PREZYDENT RZECZYPOSPOLITEJ POLSKIEJ

podaje do powszechnej wiadomości:

W dniu 28 sierpnia 1952 r. w Paryżu został sporządzony Protokół dotyczący statusu międzynarodowych dowództw wojskowych, ustanowionych na podstawie Traktatu Pótnocnoatlantyckiego, w następującym brzmieniu:

Przektad PROTOKÓŁ

dotyczący statusu międzynarodowych dowództw wojskowych,

ustanowionych na podstawie Traktatu Północnoatlantyckiego,

Strony Traktatu Północnoatlantyckiego, podpisanego w Waszyngtonie dnia 4 kwietnia 1949 r.,

biorąc pod uwagę, że na ich terytoriach, na podstawie Traktatu Północnoatlantyckiego, mogą być ustanowione, na mocy odrębnych porozumień, międzynarodowe dowództwa wojskowe oraz

pragnąc określić status tych dowództw i ich personelu na obszarze obowiązywania Traktatu Północnoatlantyckiego,

uzgodniły niniejszy protokół do Umowy sporządzonej w Londynie dnia 19 czerwca 1951 r., dotyczącej statusu ich sił zbrojnych:

Artykuł 1

W niniejszym protokole wyrażenie:

(a) „Umowa” oznacza Umowę sporządzoną w Londynie dnia 19 czerwca 1951 r. przez Strony Traktatu Północnoatlantyckiego dotyczącą statusu ich sił zbrojnych;

(b) „Naczelne Dowództwo” oznacza Naczelne Dowództwo Połączonych Sit Zbrojnych NATO w Europie, kwaterę Naczelnego

on the Status of international military Headquarters set up pursuant to the North Atlantic Treaty

The Parties to the North Atlantic Treaty signed in Washington on 4th April, 1949,

Considering that international military Headquarters may be established in their territories, by separate arrangement, under the North Atlantic Treaty, and

Desiring to define the status of such Headquarters and of the personnel thereof within the North Atlantic Treaty area,

Have agreed to the present Protocol to the Agreement signed in London on 19th June, 1951, regarding the Status of their Forces:

Article 1

In the present Protocol the

expression:

(a) "the Agreement” means the Agreement signed in London on 19th June, 1951, by the Parties to the North Atlantic Treaty regarding the Status of their Forces;

(b) "Supreme Headquarters” means Supreme Headquarters Allied Powers inEurope, Headquarters of the Supreme Allied

Considórant que des Quartiers Gónóraux militaires internationaux pourront €tre ćtablis sur leurs territoires par accords particuliers conclus en vertu du Traitć de | Atlantique Nord,

Dósireux de dófinir le statut de ces Quartiers Gónćraux et du personnel y appartenant, lorsqu ils se trouvent dans la rógion du Traitć de I Atlantique Nord,

Sont convenus du prósent Protocole a la Convention sur le statut de leurs forces, signóe a Londres le 19 juin 1951:

Article 1

Dans le prósent Protocole:

(a) Par «Convention», on entend la Convention signóe a Londres le 19 juin 1951 par les Etats Parties au Traitć de | Atlantique Nord sur le statut de leurs forces; (b) Par «Quartier Gónćral Supreme», on entend le Quartier

Dowódcy Połączonych Sił Zbrojnych na Atlantyku oraz wszelkie równorzędne międzynarodowe dowództwo wojskowe, ustanowione na mocy Traktatu Północnoatlantyckiego;

(c) „Dowództwo Sojusznicze” oznacza wszelkie Naczelne Dowództwo oraz wszelkie międzynarodowe dowództwo wojskowe ustanowione na mocy Traktatu Północnoatlantyckiego, które jest bezpośrednio podporządkowane Naczelnemu Dowództwu;

(d) „Rada Północnoatlantycka” oznacza Radę ustanowioną na mocy artykutu 9 Traktatu Północnoatlantyckiego lub którykolwiek z jej organów pomocniczych upoważnionych do działania w jej imieniu.

Artykuł 2

Z zastrzeżeniem postanowień niniejszego protokołu, Umowę stosuje się do Dowództw Sojuszniczych na terytorium Strony niniejszego protokołu na obszarze obowiązywania Traktatu Północnoatlantyckiego oraz do wojskowego i cywilnego personelu takich Dowództw oraz członków ich rodzin zgodnie z definicjami zawartymi w punktach (a), (b) i (c) ust. 1 artykułu 3 niniejszego protokołu, gdy personel ten znajduje się na określonym wyżej terytorium w związku z pełnieniem obowiązków służbowych lub, w przypadku członków rodzin, w związku z pełnieniem obowiązków służbowych przez ich matżonka lub rodzica.

Artykuł 3

1. Dla celów stosowania Umowy w odniesieniu do Dowództwa Sojuszniczego wyrażenia „siły zbrojne”, „personel cywilny” oraz „członek rodziny”, każdorazowo, kiedy występują w Umowie, posiadają znaczenie określone poniżej:

(a) „siły zbrojne” oznacza personel przy Dowództwie Sojuszniczym, należący do lądowych, morskich lub powietrznych sił zbrojnych którejkolwiek ze Stron Traktatu Pótnocnoatlantyckiego;

(b) „personel cywilny” oznacza pracowników cywilnych nie będących osobami o statusie bezpaństwowca ani też obywa-

(c) "Allied Headquarters” means any Supreme Headquarters and any international military Headquarters set up pursuant to the North Atlantic Treaty which is immediately subordinate to a Supreme Headquarters;

(d) "North Atlantic Council” means the Council established by Article 9 of the North Atlantic Treaty or any of its subsidiary bodies authorised to act on its behalf.

Article 2

Subject to the following provisions of this Protocol, the Agreement shall apply to Allied Headquarters in the territory of a Party to the present Protocol in the North Atlantic Treaty area, and to the military and civilian personnel of such Headquarters and their dependents included in the definitions in sub- -paragraphs (a), (b) and (c) of paragraph I of Article 3 of this Protocol, when such personnel are present in any such territory in connection with their official duties or, in the case of dependents, the official duties of their spouse or parent.

Article 3

1. For the purpose of applying the Agreement to an Allied Headquarters the expressions "force", "civilian component” and "dependent”, wherever they occur in the Agreement, shall have the meanings set out below:

(a) "force" means the personnel attached to the Allied Headquarters who belong to the land, sea or air armed services ofany Party to the North Atlantic Treaty;

(b) "civilian component” means civilian personnel who are not stateless persons, nor nationals of any State which is not a Par-

(d) Par «Conseil de I Atlantique Nord», on entend le Conseil instituć en vertu de | Article 9 du Traitć de | Atlantique Nord, ou chacun des organismes subsidiaires autorisós a agir en son nom.

Article 2

Sous róserve des dispositions ci-apres du prósent Protocole, la Convention s appliquera aux Quartiers Gónćraux Interallićs ćtablis sur le territoire d un Etat Partie au prósent Protocole dans la zone du Traitć de | Atlantique Nord, ainsi qu au personnel militaire et civil de ces Quartiers Góneraux et aux personnes a charge de ce personnel, compris dans les dófinitions des alinćas (a), (b) et (c) du paragraphe 1 de I Article 3 du prósent Protocole, lorsque ce personnel se trouve sur I 'un des territoires visćs ci- -dussus pour | exócution du service ou, dans le cas des personnes a charge, pour les besoins du service du conjoint ou du parent.

Article 3

1. Pour I application de la Convention a un Quartier Gónćral Interallićó, les expressions «force», «ćlóćment civil» et «personne a charge», chaque fois qu elles figurent dans la Convention, ont la signification suivante:

(a) Par «force», on entend le personnel affectć a un Quartier Góćnćral Interallić et qui appartient aux Armóes de terre, de meroude| air de toutEtat Partie au Traitć de | Atlantique Nord;

(b) Par «ólóment civil», on entend le personnel civil qui n est ni apatride, ni national d un Etat non Partie au Traitć de | Atlan-

telami jakiegokolwiek państwa, które nie jest stroną Traktatu, nie będących także obywatelami bądź osobami zamieszkałymi na stałe w Państwie przyjmującym, oraz którzy (i) pracują dla Dowództwa Sojuszniczego i są zatrudnieni przez siły zbrojne Strony Traktatu, lub (ii) zgodnie z decyzją Rady Północnoatlantyckiej mieszczą się w kategorii personelu cywilnego zatrudnionego w Dowództwie Sojuszniczym;

(c) „członek rodziny” oznacza współmałżonka członka sił zbrojnych lub personelu cywilnego, zgodnie z definicją zawartą w punktach (a) i (b) niniejszego ustępu, albo dziecko takiego członka znajdujące się pod jego lub jej opieką.

2. Dowództwo Sojusznicze jest uważane dla celów artykułu II, ust. 2 artykułu V, ust. 10 artykułu VII, ust. 2, 3, 4, 7 i 8 artykułu IX oraz artykułu XIII Umowy za siły zbrojne.

Artykuł 4

Prawa i obowiązki, które Umowa przyznaje lub nakłada na Państwo wysyłające lub jego władze w odniesieniu do jego sit zbrojnych, personelu cywilnego lub też członków ich rodzin, są przyznawane w odniesieniu do Dowództwa Sojuszniczego, członków jego personelu i ich rodzin, wobec których zgodnie z artykułem 2 niniejszego protokołu stosuje się Umowę, właściwego Dowództwa Sojuszniczego i władz odpowiedzialnych wobec niego, z wyjątkiem następujących przypadków:

(a) prawo do wykonywania jurysdykcji karnej i dyscyplinarnej przyznane organom wojskowym Państwa wysyłającego na mocy artykułu VII Umowy jest przekazane organom wojskowym Państwa, o ile takie można ustalić, którego prawu wojskowemu podlega zainteresowana osoba;

(b) obowiązki nałożone na Państwo wysyłające lub jego organy na mocy artykułu II, ust. 4 artykutu III, ust. 5(a) i 6(a) artykułu VII, ust. 9 i 10 artykułu VIII i artykułu XIII Umowy odnoszą

ty to the Treaty, nor nationals of, nor ordinarily resident in the receiving State, and who are (i) attached to the Allied Headquarters and in the employ of an armed service of a Party to the North Atlantic Treaty or (ii) in such categories of civilian personnel in the employ of the Allied Headquarters as the North Atlantic Council shall decide;

(c) "dependent" means the spouse of a member of a force or civilian component, as defined in sub-paragraphs (a) and (b) of this paragraph, or a child of such member depending on him or her for support.

2. An Allied Headquarters shall be considered to be a force for the purposes of Article II, paragraph 2 of Article V, paragraph 10 of Article VII, paragraphs 2, 3, 4, 7 and 8 of Article IX, and Article XIII, ofthe Agreement.

Article 4

The rights and obligations which the Agreement gives to or imposes upon the sending State or its authorities in respect of its forces or their civilian components or dependents shall, in respect of an Allied Headquarters and its personnel and their dependents to whom the Agreement applies in accordance with Article 2 of the present Protocol, be vested in or attach to the appropriate Supreme Headquarters and the authorities responsible under it, except that:

(a) the right which is given by Article VII of the Agreement to the military authorities of the sending State to exercise criminal and disciplinary jurisdiction shall be vested in the military authorities of the State, if any, to whose military law the person concerned is subject;

(b) the obligations imposed upon the sending State or its authorities by Article Il, paragraph 4 of Article Ill, paragraphs 5 (a) and 6 (a) of Article VII, paragraphs 9 and 10 of Article VIII, and

(c) Par «personne a charge», on entend le conjoint d un membre d'une force ou d'un ćlóćment civil dófinis aux alinćas (a) et (b) du prósent paragraphe ou les enfants qui sont a leur charge.

2. Un Quartier Gónćral Interallić est considórć comme une force pour|l application de | Article II, du paragraphe 2 de I Article V, du paragraphe 10 de I Article VII, des pragraphes 2, 3, 4, 7 et 8 de | Article IX, et de I Article XIII de la Convention.

Article 4

Les droits et obligations que la Convention confere ou impose a un Etat d origine ou a ses autoritós au sujet de ses forces, de ses ćślóments civils ou de leurs personnes a charge, seront, en ce qui concerne les Quartiers Gónćraux Interallićs, leur personnel et les personnes a charge de ce personnel auxquels s applique la Convention en vertu de I'Article 2 du prósent Protocole, confórós ou dóvolus au Quartier Gónóral Supreme approprić et aux autoritós qui en relevent, sous les róserves ci-apres:

(a) le droit qui est donnć par | Article VII de la Convention aux autoritós militaires de | Etat d origine d exercer les pouvoirs de juridiction pónale et disciplinaire est confórć aux autoritós militaires de | Etat dont la loi militaire s applique ćventuellement a la personne intóressóe;

(b)les obligations imposćes a I'Etat d origine ou a ses autoritós par | Article II, par le paragraphe 4 de I Article III, par les paragraphes 5 (a) et 6 (a) de IfArticle VII, par les paragra-

się zarówno do Dowództwa Sojuszniczego, jak i do każdego Państwa, którego sił zbrojnych lub jakiegokolwiek członka lub pracownika tych sit zbrojnych lub członka jego rodziny to dotyczy;

(c) dla celów ust. 2(a) i 5 artykutu III i artykułu XIV Umowy, w przypadku członków sit zbrojnych i członków ich rodzin, Państwo wysyłające będzie państwem, do którego sit zbrojnych należy dany członek personelu, a w przypadku członków personelu cywilnego i członków ich rodzin, państwem, o ile takie można ustalić, przez którego siły zbrojne dany członek personelu jest zatrudniony;

(d) obowiązki nałożone na Państwo wysyłające na mocy ust. 6 i 7 artykułu VIII Umowy odnoszą się do państwa, do którego sił zbrojnych należy osoba, której działanie lub zaniechanie spowodowało wystąpienie roszczenia lub, w przypadku pracownika personelu cywilnego, do państwa, przez którego siły zbrojne jest on zatrudniony, lub, jeżeli nie ma takiego państwa, do Dowództwa Sojuszniczego, którego pracownikiem jest dana osoba.

Zarówno państwo — jeżeli takowe jest — do którego odnoszą się obowiązki wymienione w niniejszym ustępie, jak i zainteresowane Dowództwo Sojusznicze będą miaty uprawnienia Państwa wysyłającego w związku z wyznaczeniem arbitra zgodnie z ust. 8 artykułu VIII.

Artykuł 5

Każdy członek Dowództwa Sojuszniczego posiada osobistą kartę identyfikacyjną wydaną przez Dowództwo, zawierającą imię i nazwisko, datę i miejsce urodzenia, narodowość, rangę, stopień lub numer (jeśli istnieje), fotografię i okres ważności. Karta taka musi być okazywana na żądanie.

Artykuł 6

1. Obowiązek zrzeczenia się roszczeń nałożony na Umawiające

Article XIII, of the Agreement, shall attach both to the Allied Headquarters and to any State whose armed service, or any member or employee of whose armed service, or the dependent of such member or employee, is concerned;

(c) for the purposes of paragraphs 2 (a) and 5ofArticle III, and Article XIV, of the Agreement, the sending State shall be, in the case of members of a force and their dependents, the State to whose armed service the member belongs, or, in the case of members of a civilian component and their dependents, the State, if any, by whose armed service the member is employed;

(d) the obligations imposed on the sending State by virtue of paragraphs 6 and 7 of Article VIII of the Agreement shall attach to the State to whose armed service the person belongs whose act or omission has given rise to the claim or, in the case of a member of a civilian component, to the State by whose armed service he is employed or, if there is no such State, to the Allied Headquarters of which the person concerned is a member.

Both the State, if any, to which obligations attach under this paragraph and the Allied Headquarters concerned shall have the rights of the sending State in connection with the appointment of an arbitrator under paragraph 8 of Article VIII.

Article 5

Every member of an Allied Headquarters shall have a personal identity card issued by the Headquarters showing names, date and place of birth, nationality, rank or grade, number (if any), photograph and period of validity. This card must be presented on demand.

Article 6

1. The obligations to waive claims imposed on the Contracting

(d)les obligations imposćes a I Etat d origine en vertu des paragraphes 6 et 7 de I Article VIII de la Convention incombent a I Etat aux forces armóes duquel appartient la personne dont l 'acte ou la nógligence a ćtć a |'origine de la demande d indemnitć, ou, dans le cas d un membre d'un ćlóśment civil, a I Etat par les forces armóes duquel il est employć, ou, a dófaut d'un tel Etat, au Quartier Gónóral Interallić auquel la personne en question appartient.

Pour la dćsignation d un arbitre, en application du paragraphe 8 de I'Article VIII, les droits de | Etat d origine sont exercćs a la fois par le Quartier Gónćral Interallić intóressć, etpar| Etat auquel incombent, le cas ćchćant, les obligations dófinies par le prósent paragraphe.

Article 5

Tout membre d'un Quartier Gónćóral Interalliść doit 6tre porteur d une carte d identitć personnelle, dólivróe par ce Quartier Genćral, munie d une photographie et mentionnant les nom, prónoms, date et lleu de naissance, nationalitć, rang ou grade, numóro matricule s ily a lieu, et la duróe de validitć de la carte. Cette carte doit €tre produite a toute róquisition.

Article 6

1. L'obligation de renoncer a toute demande d indemnitć im-

się Strony na mocy artykułu VIII Umowy odnosi się zarówno do Dowództwa Sojuszniczego, jak i do każdej Strony niniejszego protokotu.

2. Dla celów ust. 1 i 2 artykułu VIII Umowy:

(a) własność Dowództwa Sojuszniczego lub Strony niniejszego protokołu, użytkowana przez Dowództwo Sojusznicze, będzie uważana za własność Umawiającej się Strony, użytkowaną przez jej siły zbrojne;

(b) szkoda spowodowana przez członka sit zbrojnych lub personelu cywilnego, określonego zgodnie z ust. 1 artykułu 3 niniejszego protokołu, lub przez każdego innego pracownika Dowództwa Sojuszniczego będzie uważana za szkodę spowodowaną przez członka lub pracownika sił zbrojnych Umawiającej się Strony;

(c) definicja pojęcia „należące do Umawiającej się Strony” określona w ust. 3 artykułu VIII odnosi się również do Dowództwa Sojuszniczego.

3. Roszczenia, do których odnosi się ust. 5 artykułu VIII Umowy, będą obejmować roszczenia (inne niż roszczenia wynikające z kontraktów oraz roszczenia, do których odnosi się ust. 6 lub 7 wspomnianego artykułu) wynikające z działania lub zaniechania każdego pracownika Dowództwa Sojuszniczego lub wynikające z każdego innego działania, zaniechania lub zdarzenia, za które Dowództwo Sojusznicze jest prawnie odpowiedzialne i które spowoduje powstanie szkody na terytorium Państwa przyjmującego wobec stron trzecich, innych niż Strony niniejszego protokołu.

Artykuł 7

1. Zwolnienie z opodatkowania przyznane zgodnie z artykutem X Umowy członkom sit zbrojnych lub personelu cywilnego w odniesieniu do ich wynagrodzeń i dodatków stosuje się w odniesieniu do członków personelu Dowództwa Sojusz-

Parties by Article VIII of the Agreement shall attach both to the Allied Headquarters and to any Party to this Protocol concerned.

2. For the purposes of paragraphs 1 and 2 of Article VIII of the Agreement,

(a) property owned by an Allied Headquarters or by a Party to this Protocol and used by an Allied Headquarters shall be deemed to be property owned by a Contracting Party and used by its armed services;

(b) damage caused by a member of a force or civilian component as defined in paragraph 1 of Article 3 of this Protocol or by any other employee of an Allied Headquarters shall be deemed to be damage caused by a member or employee of the armed services of a Contracting Party;

(c) the definition of the expression "owned by a Contracting Party” in paragraph 3 of Article VIII shall apply in respect of an Allied Headquarters.

3. The claims to which paragraph 5 of Article VIII of the Agreement applies shall include claims (other than contractual claims and claims to which paragraphs 6 or 7 of that Article apply) arising out of acts or omissions of any employees of an Allied Headquarters, or out of any other act, omission or occurrence for which an Allied Headquarters is legally responsible, and causing damage in the territory of a receiving State to third parties, other than any ofthe Parties to this Protocol.

Article 7

1. The exemption from taxation accorded under Article X of the Agreement to members of a force or civilian component in respect of their salaries and emoluments shall apply, as regards personnel of an Allied Headquarters within the defi-

(b) Est considćrć comme dommage causć par un membre des forces armóes de la Partie Contractante ou par un employć de ces forces, tout dommage causć par un membre d une force ou d'un ćlóment civil, tels qu ils sont dófinis au paragraphe 1 de I Article 3 du prósent Protocole, ou par tout autre employć d un Quartier Góćnćral Interallić;

(c) Les dispositions du paragraphe 3 de I Article VIII de la Convention s appliquent a un Quartier Gćnćral Interallić considórć comme « Partie Contractante» aux termes dudit paragraphe.

3. Les demandes d indemnitós visćes au paragraphe 5 de | Article VIII de la Convention comprendront les demandes d indemnitć (autres que celles rósultant de | application d 'un contrat et que celles auxquelles les paragraphes 6 et 7 de cet Article sont applicables) du chef d actes ou de nćgligences d unemployć du Quartier Gónóral Interallić, ou de tout autre acte, nóćgligence ou incident dont un Quartier Gónćral Interallić est lśćgalement responsable et qui ont causć, sur le territoire d unEtat de sćjour, des dommages a untiers autre que | une des Parties au prósent Protocole.

Article 7

niczego, rozumianego zgodnie z definicją zawartą w ust. 1(a) i (b) (i) artykułu 3 niniejszego protokołu, do wynagrodzeń i należności płaconych im jako takiemu personelowi przez siły zbrojne, do których należą lub też przez które są zatrudnieni. Ustęp ten nie zwalnia takiego członka lub pracownika z opodatkowania nałożonego przez państwo, którego jest on obywatelem.

2. Pracownicy Dowództwa Sojuszniczego według kategorii uzgodnionych przez Radę Północnoatlantycką będą zwolnieni z opodatkowania wynagrodzeń i dodatków płaconych im przez Dowództwo Sojusznicze, jako jego pracownikom. Każda Strona niniejszego protokołu może jednakże zawrzeć porozumienie z Dowództwem Sojuszniczym, na mocy którego Strona taka będzie zatrudniać i wyznaczać wszystkich swoich obywateli do Dowództwa Sojuszniczego (z wyjątkiem, jeżeli takie jest życzenie Strony, obywateli, którzy nie posiadają prawa do statego pobytu na jej terytorium), którzy mają służyć jako personel Dowództwa Sojuszniczego, oraz będzie płacić wynagrodzenia i dodatki tym osobom ze swoich własnych środków w zakresie przezeń ustalonym. Powyższe wynagrodzenia i należności mogą być opodatkowane przez zainteresowaną Stronę, lecz będą zwolnione z opodatkowania przez każdą inną Stronę. Jeżeli którakolwiek ze Stron niniejszego protokołu zawrze takie porozumienie lub dokona jego zmiany lub je wypowie, to Strony niniejszego protokołu nie będą dłużej związane postanowieniami pierwszego zdania niniejszego ustępu zobowiązującymi do zwolnienia z opodatkowania wynagrodzenia i dodatków płaconych swoim obywatelom.

Artykuł 8

1. W celu ułatwienia ustanowienia, budowy, utrzymania i działania Dowództwa Sojuszniczego Dowództwo takie w interesie wspólnej obrony oraz dla jego oficjalnej i wyłącznej korzyści będzie zwolnione, tak dalece, jak to jest możliwe, z opłat celnych i podatków mających wpływ na jego wydatki. 2. Employees of an Allied Headquarters of categories agreed by the North Atlantic Council, shall be exempted from taxation on the salaries and emoluments paid to them by the Allied Headquarters in their capacity as such employees. Any Party to the present Protocol may, however, conclude an arrangement with the Allied Headquarters whereby such Party will employ and assign to the Allied Headquarters all of its nationals (except, if such Party so desires, any not ordinarily resident within its territory) who are to serve on the staff of the Allied Headquarters and pay the salaries and emoluments of such persons from its own funds, at a scale fixed by it. The salaries and emoluments so paid may be taxed by the Party concerned but shall be exempted from taxation by any other Party. If such an arrangement is entered into by any Party to the present Protocol and is subsequently modified or terminated, Parties to the present Protocol shall no longer be bound under the first sentence of this paragraph to exempt from taxation the salaries and emoluments paid to their nationals.

Article 8

1. For the purpose of facilitating the establishment, construction, maintenance and operation of Allied Headquarters, these Headquarters shall be relieved, so far as practicable, from duties and taxes, affecting expenditures by them in the interest of common defense and for their official and exclusive benefit, and each Party to the present Proto-

Elle paiera dans ce cas les traitements et ćmoluments desdites personnes sur ses propres fonds, selon un bareme dóterminć par elle. Ces traitements et śmoluments pourront faire | objet d une imposition de la part de la Partie en question mais ne pourront tre imposćs par une autre Partie. Si un arrangement de cette nature conclu par une des Parties au prósent Protocole est par la suite modifić ou dónoncć, les Parties au prósent Protocole ne seront plus obligóes, en vertu de la premiere clause du prósent paragraphe, d exonórer de | impót les traitements et śmoluments payćs a leurs propres ressortissants.

Article 8

1. En vue de faciliter | ćtablissement, la construction, | entretien et le fonctionnement des Quartiers Genćraux Interallićs, ces Quartiers Góćnćraux sont exonćrćs, dans toute la mesure du possible, des droits et taxes affórents aux dópenses supportóes par eux dans I intóret de la dćófense commune et pour leur avantage officiel et exclu-

stąpi do negocjacji z każdym Dowództwem Sojuszniczym działającym na jej terytorium, w celu zawarcia porozumienia wprowadzającego w życie niniejsze postanowienia.

2. Dowództwo Sojusznicze posiada, na tych samych warunkach, takie same prawa, jakie na mocy artykułu XI Umowy zostały przyznane siłom zbrojnym.

3. Postanowienia ust. 5 i 6 artykułu XI Umowy nie dotyczą obywateli Państwa przyjmującego, chyba że tacy obywatele należą do sit zbrojnych Strony niniejszego protokołu innej niż Państwo przyjmujące.

4. Wyrażenie „opłaty celne i podatki” w niniejszym artykule nie odnosi się do opłat za korzystanie z płatnych usług.

Artykuł 9

O ile Rada Północnoatlantycka nie zadecyduje inaczej:

(a) każdy majątek nabyty z międzynarodowych środków znajdujących się w budżecie inwestycyjnym Dowództwa Sojuszniczego i niepotrzebny dłużej Dowództwu, zgodnie z rozwiązaniami przyjętymi przez Radę Północnoatlantycką, może zostać zbyty, a dochody zostaną podzielone między Strony Traktatu Północnoatlantyckiego lub przekazane na ich rzecz proporcjonalnie do ich udziałów w kosztach inwestycyjnych Dowództwa. 2. An Allied Headquarters shall have the rights granted to a force under Article XI of the Agreement subject to the same conditions.

3. The provisions in paragraphs 5 and 6 of Article XI of the Agreement shall not apply to nationals of the receiving States, unless such nationals belong to the armed services of a Party to this Protocol other than the receiving State.

4. The expression ”"duties and taxes” in this Article does not include charges for services rendered.

Article 9

Except in so far as the North Atlantic Council may decide otherwise,

(a)any assets acquired from the international funds of an Allied Headquarters under its capital budget and no longer required by the Headquarters shall be disposed of under arrangements approved by the North Atlantic Council and the proceeds shall be distributed among or credited to the Parties to the North Atlantic Treaty in the proportions in which they have contributed to the capital costs of the Headquarters. The receiving State shall have the prior right to acquire any immovable property so disposed of in its territory, provided that it offers terms no less favourable than those offered by any third party;

(b) any land, buildings or fixed installations provided for the use of an Allied Headquarters by the receiving State without charge to the Headquarters (other than a nominal charge) and no longer required by the Headquarters shall be handed back to the receiving State, and any increase or loss in the value of the property provided by

Article 9

Sauf en cas de dócision contraire du Conseil de I Atlantique Nord:

nego przez Państwo przyjmujące, wynikający z jego użytkowania przez Dowództwo, zostanie ustalony przez Radę Północnoatlantycką (z uwzględnieniem wszystkich odnośnych przepisów prawa Państwa przyjmującego) i podzielony lub przekazany na rzecz albo obciąży Strony Traktatu Północnoatlantyckiego proporcjonalnie do ich udziałów w kosztach inwestycyjnych Dowództwa.

Artykuł 10

Każde Naczelne Dowództwo posiada osobowość prawną; ma ono zdolność do zawierania kontraktów, nabywania i zbywania własności. Państwo przyjmujące może jednak dokonać specjalnych ustaleń z Naczelnym Dowództwem lub każdym podległym mu Dowództwem Sojuszniczym działającym w imieniu Naczelnego Dowództwa.

Artykuł 11

1. Z zastrzeżeniem postanowień artykułu VIII Umowy Naczelne Dowództwo może być stroną postępowania prawnego jako powód lub pozwany. Jednakże Państwo przyjmujące i Naczelne Dowództwo, lub każde podległe mu i upoważnione przez niego Dowództwo Sojusznicze, mogą zgodzić się na to, aby Państwo przyjmujące działało w imieniu Naczelnego Dowództwa w każdym postępowaniu prawnym, w którym Dowództwo jest stroną przed sądem Państwa przyjmującego.

2. Zadne środki egzekucyjne lub środki podjęte w celu zajęcia jego własności i środków finansowych nie zostaną powzięte wobec żadnego Dowództwa Sojuszniczego, z wyjątkiem realizacji celów, o których mowa w ust. 6(a) artykułu VII oraz w artykule XIII Umowy.

Artykuł 12

1. W celu umożliwienia postugiwania się własnym międzynarodowym budżetem Dowództwo Sojusznicze może posiadać każdego rodzaju walutę i prowadzić konta bankowe w każdej walucie.

2. Strony niniejszego protokołu, na wniosek Dowództwa Sojuszni-

Article 10

Each Supreme Headquarters shall possess juridical personality; it shall have the capacity to conclude contracts and to acquire and dispose of property. The receiving State may, however, make the exercise of such capacity subject to special arrangements between it and the Supreme Headquarters or any subordinate Allied Headquarters acting on behalf of the Supreme Headquarters.

Article 11

1. Subject to the provisions of Article VIII of the Agreement, a Supreme Headquarters may engage in legal proceedings as claimant or defendant. However, the receiving State and the Supreme Headquarters or any subordinate Allied Headquarters authorised by it may agree that the receiving State shall act on behalf of the Supreme Headquarters in any legal proceedings to which that Headquarters is a party before the courts of the receiving State.

2. No measure of execution or measure directed to the seizure or attachment of its property or funds shall be taken against any Allied Headquarters, except for the purposes of paragraph 6 (a) of Article VII and Article XIII of the Argreement.

Article 12

1. To enable it to operate its international budget, an Allied Headquarters may hold currency of any kind and operate accounts in any currency.

2. The Parties to the present Protocol shall, at the request of an

Article 11

1. Sous róserve des dispositions de I Article VIII de la Convention, un Quartier Gónćral Supreme peut ester en justice, tant en demandant qu en dófendant. Toutefois, il pourra 6tre convenu entre le Quartier Gónóral Supreme ou tout Quartier Gónćóral Interallić subordonnć autorisć par lui, d une part, et | Etat de sćjour, d autre part, que ce dernier lui sera subrogć devant les tribunaux de cetEtat pour | exercice des actions auxquelles le Quartier Góćnćóral sera Partie.

2. Aucune mesure d exóćcution ou tendant soit a | apprehension, soit a la description de biens ou fonds, ne peut 6tre prise contre un Quartier Gónćral Interallić, si ce n est aux fins dófinies au paragraphe 6 (a) de I "Article VII et a l Article XIII de la Convention.

Article 12

Artykuł 13

Archiwa i inne oficjalne dokumenty Dowództwa Sojuszniczego przechowywane w. pomieszczeniach wykorzystywanych przez to Dowództwo lub będące w posiadaniu jakiegokolwiek stosownie upoważnionego członka Dowództwa są nienaruszalne, chyba że Dowództwo uchyli ten immunitet. Dowództwo będzie określać, na wniosek Państwa przyjmującego i w obecności przedstawiciela tego Państwa, charakter tych dokumentów celem potwierdzenia, że chronione są one immunitetem zgodnie z postanowieniami niniejszego artykutu.

Artykuł 14

1. Całość lub część niniejszego protokołu lub Umowy może mieć zastosowanie zgodnie z decyzją Rady Północnoatlantyckiej do każdego międzynarodowego dowództwa wojskowego lub organizacji (nie objętych definicją zawartą w ust. (b) i (c) artykułu 1 niniejszego protokołu), które zostały ustanowione zgodnie z postanowieniami Traktatu Północnoatlantyckiego.

2. Z chwilą powstania Europejskiej Wspólnoty Obronnej niniejszy protokół może mieć zastosowanie do członków personelu Europejskich Sił Obronnych przy Dowództwie Sojuszniczym oraz do cztonków ich rodzin w czasie i w trybie określonym przez Radę Północnoatlantycką.

Artykuł 15

Wszelkie spory między Stronami niniejszego protokołu lub między jakąkolwiek Stroną a jakimkolwiek Dowództwem Sojuszniczym, związane z interpretacją i stosowaniem niniejszego protokołu, będą rozstrzygane w drodze negocjacji pomiędzy stronami sporu bez odwoływania się do jakiejkowiek zewnętrznej jurysdykcji. Jeśli posta-

Allied Headquarters, facilitate transfers of the funds of such Headquarters from one country to another and the conversion of any currency held by an Allied Headquarters into any other currency, when necessary to meet the requirements of any Allied Headquarters.

Article 13

The archives and other official documents of an Allied Headquarters kept in premises used by those Headquarters or in the possession of any properly authorised member of the Headquarters shall be inviolable, unless the Headquarters has waived this immunity. The Headquarters shall, at the request of the receiving State and in the presence of a representative of that State, verify the nature of any documents to confirm that they are entitled to immunity under this Article.

Article 14

1. The whole or any part of the present Protocol or of the Agreement may be applied, by decision of the North Atlantic Council, to any international military Headquarters or organisation (not included in the definitions in paragraphs (b) and (c) of Article 1 of this Protocol) which is established pursuant to the North Atlantic Treaty.

2. When the European Defence Community comes into being, the present Protocol may be applied to the personnel of the European Defence Forces attached to an Allied Headquarters and their dependents at such time and in such manner as may be determined by the North Atlantic Council.

Article 15

AII differences between the Parties to the present Protocol or between any such Parties and any Allied Headquarters relating to the interpretation or application of the Protocol shall be settled by negotiation between the parties in dispute without recourse to any outside jurisdiction. Except where express provision is made to the contrary in

Article 14

1. Tout ou partie du prósent Protocole ou de la Convention peut, par dócision du Conseil de I Atlantique Nord, €tre appliquć a tout Quartier Gónćral militaire international ou a toute organisation militaire internationale (n entrant pas dans les dófinitions figurant aux paragraphes (b) et (c) de I Article 1 du prósent Protocole) institućs en vertu du Traitć de I Atlantique Nord.

2. Lorsque la Communautć Europóćenne de Dófense sera cróće, le prósent Protocole pourra ćtre appliquć aux membres du personnel des Forces Europóennes de Dófense attachóćs a un Quartier Gónćral Interallić et a leurs personnes a charge, dans des conditions a fixer par le Conseil de | Atlantique Nord.

Article 15

Toute contestation entre les Parties a ce Protocole ou entre elles et un Quartier Gónćral Interallić sur I interprótation ou | application du prósent Protocole est róglóće par negociations entre les Parties intóressćes sans recours a une juridiction extórieure. Sauf dans les cas ou le prósent Protocole ou la Convention contiennent une disposi-

nowienia niniejszego protokołu lub Umowy wyraźnie nie stanowią inaczej, spory, które nie mogą być rozstrzygnięte w drodze bezpośrednich negocjacji, powinny być przedstawione Radzie Północnoatlantyckiej.

Artykuł 16

1. Artykuły XV i XVII do XX Umowy mają zastosowanie do niniejszego protokołu tak, jak gdyby były one jego integralną częścią, ale też w taki sposób, aby protokół mógł być zmieniany, zawieszany, ratyfikowany, rozszerzany, aby można było doń przystępować lub go wypowiedzieć zgodnie z wymienionymi wyżej postanowieniami, niezależnie od Umowy.

2. Niniejszy protokół może być uzupełniany przez porozumienia dwustronne między Państwem przyjmującym a Naczelnym Dowództwem. Organy Państwa przyjmującego i Naczelne Dowództwo mogą zgodzić się na nadanie środkami administracyjnymi mocy obowiązującej, przed ratyfikacją, każdemu z postanowień niniejszego protokołu lub Umowy stosowanych przez nie.

Na dowód czego niżej podpisani pełnomocnicy podpisali niniejszy protokół.

Sporządzono w Paryżu dnia 28 sierpnia 1952 r. w językach angielskim i francuskim, przy czym obydwa teksty są jednakowo autentyczne, w jednym egzemplarzu, który zostanie złożony w archiwach Rządu Stanów Zjednoczonych Ameryki. Rząd Stanów Zjednoczonych Ameryki przekaże wszystkim sygnatariuszom i państwom przystępującym uwierzytelnione kopie niniejszego protokołu.

Article 16

1. Articles XV and XVII to XX of the Agreement shall apply as regards the present Protocol as ifthey were an integral part thereof, but so that the Protocol may be reviewed, suspended, ratified, acceded to, denounced or extended in accordance with those provisions independently from the Agreement.

2. The present Protocol may be supplemented by bilateral agreement between the receiving State and a Supreme Headquarters, and the authorities of a receiving State and a Supreme Headquarters may agree to give effect, by administrative means in advance of ratification, to any provisions of this Protocol or of the Agreement as applied by it.

In witness whereof the undersigned Plenipotentiaries have signed the present Protocol.

Done in Paris this 28th day of August 1952, in the English and French languages, both texts being equally authoritative, in a single original which shall be deposited in the archives of the Government of the United States of America. The Government of the United States of America shall transmit certified copies thereof to all the signatory and acceding States.

Le Gouvernement des Etats-Unis d Amórique en transmettra des copies authentiques a tous les Etats signataires et adhćrents.

Po zaznajomieniu się z powyższym protokołem, w imieniu Rzeczypospolitej Polskiej oświadczam, że:

— został on uznany za słuszny zarówno w całości, jak i każde z postanowień w nim zawartych,

— Rzeczpospolita Polska postanawia przystąpić do tego protokołu,

— postanowienia protokołu są ratyfikowane, przyjęte, potwierdzone i będą niezmiennie zachowywane.

Na dowód czego wydany został akt niniejszy, opatrzony pieczęcią Rzeczypospolitej Polskiej.
