ilevaran a cabo en virtud del presente Memorando de Entendimiento, estaran sujetas a un acuerdo aparte sobre la protección de información reservada.
Articulo 6 Ventas a terceros
6.1 Las ventas a terceros de los adelantos obtenidos en conjunto y de los equipos, deberan ser aprobadas previamente por ambas Partes.
6.2 La concesión de licencias para la producción de los adelantos obtenidos en conjunto y de los equipos en un tercer pais, requerira la aprobación previa de ambas Partes.
6.3 El acceso de terceros a los adelantos y los equipos conjuntamente obtenidos bajo este Memorandum de Entendimiento, se regira por acuerdos separados.
Articulo 7 Obliqaciones financieras
El presente Memorando de Entendimiento no creara obligaciones financieras a las Partes, salvo aquellas relacionadas con los gastos administrativos necesarios para la ejecución de este Memorandum de Entendimiento.

Articulo 8
Reuniones e intercambio de información
8.1 Las Partes podran celebrar reuniones anuales alternativamente en la Republica de Polonia y en la Republica de Colombia, bajo la presidencia del Estado Anfitrión para definir y especificar las areas de cooperación y preparar y aprobar los programas de trabajo, si es posible.
8.2 Si la reunión anual no puede llevarse a cabo, las Partes intercambiaran la información necesaria a travćs de las autoridades mencionadas en el
articulo 4.
Articulo 9
Solución de controversias
Cualquier controversia relacionada con la interpretación o aplicación del presente Memorando de Entendimiento sera resuelta exclusivamente por medio de consultas directas entre las Partes, y se resolvera en todos los casos por mutuo acuerdo.
Articulo10 Disposiciones finales
El presente Memorandum de Entendimiento entrara en vigor treinta dias despućs de su firma.
10.1 El presente Memorando de Entendimiento se celebra por un periodo indefinido. Podra ser terminado por cualquiera de las Partes mediante notificación por escrito. En tal caso, el Memorando de Entendimiento expirara seis (6) meses despućs de la fecha de recepción de dicha notificación.
10.3 El presente Memorando de Entendimiento podra ser modificado en cualquier momento mediante consentimiento mutuo por escrito de las Partes. En tal caso, el parrafo 1 se aplicara de manera adecuada.
10.4 La terminación o expiración del presente Memorando de Entendimiento no tendra ningin efecto en los acuerdos especificos mencionados en el Articulo 3.
