709 OŚWIADCZENIE RZĄDOWE
z dnia 31 lipca 2002 r.
w sprawie mocy obowiązującej Rzymskiego Statutu Międzynarodowego Trybunału Karnego, sporządzonego w Rzymie dnia 17 lipca 1998 r.
Podaje się niniejszym do wiadomości, że zgodnie z ustawą z dnia 5 lipca 2001 r. o ratyfikacji Rzymskiego Statutu Międzynarodowego Trybunału Karnego (Dz. U. Nr 98, poz. 1065), sporządzonego w Rzymie dnia 17 lipca 1998 r., Prezydent Rzeczypospolitej Polskiej ratyfikował dnia 9 października 2001 r. wyżej wymieniony statut. Dnia 12 listopada 2001 r. złożono Sekretarzowi Generalnemu Organizacji Narodów Zjednoczonych, jako depozytariuszowi, dokument ratyfikacyjny.
Zgodnie z artykułem 126 ust. 1 powyższego statutu wszedł on w życie dnia 1 lipca 2002 r. W tym samym dniu wszedł w życie także w stosunku do Rzeczypospolitej Polskiej.
Jednocześnie podaje się do wiadomości, co następuje:
1. Przy składaniu dokumentu ratyfikacyjnego Rzeczpospolita Polska złożyła następującą deklarację:
„W odniesieniu do artykułu 87 ustęp 2 statutu Rzeczpospolita Polska oświadcza, że wnioski o współpracę składane przez Trybunał oraz załączone dokumenty sporządzane będą w języku polskim.”
2. Andory oświadcza, że wszystkie wnioski o współpracę, sporządzone przez Trybunał zgodnie z częścią IX statutu, muszą być przekazywane drogą dyplomatyczną.
Stosownie do artykutu 87 ustęp 2 Rzymskiego Statutu Międzynarodowego Trybunału Karnego Księstwo Andory oświadcza, że wszystkie wnioski o współpracę i jakiekolwiek dokumenty popierające wnioski otrzymywane z Trybunału muszą być, zgodnie z artykułem 50 statutu, ustanawiającym języki arabski, chiński, angielski, francuski, rosyjski i hiszpański językami urzędowymi Trybunału, sporządzane w języku francuskim lub hiszpańskim albo, w razie konieczności, dołącza się do nich ttumaczenie na jeden z tych języków.
Stosownie do artykułu 103 ustęp 1 (a) i (b) Rzymskiego Statutu Międzynarodowego Trybunału Karnego Księstwo Andory oświadcza, że w razie konieczności zadeklaruje wolę przyjęcia obywateli Andory skazanych przez Trybunał, pod warunkiem, że wyrok wydany przez Trybunał będzie wykonalny zgodnie z ustawodawstwem Andory dotyczącym maksymalnego okresu trwania skazania.

W odniesieniu do artykułu 87 ustęp 2 statutu Republika Argentyńska niniejszym oświadcza, że wnioski Trybunału o współpracę oraz wszelkie załączone dokumenty będą sporządzane w języku hiszpańskim lub dołącza się do nich tłumaczenie na język hiszpański.
(„With regard to article 87, paragraph 2, of the Statute, the Argentine Republic hereby declares that requests for cooperation coming from the Court, and any accompanying documentation, shall be in Spanish or shall be accompanied by a translation into Spanish. ”)

AUSTRALIA Deklaracja:
Rząd Australii po rozważeniu statutu niniejszym go ratyfikuje w imieniu Australii z następującym oświadczeniem, którego postanowienia mają pełną moc w prawie australijskim i które nie jest zastrzeżeniem:
Australia odnotowuje, że sprawa będzie niedopuszczalna przed Międzynarodowym Trybunatem Karnym (Trybunałem), gdy jest ona przedmiotem postępowania karnego w państwie. Australia potwierdza pierwszeństwo swojej jurysdykcji karnej w odniesieniu do zbrodni podlegających jurysdykcji Trybunału. Aby umożliwić Australii skuteczne wykonywanie jej jurysdykcji i petne przestrzeganie zobowiązań wynikających ze Statutu Trybunału, żadna osoba nie będzie dostarczona Trybunałowi przez Australię, dopóki [Australia] nie będzie miała petnej możliwości przeprowadzenia postępowania karnego odnośnie do jakichkolwiek zarzucanych zbrodni. Stosownie do artykułu 87 ustęp 2 Statutu Rzymskiego Republika Austrii oświadcza, że wnioski o współpracę i jakiekolwiek dokumenty popierające wnioski będą sporządzane w języku niemieckim lub dołącza się do nich tłumaczenie na ten język.

KRÓLESTWO BELGII Deklaracja dotycząca artykułu 31 ustęp 1 (c):
Stosownie do artykułu 21 ustęp 1 (b) statutu oraz mając na względzie zasady międzynarodowego prawa humanitarnego, które nie mogą być naruszane, Rząd Belgii uważa, że artykuł 31 ust. 1 (c) statutu może być stosowany i interpretowany wyłącznie w zgodzie z tymi zasadami.

ARABSKA REPUBLIKA EGIPTU Deklaracja:
1. Stosownie do artykułu 87 ustępy 1 i 2 Arabska Republika Egiptu oświadcza, że Ministerstwo Sprawiedliwości będzie organem odpowiedzialnym za zajmowanie się wnioskami o współpracę z Trybunałem. Takie wnioski będą przekazywane drogą dyplomatyczną. Wnioski o współpracę i jakiekolwiek dokumenty popierające wniosek będą sporządzane w języku arabskim, będącym urzędowym językiem Państwa, i będzie do nich dołączane ttumaczenie na język angielski będący jednym z roboczych języków Trybunału.
2. Arabska Republika Egiptu potwierdza duże znaczenie Statutu interpretowanego i stosowanego zgodnie z ogólnymi zasadami i fundamentalnymi prawami powszechnie uznanymi i zaakceptowanymi przez całą społeczność międzynarodową oraz zgodnie z zasadami, celami i postanowieniami Karty Narodów Zjednoczonych, jak również z ogólnymi zasadami i regułami prawa międzynarodowego i międzynarodowego prawa humanitarnego. Ponadto oświadcza, że będzie interpretowała i stosowała znajdujące się w Statucie Trybunału odwołania do dwóch pojęć — fundamentalnych praw i międzynarodowych standardów, rozumiejąc je w ten sposób, że odwołania te odnoszą się do fundamentalnych praw i międzynarodowo uznanych norm i standardów akceptowanych przez społeczność międzynarodową jako całość.
3. Arabska Republika Egiptu oświadcza, że jej rozumienie warunków, środków i reguł, które znajdują się we wprowadzającym ustępie artykułu 7 Statutu Trybunału, jest takie, iż będą one miaty zastosowanie do wszystkich czynów wymienionych w tym artykule.
4. Arabska Republika Egiptu oświadcza, że jej rozumienie artykułu 8 Statutu Trybunału będzie następujące:

KONFEDERACJA SZWAJCARSKA
Wnioski o współpracę składane przez Trybunał w oparciu o artykuł 87 ustęp 1 (a) statutu będą przekazywane do Centralnego Biura Współpracy z Międzynarodowym Trybunałem Karnym w Federalnym Departamencie Sprawiedliwości.
Językami urzędowymi w rozumieniu artykułu 87 ustęp 2 statutu będą języki francuski, niemiecki i włoski.
Trybunał może przekazywać informacje na temat podjętych decyzji i innych proceduralnych kroków czy dokumentów osobom, do których te decyzje lub dokumenty są adresowane w Szwajcarii, bezpośrednio poprzez pocztę. Do wszelkich wezwań do zgłoszenia się do Trybunału w charakterze świadka lub biegłego dołączony będzie przepis Reguł Procesowych i Dowodowych Trybunału dotyczący samooskarżenia; przepis ten zostanie przedstawiony zainteresowanej osobie w języku, który będzie przez nią zrozumiały.
W związku z artykułem 103 ustęp 1 statutu Szwajcaria oświadcza, że przejmie odpowiedzialność za wykonanie przekazanych przez Trybunał kar pozbawienia wolności orzeczonych wobec obywateli Szwajcarii i osób mających stałe miejsce zamieszkania w Szwajcarii.
(„Requests for cooperation made by the Court under article 87, paragraph 1 (a), of the Statute shall be transmitted to the Central Office for Cooperation with the International Criminal Court of the Federal Bureau of Justice.
The official languages within the meaning of article 87, paragraph 2, of the Statute, shall be French, German an ltalian.
The Court may serve notice of its decisions and other procedural steps or documents on the persons to whom such decisions or documents are addressed in Switzerland directly through the mail. KRÓLESTWO SZWECJI
W związku ze złożeniem dokumentu ratyfikacyjnego Rzymskiego Statutu Międzynarodowego Trybunału Karnego i odnośnie do zbrodni wojennych wymienionych w artykule 8 statutu, który odnosi się do metod prowadzenia wojny, Rząd Królestwa Szwecji pragnie powołać się na Opinię Doradczą Międzynarodowego Trybunału Sprawiedliwości z dnia 8 lipca 1996 r. w sprawie legalności groźby lub użycia broni jądrowej, a w szczególności ustępów od 85 do 87 tej opinii, w której Trybunał stwierdza, że nie może być wątpliwości co do stosowania prawa humanitarnego w przypadku użycia broni jądrowej.

W odniesieniu do artykułu 87 ustęp 1 Rzymskiego Statutu Międzynarodowego Trybunału Karnego Królestwo Szwecji oświadcza, że wszystkie wnioski o współpracę, sporządzone przez Trybunał na podstawie części IX statutu, muszą być przekazywane za pośrednictwem Szwedzkiego Ministerstwa Sprawiedliwości.

w pełni uprawnień wynikających ze statutu w takim zakresie, w jakim jest właściwa w tej kwestii, oraz w ścisłym związku z przepisami konstytucyjnymi Republiki.
Stosownie do przepisów części 1X statutu zatytułowanej „Współpraca międzynarodowa i pomoc prawna” organ wykonawczy w terminie sześciu miesięcy przedstawia organowi ustawodawczemu ustawę określającą procedurę w celu zapewnienia stosowania Statutu.

As a State party to the Rome Statute, the Eastern Republic of Uruguay shall ensure its application to the full extent of the powers of the Statute insofar as it is competent in that respect and in strict accordance with the Constitutional provisions of the Republic.

Zjednoczone Królestwo Wielkiej Brytanii i Irlandii Północnej rozumie użyte w artykule 8 ustęp (2) (b) i (e) pojęcie: „ustalone ramy prawa międzynarodowego” jako obejmujące międzynarodowe prawo zwyczajowe ustalone przez praktykę państwa i doktrynę prawną.
W tym kontekście Zjednoczone Królestwo potwierdza i zwraca uwagę Trybunału na swój punkt widzenia wyrażony, inter alia, w swoich oświadczeniach
złożonych przy ratyfikacji stosownych instrumentów prawa międzynarodowego włącznie z Protokotem Dodatkowym do Konwencji Genewskich z dnia 12 sierpnia 1949 r. odnoszącym się do ochrony ofiar międzynarodowych konfliktów zbrojnych (Protokół I) z dnia 8 czerwca 1977 r.
Zjednoczone Królestwo oświadcza stosownie do artykułu 87 ustęp (2) statutu, że wnioski o współpracę i jakiekolwiek dokumenty popierające wnioski muszą być sporządzone w języku angielskim.

4. W zawiadomieniu otrzymanym 6 maja 2002 r. Rząd Stanów Zjednoczonych Ameryki poinformował Sekretarza Generalnego o następującym:
Niniejszym informuję, w związku z Rzymskim Statutem Międzynarodowego Trybunału Karnego przyjętym 17 lipca 1998 r., że Stany Zjednoczone nie zamierzają stać się stroną tego traktatu. W związku z tym Stany Zjednoczone nie mają żadnych zobowiązań prawnych wynikających z podpisania statutu w dniu 31 grudnia 2000 r. Stany Zjednoczone wnoszą o to, aby ich zamiar wyrażony w tym piśmie został odzwierciedlony w liście depozytariusza odnoszącej się do statusu tego traktatu.”
