przypominając postanowienia Konwencji i Zalecenia dotyczącego inspekcji pracy, z 1947 r., Zalecenia dotyczącego inspekcji pracy w przedsiębiorstwach górniczych i transportowych, z 1947 r. i Konwencji dotyczącej minimalnych norm na statkach handlowych, z 1976 r.,i

przypominając wejście w życie w dniu 16 listopada 1994 r. Konwencji Narodów Zjednoczonych o prawie morza, z 1982 r.,i

postanowiwszy przyjąć niektóre wnioski w sprawie rewizji Zalecenia dotyczącego inspekcji pracy marynarzy, z 1926 r., która to sprawa stanowi pierwszy punkt porządku dziennego sesji, i

postanowiwszy, że wnioski te zostaną ujęte w formę konwencji międzynarodowej, do realizacji jedynie przez państwo flagowe;

przyjmuje dnia dwudziestego drugiego października tysiąc dziewięćset dziewięćdziesiątego Szóstego roku następującą konwencję, która otrzyma nazwę: Konwencja dotycząca inspekcji pracy marynarzy, z 1996 r.:

Część I Zakres stosowania i definicje Artykuł 1

1. Jeżeli niniejszy artykut nie stanowi inaczej, konwencja ma zastosowanie do każdego statku morskiego, będącego własnością publiczną lub prywatną, zarejestrowanego na terytorium Członka, dla którego niniejsza konwencja jest

Noting the changes in the nature of the shipping industry and, as a consequence thereof, the changes in seafarers' working and living conditions since the Labour Inspection (Seamen) Recommendation, 1926, was adopted, and

Recalling the provisions of the Labour Inspection Convention and FRecommendation, 1947, the Labour Inspection (Mining and Transport) Recommendation, 1947, and the Merchant Shipping (Minimum Standards) Convention, 1976, and

Recalling the entry into force of the United Nations Convention on the Law of the Sea, 1982, on 16 November 1994, and

Having decided upon the adoption of certain proposals with regard to the revision of the Labour lInspection (Seamen) Recommendation, 1926, which is the first item on the agenda of the session, and

Having determined that these proposals shall take the form of an international Convention for flag State implementation only;

adopts, this twenty-second day of October of the year one thousand nine hundred and ninety- -six, the following Convention, which may be cited as the Labour Inspection (Seafarers) Convention, 1996:

Part I Scope and definitions Article 1

1. Except as otherwise provided in this Article, this Convention applies to every seagoing ship, whether publicly or privately owned, which is registered in the territory of a Member for which the Convention is in force and is

Rappelant I'entróe en vigueur, le 16 novembre 1994, de la Convention des Nations Unies sur le droit de la mer, 1982;

Apres avoir dócidć d'adopter diverses propositions relatives a la róvision de la recommandation sur I'inspection du travail (gens de mer), 1926, question qui constitue le premier point a I'ordre du jour de la session;

Apres avoir dócidć que ces propositions prendraient la forme d'une convention internationale s'appliquant seulement a I'Etat du pavillon,

adopte, ce vingt-deuxieme jour d'octobre mil neuf cent quatre- -vingt-seize, la convention ci- -apres, qui sera dćnommóe Convention sur I'inspection du travail (gens de mer), 1996.

Partie | Champ d'application et dófinitions Article 1

1. Sous róserve des dispositions contraires figurant dans le prósent article, la prósente convention s'applique a tout navire de mer immatriculć dans le territoire d'un Membre pour lequel la convention est en vigueur, de pro-

w mocy, i używanego dla celów handlowych do transportu towarów lub pasażerów, albo do innych celów handlowych. Dla celów niniejszej konwencji statek, będący w rejestrze dwóch Członków, uważany jest za zarejestrowany na terytorium tego Członka, którego banderę nosi.

2. Ustawodawstwo lub przepisy krajowe określą, które statki mają być uznawane za statki morskie dla celów niniejszej konwencji.

3. Niniejsza konwencja ma zastosowanie do holowników morskich.

4. Niniejsza konwencja nie ma zastosowania do statków o wyporności mniejszej niż 500 ton brutto i nieużywanych do nawigacji, statków, takich jak pływające urządzenia wiertnicze i platformy wiertnicze. Decyzja, które statki są objęte niniejszym ustępem, będzie podjęta przez centralną władzę koordynującą po konsultacji z najbardziej reprezentatywnymi organizacjami armatorów i marynarzy.

5. W zakresie, w jakim centralna władza koordynująca uważa to za praktyczne, po konsultacji z reprezentatywnymi organizacjami armatorów statków rybackich i rybaków, postanowienia niniejszej konwencji będą stosowane do handlowych morskich statków rybackich.

6. 7. Dla celów niniejszej konwencji:

a) określenie „centralna władza koordynująca” oznacza ministrów, ministerstwa lub inne władze ' publiczne mające uprawnienia do wydawania i kontrolowania realizacji przepisów, zarządzeń lub innych in-

engaged in the transport of cargo or passengers for the purpose of trade or is employed for any other commercial purpose. For the purpose of this Convention, a ship that is on the register of two Members is deemed to be registered in the territory of the Member whose flag it flies.

2. National laws or regulations shall determine which ships are to be regarded as seagoing ships for the purpose of this Convention.

3. This Convention applies to seagoing tugs.

4. This Convention does not apply to vessels less than 500 gross tonnage and, when not engaged in navigation, vessels such as oil rigs and drilling platforms. The decision as to which vessels are covered by this paragraph shall be taken by the central coordinating authority in consultation with the most representative organizations of shipowners and seafarers.

5. To the extent the central coordinating authority deems it practicable, after consulting the representative organizations of fishing vessel owners and fishermen, the provisions of this Convention shall apply to commercial maritime fishing vessels.

6. In the event of any doubt as to whether or not any ships are to be regarded as engaged in commercial maritime operations or commercial maritime fishing for the purpose of this Convention, the question shall be determined by the central coordinating authority after consulting the organizations of shipowners, seafarers and fishermen concerned.

7. For the purpose of this Convention:

(a) the term "central coordinating authority” means ministers, government departments or other public authorities having power to issue and supervise the implementation of regulations, orders or other in-

5. Pour autant que I'autoritć centrale de coordination le juge róalisable, apres consultation des organisations reprósentatives des armateurs a la peche et des pEcheurs, les dispositions de la convention s'appliqueront aux bateaux de póche maritime commerciale.

6. En cas de doute sur la question de savoir si un navire doit 6tre considóćrć comme affectć a I'exploitation maritime commerciale ou a la peche maritime commerciale aux fins de la convention, la question sera róglóe par I'autoritó centrale de coordination, apres consultation des organisations d'armateurs, de gens de mer et de pecheurs intóressćes.

7. Aux fins de la convention:

a) I'expression «autoritć centrale de coordination» dósigne les ministres, les services gouvernementaux ou toutes autres autoritós publiques habilitćes a ćdicter des arr6tós, reglements ou autres instructions ayant ayant

strukcji mających moc prawną dotyczących inspekcji warunków pracy i życia marynarzy w odniesieniu do jakiegokolwiek statku zarejestrowanego na terytorium Cztonka;

b) określenie „inspektor” oznacza

każdego urzędnika państwowego lub innego urzędnika publicznego odpowiedzialnego za przeprowadzanie inspekcji wszelkich kwestii związanych z warunkami życia i pracy marynarzy, jak również każdą inną osobę posiadającą właściwe pełnomocnictwa dokonującą inspekcji dla instytucji lub organizacji upoważnionej przez centralną władzą koordynującą, zgodnie z artykułem 2 ustęp 3;

c) określenie „przepisy prawne”

obejmuje, oprócz ustawodawstwa i przepisów, orzeczenia arbitrażowe i układy zbiorowe mające moc prawną;

d) określenie „marynarze” oznae

cza osoby zatrudnione w jakimkolwiek charakterze na statku morskim, do którego stosuje się niniejsza konwencja. W przypadku wątpliwości, czy pewne kategorie osób mają być uznane za marynarzy dla celów niniejszej konwencji, kwestia ta będzie określana przez centralną władzę koordynującą, po konsultacji z zainteresowanymi organizacjami armatorów i marynarzy;

określenie „warunki pracy i życia marynarzy” oznacza warunki dotyczące standardów utrzymania i czystości dziedzin życia i pracy na statku, minimalnego wieku, umów najmu, żywności i zaopatrzenia, zakwaterowania załogi, rekrutacji, utrzymania stanu załogi, kwalifikacji, czasu pracy, badań lekarskich, zapobiegania wypadkom zawodowym, opieki lekarskiej, świadczeń chorobowych i wypadkowych, ochrony socjalnej i spraw z nią związanych, repatriacji, okresów i warunków zatrudnienia, które są przedmiotem ustawodawstwa i przepisów krajowych oraz

(b) the term "inspector" means

any civil servant or other public official with responsibility for inspecting any aspect of seafarers” working and living conditions, as well as any other person holding proper credentials performing an inspection for an institution or organization authorized by the central coordinating authority in accordance with Article 2, paragraph 3;

(c) the term "legal provisions” includes, in addition to laws and regulations, arbitration awards and collective agreements upon which the force of law is conferred;

(d)the term ”"seafarers” means

persons who are employed in any capacity on board a seagoing ship to which the Convention applies. In the event of any doubt as to whether any categories of persons are to be regarded as seafarers for the purpose of this Convention, the question shall be determined by the central coordinating authority after consulting the organizations of shipowners and seafarers concerned;

(e) the term "seafarers" working

and living conditions” means the conditions such as those relating to the standards of maintenance and cleanliness of shipboard living and working areas, minimum age, articles of agreement, food and catering, crew accommodation, recruitment, manning, qualifications, hours of work, medical examinations, prevention of occupational accidents, medical care, sickness and injury benefits, social welfare and related matters, repatriation, terms and conditions of employment which are subject to national laws and regula-

c) Fexpression «dispositions lćgales» couvre, outre la lógislation nationale, les sentences arbitrales et les conventions collectives ayant force obligatoire;

d) I'expression «gens de mer» dósigne les personnes employćes, a quelgue titre que ce soit, a bord d'un navire de mer auquel la convention s'applique. En cas de doute sur les catógories de personnes devant, aux fins de la prósente convention, €tre considóćróes comme des gens de mer, la question sera róglóe par IFautoritć centrale de coordination apres consultation des organisations d'armateurs et de gens de mer intóressćes;

e) I' expression «conditions de travail et de vie des gens de mer» dósigne les conditions telles que celles concernant les normes d'entretien et de propretć des lieux de vie et de travail a bord, Fage minimum, les contrats dengagement, I'alimentation et le service de table, le logement de I'ćquipage, le recrutement, les effectifs, les qualifications, la duróe du travail, les examens módicaux, la próvention des accidents du travail, les soins módicaux, les prestations de maladie et d'accident, le bien-6tre et les questions connexes, le rapatriement, les conditions et modalitós d'em-

Część II Organizacja inspekcji Artykuł 2

1. Każdy Członek wykonujący postanowienia konwencji będzie utrzymywał system inspekcji warunków pracy i życia marynarzy.

2. Centrala władza koordynująca będzie koordynowała, catkowicie lub częściowo, inspekcje dotyczące warunków pracy i życia marynarzy oraz ustali zasady, jakie mają być przestrzegane.

3. Centralna władza koordynująca będzie we wszystkich przypadkach odpowiedzialna za inspekcje warunków pracy i życia marynarzy. Może ona upoważnić instytucje publiczne lub inne organizacje, które uznaje za kompetentne i niezależne do przeprowadzania inspekcji warunków pracy i życia marynarzy w jej imieniu. Będzie ona utrzymywała i udostępni publicznie listę takich instytucji lub organizacji.

Artykuł 3

1. Każdy Członek zapewni przeprowadzanie inspekcji na wszystkich statkach zarejestrowanych na jego terytorium w okresie nieprzekraczającym trzech lat, a tam gdzie to praktycznie możliwe corocznie, w celu sprawdzenia, czy warunki pracy i życia marynarzy są zgodne z ustawodawstwem i przepisami krajowymi.

2. Jeżeli Członek otrzyma skargę lub uzyska dowód, że statek zarejestrowany na jego terytorium nie spełnia wymogów ustawodawstwa i przepisów krajowych dotyczących pracy i życia marynarzy, Członek ten podejmie działania w celu przeprowadzenia inspekcji statku, tak szybko jak to możliwe.

Part II Organization of inspection Article 2

1. Each Member for which the Convention is in force shall maintain a system of inspection of seafarers” working and living conditions.

2. The central coordinating authority shall coordinate inspections wholly or partly concerned with seafarers” working and living conditions and shall establish principles to be observed.

3. The central coordinating authority shall in all cases be responsible for the inspection of seafarers' working and living conditions. It may authorize public institutions or other organizations it recognizes as competent and independent to carry out inspections of seafarers' working and living conditions on its behalf. It shall maintain and make publicly available a list of such institutions or organizations.

Article 3

1. Each Member shall ensure that all ships registered in its territory are inspected at intervals not exceeding three years and, when practicable, annually, to verify that the seafarers' working and living conditions on board conform to national laws and regulations.

2. If a Member receives a complaint or obtains evidence that a ship registered in its territory does not conform to national laws and regulations in respect of seafarers” working and living conditions, the Member shall take measures to inspect the ship as soon as practicable.

Partie II Organisation de I'inspection Article 2

2. L'autoritć centrale de coordination devra coordonner les inspections entierement ou partiellement consacróes aux conditions de travail et de vie des gens de mer, et ćtablir des principes a respecter.

3. L'autorite centrale de coordination assumera dans tous les cas la responsabilitć de Finspection des conditions de travail et de vie des gens de mer. Elle pourra autoriser des institutions publiques ou d'autres organisations dont elle reconnait la compótence et I'indćpendance a procóder, en son nom, a une telle inspection. Elle devra tenir a jour et mettre a disposition du public une liste de ces institutions ou organisations.

Article 3

1. Chaque Membre veillera a ce que tous les navires immatriculós sur son territoire soient inspectós a des intervalles n'excódant pas trois ans et, lorsque cela est realisable, chaque annće, afin de vćrifier que les conditions de travail et de vie des gens de mer a bord sont conformes a la lógislation nationale.

2. Si un Membre regoit une plainte ou acquiert la preuve qu'un navire immatriculć sur son territoire ne se conforme pas a la lógislation nationale concernant les conditions de travail et de vie des gens de mer, le Membre devra prendre des mesures pour procóder a I'inspection du navire des que cela est rćalisable.

Artykuł 4

Każdy Członek wyznaczy inspektorów wykwalifikowanych do wykonywania obowiązków i podejmie niezbędne kroki dla upewnienia się, że liczba inspektorów jest wystarczająca do spełniania wymogów niniejszej konwencji.

Artykuł 5

1. Inspektorzy posiadają status i warunki pracy zapewniające im niezależność od zmian rządowych i niewłaściwych wpływów zewnętrznych.

2. Inspektorzy wyposażeni w odpowiednie pełnomocnictwa mają prawo do:

a) wchodzenia na pokład statku zarejestrowanego na terytorium Członka i do innych miejsc niezbędnych do inspekcji;

b) przeprowadzania badań, testów lub śledztwa, które mogą uznawać za niezbędne w celu upewnienia się, że przepisy prawne są ściśle przestrzegane;

c) wymagania, aby nieprawidłowości zostały naprawione; i

d) zakazu opuszczania portu przez statek do momentu podjęcia niezbędnych środków, jeśli mają podstawy sądzić, że nieprawidłowości stanowią znaczne zagrożenie dla zdrowia i bezpieczeństwa marynarzy, pod warunkiem zapewnienia praw do odwołania się do władz sądowniczych lub administracyjnych, statek nie może być zatrzymany lub opóźniony bez ważnego powodu.

Artykuł 6

1. W czasie przeprowadzania inspekcji lub kiedy podejmowane są działania zgodne z niniejszą konwencją należy dołożyć wszelkich starań, aby uniknąć nieuzasadnionego zatrzymania lub opóźnienia statku.

Article 4

Each Member shall appoint inspectors qualified for the performance of their duties and shall take the necessary steps to satisfy itself that inspectors are available in sufficient number to meet the requirements of this Convention.

Article 5

1. lnspectors shall have the status and conditions of service to ensure that they are independent of changes of government and of improper external influences.

2. Inspectors provided with proper credentials shall be empowered:

(a)to board a ship registered in the territory of the Member and to enter premises as necessary for inspection;

(b) to carry out any examination, test or inquiry which they may consider necessary in order to satisfy themselves that the legal provisions are being strictly observed;

(c) to require that deficiencies are remedied; and

(d) where they have grounds to believe that a deficiency constitutes a significant danger to seafarers' health and safety, to prohibit, subject to any right of appeal to a judicial or administrative authority, a ship from leaving port until necessary measures are taken, the ship not being unreasonably detained or delayed.

Article 6

1. When an inspection is conducted or when measures are taken under this Convention, all reasonable efforts shall be made to avoid a ship being unreasonably detained or delayed.

Article 5

2. Les inspecteurs, munis de pieces justificatives de leurs fonctions, seront autorisós:

a) a monter a bord des navires immatriculós dans le territoire du Membre et a pónćtrer dans les locaux a des fins d'inspection;

b)a procóder a tous examens, contróles ou enqućtes qu'ils jugent nócessaires pour s'assurer que les dispositions lćgales sont strictement respectćes;

c) a exiger qur'il soit remódić aux carences;

d) a interdire, sous róserve de tout droit de recours devant I'autoritć administrative ou I'autoritć judiciaire, a un navire de quitter le port jusqu'a ce que les dispositions nócessaires aient ćtć prises, lorsqu'ils ont des raisons de croire qu'une carence constitue un danger significatif pour la santć et la sócuritć des gens de mer, le navire ne devant pas €tre indiment retenu ou retardć.

Article 6

1. Lorsqu'il sera procódć a une inspection ou lorsque des mesures seront prises conformóment aux dispositions de la prósente convention, tous les efforts raisonnables devront 6tre dóćployćs pour ćviter que le navire ne soit indliment retenu ou retardć.

Nr 139

2. Jeżeli statek jest bez wyraźnego powodu zatrzymany lub opóźniony, armator lub użytkownik statku będzie uprawniony do odszkodowania za każdą poniesioną stratę lub szkodę. W każdym przypadku zarzutu nieuzasadnionego zatrzymania lub opóźnienia, ciężar dowodu będzie spoczywał na armatorze lub użytkowniku statku.

Część III Kary

Artykuł 7

1. Stosowne kary, nakładane przez inspektorów za naruszanie przepisów prawnych i utrudnianie wypełniania ich obowiązków, będą przewidziane w ustawodawstwie krajowym lub regulacjach prawnych.

2. Inspektorzy mają, według swego uznania, prawo do udzielania upomnień i porad zamiast rozpoczynania lub zalecania wszczynania postępowania.

Część IV Raporty

Artykuł 8

1. Centralna władza koordynująca będzie utrzymywała wykazy inspekcji warunków pracy i życia marynarzy.

2. Będzie ona publikowała coroczny raport na temat działań inspekcyjnych, w tym listę instytucji i organizacji upoważnionych do przeprowadzania inspekcji w jej imieniu. Raport będzie publikowany w uzasadnionym czasie po zakończeniu roku, którego dotyczy, nie później jednak niż w ciągu sześciu miesięcy.

Artykuł 9

1. Inspektorzy będą przedkładali centralnej władzy koordynującej raport z każdej inspekcji. Jedna kopia raportu w języku angielskim lub innym języku roboczym statku będzie przekazywana kapitanowi statku, a następna będzie wywieszana na tablicy informacyjnej statku, aby poinformować marynarzy lub przesłana do ich przedstawicieli.

2. If a ship is unreasonably detained or delayed, the shipowner or operator of the ship shall be entitled to compensation for any loss or damage suffered. In any instance of alleged unreasonable detention or delay, the burden of proof shall lie with the shipowner or operator of the ship.

Part III Penalties

Article 7

1. Adequate penalties for violations of the legal provisions enforceable by inspectors and for obstructing inspectors in the performance of their duties shall be provided for by national laws or regulations and shall be effectively enforced.

2. Inspectors shall have the discretion to give warnings and advice instead of instituting or recommending proceedings.

Part IV Reports

Article 8

1. The central coordinating authority shall maintain records of inspections of seafarers' working and living conditions.

2. It shall publish an annual report on inspection activities, including a list of institutions and organizations authorized to carry out inspections on its behalf. This report shall be published within a reasonable time after the end of the year to which it relates and in any case within six months.

Article 9

1. Inspectors shall submit a report of each inspection to the central coordinating authority. One copy of the report in English or in the working language of the ship shall be furnished to the master of the ship and another copy shall be posted on the ship's notice board for the information of the seafarers or sent to their representatives.

2. L'armateur ou I'exploitant du navire pourra prótendre a une compensation pour tout prójudice ou perte qui rósulterait d'une telle immobilisation ou d'un tel retard indu, la charge de la preuve lui incombant.

Partie III Sanctions

Article 7

1. Des sanctions approprióes pour violation des dispositions lógales dont I'application incombe aux inspecteurs et pour obstruction faite aux inspecteurs dans I'exercice de leurs fonctions devront 6tre próvues par la lśgislation nationale et effectivement appliqućes.

2. Les inspecteurs auront la facultć de donner des avertissements et des conseils au leiu d'intenter ou de recommander des poursuites.

Partie IV Rapports

Article 8

1. L'autoritć centrale de coordination tiendra des registres des inspections des conditions de travail et de vie des gens de mer.

2. Elle publiera un rapport annuel sur les activitćs d'inspection, y compris une liste des institutions et organisations autorisóes a procóder a des inspections en son nom. Ce rapport devra €tre publić dans un dólai raisonnable, ne dópassant en aucun cas six mois, a partir de la fin de I'annće a laquelle il se rófere.

Article 9

1. Les inspecteurs devront, pour toute inspection effectuće, soumettre un rapport a I'autoritć centrale de coordination. Une copie de ce rapport en langue anglaise ou dans la langue de travail du navire sera remise au capitaine, une autre sera affichóće sur le tableau d'affichage du navire pour "information des gens de mer a bord ou communiquće a leurs reprósentants.

2. W przypadku inspekcji przeprowadzonej w wyniku poważnego wypadku, raport będzie przedłożony tak szybko jak to tylko możliwe, ale nie później jednak niż miesiąc po sporządzeniu wniosków z inspekcji.

Część V Postanowienie końcowe

Artykuł 10

Niniejsza konwencja zastępuje Zalecenie dotyczące inspekcji pracy marynarzy, z 1926 r.

Artykuł 11

Dyrektor Generalny Międzynarodowego Biura Pracy zostanie poinformowany o formalnych ratyfikacjach niniejszej konwencji w celu ich zarejestrowania.

Artykuł 12

1. Niniejsza konwencja będzie obowiązywała tylko tych Członków Międzynarodowej Organizacji Pracy, których ratyfikacje zostaną zarejestrowane przez Dyrektora Generalnego Międzynarodowego Biura Pracy.

2. Wejdzie ona w życie po upływie 12 miesięcy od daty zarejestrowania przez Dyrektora Generalnego ratyfikacji niniejszej konwencji przez dwóch Członków.

3. Następnie niniejsza konwencja wejdzie w życie dla każdego Członka po uptywie 12 miesięcy od daty zarejestrowania jego ratyfikacji.

Artykuł 13

1. Każdy Członek, który ratyfikował niniejszą konwencję, może ją wypowiedzieć po upływie dziesięciu lat od daty początkowego wejścia jej w życie aktem przekazanym Dyrektorowi Generalnemu Międzynarodowego Biura Pracy i przez niego zarejestrowanym. Wypowiedzenie to nabierze mocy po upływie jednego roku od daty jego zarejestrowania.

2. Każdy Członek, który ratyfikował niniejszą konwencję, a który w ciągu roku po upływie dziesięcioletniego okresu, wymienionego w poprzednim ustępie, nie skorzy-

2. In case of an inspection pursuant to a major incident, the report shall be submitted as soon as practicable but not later than one month following the conclusion of the inspection.

Part V Final provisions

Article 10

This Convention supersedes the Labour Inspection (Seamen) Recommendation, 1926.

Article 11

The formal ratifications of this Convention shall be communicated to the Director-General of the International Labour Office for registration.

Article 12

1. This Convention shall be binding only upon those Members of the International Labour Organization whose ratifications have been registered with the Director- -General of the International Labour Office.

2. It shall come into force 12 months after the date on which the ratifications of two Members have been registered with the Director-General.

3. Thereafter, this Convention shall come into force for any Member 12 months after the date on which its ratification has been registered.

Article 13

1. AMember which has ratified this Convention may denounce it after the expiration of ten years from the date on which the Convention first comes into force, by an act communicated to the Director-General of the International Labour Office for registration. Such denunciation shall not take effect until one year after the date on which it is registered.

Article 10

La prósente convention remplace la recommandation sur Il'inspection du travail (gens de mer), 1926.

Article 11

Les ratifications formelles de la prósente convention seront communiqućes au Directeur gónćral du Bureau international du Travail et par lui enregistróes.

Article 12

1. La prósente convention ne liera que les Membres de I'Organisation internationale du Travail dont la ratification aura ćtć enregistróe par le Directeur gónćral du Bureau international du Travail.

2. Elle entrera en vigueur douze mois apres que les ratifications de deux Membres auront ćtć enregistróes par le Directeur gónóral.

3. Par la suite, cette convention entrera en vigueur pour chaque Membre douze mois apres la date ou sa ratification aura ćtóć enregistróe.

Article 13

1. Tout Membre ayant ratifić la prósente convention peut la dśnoncer a l'expiration d'une póriode de dix annćes apres la date de la mise en vigueur initiale de la convention, par un acte communiquć au Directeur gónćral du Bureau international du Travail et par lui enregistrć. La dónonciation ne prendra effet qu'une annóće apres avoir ćtć enregistróe.

Artykuł 14

1. Dyrektor Generalny Międzynarodowego Biura Pracy zawiadomi wszystkich Członków Międzynarodowej Organizacji Pracy o zarejestrowaniu wszystkich ratyfikacji i aktów wypowiedzenia przekazanych mu przez Członków Organizacji.

2. Zawiadamiając Członków Organizacji o zarejestrowaniu drugiej zgłoszonej mu ratyfikacji, Dyrektor Generalny zwróci uwagę Członków Organizacji na datę wejścia w życie niniejszej konwencji.

Artykuł 15

Dyrektor Generalny Międzynarodowego Biura Pracy udzieli Sekretarzowi Generalnemu Organizacji Narodów Zjednoczonych w celu zarejestrowania, zgodnie z artykułem 102 Karty Narodów Zjednoczonych, wyczerpujących informacji o wszystkich ratyfikacjach i aktach wypowiedzenia, które zarejestrował zgodnie z postanowieniami poprzednich artykułów.

Artykuł 16

Rada Administracyjna Międzynarodowego Biura Pracy, w każdym przypadku, gdy uzna to za potrzebne, przedstawi Konferencji Ogólnej sprawozdanie ze stosowania niniejszej konwencji i rozpatrzy, czy należy wpisać na porządek dzienny Konferencji sprawę całkowitej lub częściowej jej rewizji.

Artykuł 17

1. W razie przyjęcia przez Konferencję nowej konwencji wprowadzającej całkowitą lub częściową rewizję niniejszej konwencji i o ile nowa konwencja nie stanowi inaczej:

Article 14

1. The Director-General of the International Labour Office shall notify all Members of the International Labour Organization of the registration of all ratifications and denunciations communicated by the Members of the Organization.

Article 15 The Director-General of the International Labour Office shall

communicate to the Secretary-General of the United Nations, for registration in accordance with Article 102 of the Charter of the United Nations, full particulars of all ratifications and acts of denunciation registered by the Director-General in accordance with the provisions of the preceding Articles.

Article 16

At such times as it may consider necessary, the Governing Body of the International Labour Office shall present to the General Conference a report on the working of this Convention and shall examine the desirability of placing on the agenda of the Conference the question of its revision in whole or in part.

Article 17

1. Should the Conference adopt a new Convention revising this Convention in whole or in part, then, unless the new Convention otherwise provides —

(a) the ratification by a Member of the new revising Conven-

Article 15

Le Directeur gónóral du Bureau international du Travail communiquera au Secrótaire gónćral des Nations Unies, aux fins d'enregistrement, conformóment a [article 102 de la Charte des Nations Unies, des renseignements complets au sujet de toutes ratifications et de tous actes de dónonciation quil aura enregistrós _conformóment aux articles prócódents.

Article 16

Chaque fois qu'il le jugera nócessaire, le Conseil d' administration du Bureau international du Travail prósentera a la Confórence gónćrale un rapport sur I'application de la prósente convention et examinera s'il y a lieu d'inscrire a I'ordre du jour de la Confćrence la question de sa róvision totale ou partielle.

Article 17

1. Au cas ou la Confórence adopterait une nouvelle convention portant revision totale ou partielle de la prósente convention, et a moins que la nouvelle convention ne dispose autrement:

a) la ratification par un Membre de la nouvelle convention por-

b) począwszy od daty wejścia w życie nowej konwencji wprowadzającej rewizję, niniejsza konwencja przestanie być otwarta do ratyfikacji przez Członków.

2. Niniejsza konwencja pozostanie w każdym razie w mocy w swej aktualnej formie i treści dla tych Członków, którzy ją ratyfikowali, a nie ratyfikowali konwencji wprowadzającej rewizję.

Artykuł 18

Teksty angielski i francuski niniejszej konwencji są jednakowo autentyczne.

Powyższy tekst jest autentycznym tekstem konwencji przyjętej należycie przez Konferencję Ogólną Międzynarodowej Organizacji Pracy na jej osiemdziesiątej czwartej sesji, która odbyła się w Genewie i została ogłoszona zamkniętą w dniu 22 października 1996 r.

(b) as from the date when the new revising Convention comes into force, this Convention shall cease to be open to ratification by the Members.

2. This Convention shall in any case remain in force in its actual from and content for those Members which have ratified it but have not ratified the revising Convention.

Article 18

The English and French versions of the text of this Convention are equally authoritative.

The foregoing is the authentic text of the Convention duly adopted by the General Conference of the International Labour Organization during its Eightyfourth Session which was held at Geneva and declared closed 22 October 1996.
