podaje do powszechnej wiadomości:
W dniu 19 czerwca 1951 r. w Londynie została sporządzona Umowa między Państwami-Stronami Traktatu Północnoatlantyckiego dotycząca statusu ich sił zbrojnych w następującym brzmieniu:

Strony Traktatu Pótnocnoatlantyckiego, sporządzonego w Waszyngtonie dnia 4 kwietnia 1949 r.,
zważywszy, że siły zbrojne jednej z Umawiających się Stron mogą być na podstawie porozumienia wysłane na terytorium innej Umawiającej się Strony;
mając na uwadze, że decyzja o ich wysłaniu oraz warunki, na których zostaną wysłane, w zakresie, w jakim nie są one określone w niniejszej umowie, pozostaną nadal przedmiotem odrębnych uregulowań między zainteresowanymi Stronami;
pragnąc jednakże określić status takich sił zbrojnych na terytorium innej Umawiającej się Strony;
uzgodniły, co następuje:
Artykuł I
1. W niniejszej umowie wyrażenie:
(a) „siły zbrojne” oznacza personel należący do lądowych, morskich lub powietrznych sił zbrojnych jednej z Umawiających się Stron, przebywający na terytorium innej Umawiającej się Strony, na obszarze

The Parties to the North Atlantic Treaty signed in Washington on 4th April, 1949,
Considering that the forces of one Party may be sent, by arrangement, to serve in the territory of another Party;
Bearing in mind that the decision to send them and the conditions under which they will be sent, in so far as such conditions are not laid down by the present Agreement, will continue to be the subject of separate arrangements between the Parties concerned;
Desiring, however, to define the status of such forces while in the territory of another Party;
Have agreed as follows:
Article |
1. In this Agreement the expression —
(a) "force" means the personnel belonging to the land, sea or air armed services of one Contracting Party when in the territory of another Contracting Party in the North Atlantic Treaty area in connexion with their official

Sont convenus des dispositions suivantes:
Article I£"
1. Dans la prósente Convention I' expression:
(a) „force” signifie le personnel appartenant aux armóes de terre, de mer ou de I'air de I'une des Parties Contractantes qui se trouve pour I'exócution du service sur le territoire d'une autre Partie Contractante de la

(b) „personel cywilny” oznacza pracowników cywilnych towarzyszących siłom zbrojnym Umawiającej się Strony, zatrudnionych w siłach zbrojnych tej Umawiającej się Strony i nie będących bezpaństwowcami ani też obywatelami jakiegokolwiek państwa, które nie jest Stroną Traktatu Północnoatlantyckiego, ani też obywatelami bądź osobami zamieszkałymi na stałe w państwie, w którym przebywają sity zbrojne;
(c) „członek rodziny” oznacza współmałżonka członka sił zbrojnych lub personelu cywilnego albo jego dziecko będące na jego utrzymaniu;
(d) „Państwo wysyłające” oznacza Umawiającą się Stronę, do której należą siły zbrojne;
(e) „Państwo przyjmujące” oznacza Umawiającą się Stronę, na której terytorium przebywają siły zbrojne lub ich personel cywilny, niezależnie od tego, czy tam stacjonują, czy też przejeżdżają przez nie tranzytem;
(f) „organy wojskowe Państwa wysyłającego” oznacza te organy Państwa wysyłającego, które są upoważnione z mocy prawa do stosowania prawa wojskowego tego Państwa w odniesieniu do członków jego sił zbrojnych lub ich personelu cywilnego;
(g) „Rada Północnoatlantycka” oznacza Radę ustanowioną na mocy art. 9 Traktatu Północnoatlantyckiego lub też jej organy pomocnicze upoważnione do działania w jej imieniu.
2. Niniejszą umowę stosuje się do organów jednostek administracyjnych Umawiających się Stron w granicach ich terytoriów, do których ma zastosowanie niniejsza umowa w zakresie określonym
duties, provided that the two Contracting Parties concerned may agree that certain individuals, units or formations shall not be regarded as constituting or included in a "force" for the purposes of the present Agreement;
(b) "civilian component” means the civilian personnel accompanying a force of a Contracting Party who are in the employ of an armed service of that Contracting Party, and who are not stateless persons, nor nationals of any State which is not a Party to the North Atlantic Treaty, nor nationals of, nor ordinarily resident in, the State in which the force is located;
(c) "dependent" means the spouse of a member of a force or of a civilian component, or a child of such member depending on him or her for support;
(d) "sending State” means the Contracting Party to which the force belongs;
(e) "receiving State" means the Contracting Party in the territory of which the force or civilian component is located, whether it be stationed there or passing in transit;
(f) "military authorities of the sending State” means those authorities of a sending State who are empowered by its law to enforce the military law of that State with respect to members of its forces or civilian components;
"North Atlantic Council” means the Council established by Article 9 of the North Atlantic Treaty or any of its subsidiary bodies authorised to act on its behalf.

2. This Agreement shall apply to the authorities of political sub- -divisions of the Contracting Parties, within their territories to which the Agreement applies or extends in accordance with Article XX, as it

(c) „personne a charge” signifie le conjoint d'un membre d'une force ou d'un ćlóćment civil faisant partie d'une force, ou les enfants qui sont a leur
charge;
(d) „Etat d'origine” signifie la Partie Contractante dont releve la force;
(e) „Etat de sćjour” signifie la
Partie Contractante sur le territoire de laquelle se trouve la force ou Ićlóćment civil, soit en sćjour, soit en transit;
(f) „autoritós militaires de I'Etat d'origine” signifie les autoritós de I'Etat d'origine qui, en vertu de la lógislation de cet Etat, sont chargóes d'appliquer les lois militaires dudit Etat aux membres de ses forces ou de ses ćlóćments civils;
(g) „Conseil de I'Atlantique Nord” signifie le Conseil ćtabli par FArticle 9 du Traitć de FAtlantique Nord, ou tout organe subordonnć de celui-ci autorisć a agir en son nom.
2. La prósente Convention est applicable aux autoritós des subdivisions politiques des Parties Contractantes, dans les limites des territoires auxquels, conformóment aux dispositions de I'Article XX,

w art. XX, tak jak stosuje się ją do organów centralnych tej Umawiającej się Strony, jednakże pod warunkiem, że mienie znajdujące się w posiadaniu jednostek administracyjnych nie będzie uważane za mienie Umawiającej się Strony w rozumieniu art. VIII.
Artykuł II
Siły zbrojne i ich członkowie oraz personel cywilny, a także członkowie ich rodzin mają obowiązek przestrzegać prawa Państwa przyjmującego i powstrzymać się od jakiejkolwiek działalności niezgodnej z duchem niniejszej umowy oraz w szczególności od jakiejkolwiek działalności politycznej w Państwie przyjmującym. Państwo wysyłające ma obowiązek podjąć niezbędne środki w tym celu.
Artykuł III
1. Na warunkach określonych w ust. 2 niniejszego artykułu i zgodnie z wymogami ustanowionymi przez Państwo przyjmujące odnośnie do wjazdu i wyjazdu sit zbrojnych lub ich członków, członkowie sił zbrojnych nie podlegają przepisom paszportowym i wizowym ani też kontroli organów imigracyjnych przy wjeździe i wyjeździe z terytorium Państwa przyjmującego. Ponadto nie podlegają oni przepisom Państwa przyjmującego, dotyczącym rejestracji i kontroli cudzoziemców, jednakże nie oznacza to, że uzyskują oni jakiekolwiek prawo do stałego pobytu lub zamieszkania na terytorium Państwa przyjmującego.
2. W odniesieniu do członków sił zbrojnych będą jedynie wymagane następujące dokumenty, które należy okazywać na żądanie:
(a) dowód tożsamości wystawiony przez Państwo wysyłające, zawierający imię i nazwisko, datę urodzenia, stopień i numer (o ile taki posiadają), rodzaj służby i fotografię;
(b) indywidualny lub zbiorowy rozkaz wyjazdu w języku Państwa wysyłającego oraz w językach angielskim i francuskim,
applies to the central authorities of those Contracting Parties, provided, however, that property owned by political sub-divisions shall not be considered to be property owned by a Contracting Party within the meaning of Article VIII.
Article II
It is the duty of a force and its civilian component and the members thereof as well as their dependents to respect the law of the receiving State, and to abstain from any activity inconsistent with the spirit of the present Agreement, and, in particular, from any political activity in the receiving State. It is also the duty of the sending State to take necessary measures to that end.
Article III
1. Onthe conditions specified in paragraph 2 of this Article and subject to compliance with the formalities established by the receiving State relating to entry and departure of a force or the members thereof, such members shall be exempt from passport and visa regulations and immigration inspection on entering or leaving the territory of a receiving State. They shall also be exempt from the regulations of the receiving State on the registration and control of aliens, but shall not be considered as acquiring any right to permanent residence or domicile in the territories of the receiving State.
2. The following documents only will be required in respect of members of a force. They must be presented on demand:
(a) personal identity card issued by the sending State showing names, date of brith, rank and number (if any), service, and photograph;
(b) individual or collective movement order, in the language of the sending State and in the English and French languages,

Article II
Les membres d'une force ou d'un ćlćment civil, ainsi que les personnes a leur charge, sont tenus de respecter les lois en vigueur dans I'Etat de sćjour et de s'abstenir sur le territoire de cet Etat de toute activitć incompatible avec I'esprit de la prósente Convention et en particulier de toute activitć politique. Au surplus les autoritós de I'Etat d'origine sont tenues de prendre les mesures nócessaires a cette fin.
Article III
1. Sans prójudice des dispositions du paragraphe 2 du prósent article, et a condition de se conformer aux formalitós prescrites par I'Etat de sćjour pour I'entróe et la sortie d'une force, ou des membres d'une force, ceux-ci sont dispensćs des formalitćs de passeport et de visa, ainsi que de Iinspection par les services d'immigration a I'entróe et a la sortie du territoire d'un Etat de sćjour. lls ne sont pas davantage assujettis a la reglementation relative a lI'enregistrement et au contróle des ćtrangers. Toutefois, ils ne sont pas considórós comme acqućrant des droits a la rósidence permanente ou au domicile dans les territoires de I'Etat de sćjour.
2. Les seuls documents ci-dessous seront exigós des membres d'une force. lls doivent €tre produits a toute róquisition:
(a) Carte d'identitć personnelle dólivróe par IEtat d'origine munie d'une photographie et mentionnant les noms et prónoms, la date de naissance, le grade, le service et, s'il y a lieu, le numóro matricule;
(b) Ordre de mission collectif ou individuel dans la langue de IfEtat dorigine ainsi qu'en anglais et en frangais, dólivrć

wystawiony przez odpowiedni organ Państwa wysyłającego lub Organizacji Traktatu Północnoatlantyckiego, potwierdzający status osoby lub grupy osób jako członka lub członków sił zbrojnych, jak również rozkaz wyjazdu. Państwo przyjmujące może zażądać, aby rozkaz wyjazdu byt kontrasygnowany przez jego właściwego przedstawiciela.
3. Członkowie personelu cywilnego i członkowie ich rodzin powinni posiadać odpowiednie wpisy w swoich paszportach, potwierdzające ich status cztonka personelu cywilnego lub członka jego rodziny.
4. Jeżeli członek sit zbrojnych lub ich personelu cywilnego opuści miejsce służby pełnionej na rzecz Państwa wysyłającego i nie zostanie odesłany do kraju, organy Państwa wysyłającego poinformują o tym niezwłocznie organy Państwa przyjmującego, podając wszelkie niezbędne szczegóły. Organy Państwa wysyłającego poinformują także organy Państwa przyjmującego o każdym członku ich sił zbrojnych lub personelu cywilnego, który jest nieobecny przez okres dłuższy niż 21 dni.
5. Jeżeli Państwo przyjmujące zwróci się o usunięcie ze swojego terytorium członka sił zbrojnych lub ich personelu cywilnego albo wyda nakaz wydalenia byłego członka sił zbrojnych lub ich personelu cywilnego bądź członka rodziny aktualnego lub byłego członka sit zbrojnych, to organy Państwa wysyłającego będą zobowiązane do przyjęcia takiej osoby na swoje terytorium lub do odesłania takiej osoby z terytorium Państwa przyjmującego. Niniejszy ustęp ma zastosowanie wyłącznie do osób, które nie są obywatelami Państwa przyjmującego i wjechały na terytorium Państwa przyjmującego w charakterze członka sit zbrojnych lub ich personelu cywilnego albo w celu zostania ich członkiem, oraz w odniesieniu do członków rodzin wyżej wymienionych osób.
Artykuł IV
Państwo przyjmujące albo:
(a) uzna, bez przeprowadzania dodatkowego egzaminu z kierowa-
issued by an appropriate agency of the sending State or of the North Atlantic Treaty Organisation and certifying to the status of the individual or group as a member or members of a force and to the movement ordered. The receiving State may require a movement order to be countersigned by its appropriate representative.
3. Members of acivilian component and dependents shall be so described in their passports.
4. If a member of a force or of a civilian component leaves the employ of the sending State and is not repatriated, the authorities of the sending State shall immediately inform the authorities of the receiving State, giving such particulars as may be requires. The authorities of the sending State shall similarly inform the authorities of the receiving State of any member who has absented himself for more than twenty-one days.
5. If the receiving State has requested the removal from its territory of a member of a force or civilian component or has made an expulsion order against an ex- -member of a force or of a civilian component or against a dependent of a member orex-member, the authorities of the sending State shall be responsible for receiving the person concerned within their own territory or otherwise disposing of him outside the receiving State. This paragraph shall apply only to persons who are not nationals of the receiving State and have entered the receiving State as members of a force or civilian component or for the purpose of becoming such members, and to the dependents of such persons.
Article IV
The receiving State shall either
(a) accept as valid, without a driving test or fee, the driving per-

3. Le passeport dont les membres d'un ćlóment civil et les personnes a charge seront porteurs devra faire ćtat de ladite qualitć.
4. Si un membre d'une force ou d'un ćlćment civil cesse d'6tre au service de I'Etat d'origine et n'est pas rapatrić, les autoritćs de I'Etat d'origine en informent immódiatement les autoritós de IEtat de sćjour en leur donnant toutes indications utiles. Les autoritós de I'Etat d'origine informent, dans les móemes conditions, les autoritós de IEtat de sćjour de toute absence illśógale dćpassant 21 jours.
5. Si I'Etat de sćjour a demandć I'ćloignement de son territoire d'un membre dune force ou d'un ćlćment civil, ou a pris un arretć d'expulsion contre un ex-membre d'une force ou d'un ćlćment civil ou contre une personne a charge dun membre ou dun ex-membre, les autoritćs de I'Etat d'origine sont tenues de les recevoir sur leur territoire ou tout au moins de leur faire quitter le territoire de I'Etat de sćjour. Ce paragraphe ne s'applique qu'aux personnes qui ne sont pas des nationaux de I'Etat de sćjour et qui sont entróes dans ledit Etat en qualitć de membre d'une force ou d'un ćlóćment civil ou en vue de le devenir ou de personne a charge de ceux-ci.
Article IV
L'Etat de sćjour peut:
(a) soit accepter comme valable, sans exiger ni examen ni droit

nia pojazdem i pobierania opłaty, pozwolenie na kierowanie pojazdem lub prawo jazdy albo wojskowe pozwolenie na kierowanie pojazdem wystawione członkowi sit zbrojnych lub jego personelu cywilnego przez Państwo wysyłające lub jednostkę administracyjną tego Państwa; albo
(b) wystawi swoje własne pozwolenie na kierowanie pojazdem lub prawo jazdy każdemu członkowi sił zbrojnych lub ich personelu cywilnego, który posiada pozwolenie na kierowanie pojazdem lub prawo jazdy albo wojskowe pozwolenie na kierowanie pojazdem wystawione przez Państwo wysyłające lub jego jednostkę administracyjną, przy czym egzamin z kierowania pojazdem nie będzie w tym celu wymagany.
Artykuł V
1. Członkowie sił zbrojnych powinni zazwyczaj nosić mundury. O ile organy Państwa wysyłającego i Państwa przyjmującego nie uzgodnią inaczej, używanie odzieży cywilnej będzie dopuszczone na takich samych warunkach, jakie obowiązują członków sił zbrojnych Państwa przyjmującego. Podczas przekraczania granicy regularne oddziaty lub formacje sit zbrojnych powinny być umundurowane.
2. Pojazdy służbowe sił zbrojnych lub ich personelu cywilnego oprócz numerów rejestracyjnych powinny posiadać widoczny symbol swojego państwa.
Artykuł VI
Członkowie sit zbrojnych mogą posiadać i nosić broń pod warunkiem, że są do tego upoważnieni na mocy wydanych im rozkazów. Organy Państwa wysyłającego rozpatrzą przychylnie stosowne wnioski Państwa przyjmującego w tej sprawie.
Artykuł VII 1. Z zastrzeżeniem postanowień niniejszego artykułu:
(a) organy wojskowe Państwa wysyłającego mają prawo spra-
mit or licence or military driving permit issued by the sending State or a sub-division thereof to a member of a force or of a civilian component; or
(b) issue its own driving permit or licence to any member of a force or civilian component who holds a driving permit or licence or military driving permit issued by the sending State or a sub-division thereof, provided that no driving test shall be required.
Article V
1. Members of a force shall normally wear uniform. Subject to any arrangementto the contrary between the authorities of the sending and receiving States, the wearing of civilian dress shall be on the same conditions as for members of the forces of the receiving State. Regularly constituted units or formations of a force shall be in uniform when crossing a frontier.
2. Service vehicles of a force or civilian component shall carry, in addition to their registration number, a distinctive nationality mark.
Article VI
Members of a force may possess and carry arms, on condition that they are authorised to do so by their orders. The authorities of the sending State shall give sympathetic consideration to requests from the receiving State concerning this matter.
Article VII 1. Subject to the provisions of this Article,
(a) the military authorities of the sending State shall have the ri-

Article V
1. Les membres d'une force portent normalement leur uniforme. Sous róserve de tout arrangement contraire entre les autoritós de I'Etat d'origine et de I'Etat de sćjour, la tenue civile sera portóe dans les memes conditions que par les forces armóes des Etats de sćjour. Les unitóćs de formations militaires rógulierement constituśes d'une force doivent se prósenter en uniforme aux frontieres qu'elles franchissent.
2. Les vćhicules d'une force ou d'un ćlóment civil immatriculós a I'armóe portent, en plus de leur
numóro d'immatriculation, une marque _distinctive de - leur nationalitć. Article VI Les membres d'une force peuvent dótenir et porter leurs
armes a condition d'y €tre autorisós par le reglement qui leur est applicable. Les autoritós de I'Etat d'origine examineront avec bienveillance les demandes que I'Etat de sćjour leur prósentera en la matiere.
Article VII 1. Sous róserve des dispositions du prósent article,
(a) Les autoritós militaires de I'Etat d'origine ont le droit d'exercer

wowania w granicach Państwa przyjmującego petnej jurysdykcji karnej i dyscyplinarnej, przyznanej im przez prawo Państwa wysyłającego w stosunku do wszystkich osób podlegających prawu wojskowemu tego Państwa;
(b) organy Państwa przyjmującego sprawują jurysdykcję nad członkami sit zbrojnych lub ich personelu cywilnego oraz członkami ich rodzin w odniesieniu do przestępstw popetnionych na terytorium Państwa przyjmującego i karalnych zgodnie z jego prawem.
2(a) Organy wojskowe Państwa
wysyłającego mają prawo sprawowania wyłącznej jurysdykcji w stosunku do osób podlegających prawu wojskowemu tego Państwa w odniesieniu do przestępstw karalnych zgodnie z prawem Państwa wysyłającego, a niekaralnych zgodnie z prawem Państwa przyjmującego, w tym przestępstw przeciwko bezpieczeństwu Państwa wysyłającego.
(b) Organy Państwa przyjmującego mają prawo sprawowania wyłącznej jurysdykcji w stosunku do członków sił zbrojnych lub ich personelu cywilnego oraz członków ich rodzin w odniesieniu do przestępstw karalnych zgodnie z jego prawem, a niekaralnych zgodnie z prawem Państwa wysyłającego, w tym przestępstw przeciwko bezpieczeństwu Państwa przyjmującego.
(c) Dla potrzeb niniejszego ustępu
oraz ustępu 3 niniejszego artykułu pojęcie przestępstwa przeciwko bezpieczeństwu Państwa obejmuje:
(i) zdradę Państwa,
(ii) sabotaż, szpiegostwo lub naruszenie jakichkolwiek przepisów dotyczących tajemnicy państwowej tego Państwa lub tajemnicy związanej z obronnością tego Państwa.
3. W sytuacjach gdy prawo
ght to exercise within the receiving State all criminal and disciplinary jurisdiction conferred on them by the law of the sending State over all persons subject to the military law of that State;
(b) the authorities of the receiving
State shall have jurisdiction over the members of a force or civilian component and their dependents with respect to offences committed within the territory of the receiving State and punishable by the law of that State.
. —(a) The military authorities of
the sending State shall have the right to exercise exclusive jurisdiction over persons subject to the military law of that State with respect to offences, including offences relating to its security, punishable by the law of the sending State, but not by the law of the receiving State.
(b) The authorities ofthe receiving
State shall have the right to exercise exclusive jurisdiction over members of a force or civilian component and their dependents with respect to offences, including offences relating to the security of that State, punishable by its law but not by the law of the sending State.
(c) For the purposes of this paragraph and of paragraph 3 of this Article a security offence against a State shall include
(i) treason against the State;
(ii) sabotage, espionage or violation of any law relating to official secrets of that State, or secrets relating to the national defence of that State.
3. In cases where the right to

Organy Państwa mającego pierwszeństwo rozpatrzą życzliwie wniosek organów drugiego Państwa o zrzeczenie się prawa pierwszeństwa w przypadku, gdy takie zrzeczenie się ma dla drugiej Strony szczególne znaczenie.
4. Powyższe postanowienia niniejszego artykułu nie oznaczają, iż organy wojskowe Państwa wysyłającego mają jakiekolwiek prawo do sprawowania jurysdykcji w stosunku do osób, które są obywatelami Państwa przyjmującego lub zamieszkują w nim na state, chyba że są one członkami sił zbrojnych Państwa wysyłającego.
5. (c) If the State having the primary right decides not to exercise jurisdiction, it shall notify the authorities of the other State as soon as practicable. The authorities of the State having the primary right shall give sympathetic consideration to a request from the authorities of the other State for a waiver of its right in cases where that other State considers such waiver to be of particular importance.
4. The foregoing provisions of this Article shall not imply any right for the military authorities of the sending State to exercise jurisdiction over persons who are nationals of or ordinarily resident in the receiving State, unless they are members of the force of the sending State.
5. — (a) The authorities of the receiving and sending States shall assist each other in the arrest of members of a force or civilian component or their dependents in the territory of the receiving State and in handing them over to the authority which is to exercise jurisdiction in accordance with the above provisions.

State shall notify promptly the military authorities of the sending State of the arrest of any member of a force or civilian component or a dependent.
(c)The custody of an accused
member of a force or civilian component over whom the receiving State is to exercise jurisdiction shall, if he is in the hands of the sending State, remain with that State until he is charged by the receiving State.
. — (a) The authorities of the receiving and sending States shall assist each other in the carrying out of all necessary investigations into offences, and in the collection and production of evidence, including the seizure and, in proper cases, the handing over of objects connected with an offence. The handing over of such objects may, however, be made subject to their return within the time specified by the authority delivering them.
(b) The authorities of the Contracting Parties shall notify one another of the disposition of all cases in which there are concurrent rights to exercise jurisdiction.
.— (a) A death sentence shall
not be carried out in the receiving State by the authorities of the sending State if the legislation of the receiving State does not provide for such punishment in a similar case.
(b) The authorities ofthe receiving
State shall give sympathetic consideration to a request from the authorities of the sending State for assistance in carrying out a sentence of imprisonment pronounced by the authorities of the sending State under the provision of this Article within the territory of the receiving State.

W przypadku gdy oskarżony został osądzony zgodnie z postanowieniami niniejszego artykułu przez organy jednej z Umawiających się Stron i został uniewinniony albo też skazany i odbywa lub odbyt zasądzoną karę bądź też został ułaskawiony, nie może być sądzony ponownie za to samo przestępstwo na terytorium tego samego Państwa przez organy innej Umawiającej się Strony. Jednakże żadne z postanowień niniejszego ustępu nie stanowi przeszkody dla organów wojskowych Państwa wysyłającego, aby osądzić cztonka ich sił zbrojnych za jakiekolwiek naruszenie zasad dyscypliny, wynikające z działania lub zaniechania, będącego przestępstwem, za które był on sądzony przez organy innej Umawiającej się Strony.
9. Jeżeli członek sił zbrojnych lub ich personelu cywilnego albo członek jego rodziny jest ścigany zgodnie z jurysdykcją Państwa przyjmującego, będzie on uprawniony do:
(a) niezwłocznego i szybkiego procesu;
(b) zapoznania się przed procesem z zarzutem lub zarzutami wnoszonymi przeciwko niemu;
(c) konfrontacjj ze świadkami świadczącymi na jego niekorzyść;
(d) korzystania z obowiązkowego stawiennictwa osób świadczących na jego korzyść, jeżeli znajdują się one w granicach jurysdykcji Państwa przyjmującego;
(e) posiadania obrońcy z własnego wyboru albo do posiadania bezpłatnie lub częściowo odpłatnie obrońcy na warunkach aktualnie stosowanych w Państwie przyjmującym;
(f) korzystania, jeżeli uzna za konieczne, z usług kompetentnego tłumacza; oraz
(g) komunikowania się z przedstawicielem rządu Państwa wysyłającego i, jeżeli zasady postępowania sądowego na to pozwalają, do obecności takiego przedstawiciela podczas procesu.
10. (a) Regularne oddziaty wojskowe lub formacje sit zbrojnych będą miały prawo nadzorowa-

Where an accused has been tried in accordance with the provisions of this Article by the authorities of one Contracting Party and has been acquitted, or has been convicted and is serving, or has served, his sentence or has been pardoned, he may not be tried again for the same offence within the same territory by the authorities of another Contracting Party. However, nothing in this paragraph shall prevent the military authorities of the sending State from trying a member of its force for any violation of rules of discipline arising from an act or omission which constituted an offence for which he was tried by the authorities of another Contracting Party.
9. Whenever a member of a force or civilian component or a dependent is prosecuted underthe jurisdiction of a receiving State he shall be entitled —
(a) to a prompt and speedy trial;
(b) to be informed, in advance of trial, of the specific charge or charges made against him;
(c) to be confronted with the witnesses against him;
(d)to have compulsory process for obtaining witnesses in his favour, if they are within the jurisdiction of the receiving State;
(e) to have legal representation of his own choice for his defence or to have free or assisted legal representation under the conditions prevailing for the time being in the receiving State;
(f) if he considers it necessary, to have the services of a competent interpreter; and
(g) to communicate with a representative of the Government of the sending State and, when the rules of the court permit, to have such a representative present at his trial.
10. — (a) Regularly constituted military units or formations of a force shall have the right to

(b) Poza wymienionym wyżej terytorium wspomniana żandarmeria wojskowa może działać wyłącznie zgodnie z ustaleniami podjętymi z organami Państwa przyjmującego, w porozumieniu z tymi organami i tylko w takim zakresie, w jakim działania te są niezbędne dla zapewnienia dyscypliny i porządku wśród członków sit zbrojnych.
11. Każda z Umawiających się Stron może wprowadzić takie przepisy, jakie uważa za niezbędne dla zapewnienia należytego bezpieczeństwa i ochrony na swoim terytorium w odniesieniu do instalacji, sprzętu, mienia, archiwów i oficjalnych informacji innych Umawiających się Stron oraz karania osób naruszających przepisy w tym celu ustanowione.
Artykuł VIII
1. Każda z Umawiających się Stron zrzeka się wszelkich roszczeń wobec innej Umawiającej się Strony z tytułu szkód wyrządzonych w jakimkolwiek mieniu do niej należącym i używanym przez jej lądowe, morskie lub powietrzne siły zbrojne, jeżeli taka szkoda:
(i) została spowodowana przez członka lub osobę zatrudnioną w siłach zbrojnych drugiej Umawiającej się Strony podczas wykonywania przez nią obowiązków związanych z działalnością wykonywaną w ramach Traktatu Północnoatlantyckiego;
(ii) jest skutkiem użycia pojazdu, okrętu lub statku powietrznego należącego do innej Umawiającej się Strony i używanego przez jej siły zbrojne, pod warunkiem że taki pojazd, statek lub statek powietrzny spowodował szkodę w związku z działalnością w ramach Traktatu
police any camps, establishments or other premises which they occupy as the result of an agreement with the receiving State. The military police of the force may take all appropriate measures to ensure the maintenance of order and security on such premises.
(b) Outside these premises, such military police shall be employed only subject to arrangements with the authorities of the receiving State and in liaison with those authorities, and in so far as such employment is necessary to maintain discipline and order among the members of the force.
11. Each Contracting Party shall seek such legislation as it deems necessary to ensure the adequate security and protection within its territory of installations, equipment, property, records and official information of other Contracting Parties, and the punishment of persons who may contravene laws enacted for that purpose.
Article VIII
1. Each Contracting Party waives all its claims against any other Contracting Party for damage to any property owned by it and used by its land, sea or air armed services, if such damage —
(i) was caused by a member oran employee of the armed services of the other Contracting Party inthe execution of his duties in connexion with the operation of the North Atlantic Treaty; or
(ii) arose from the use of any vehicle, vessel or aircraft owned by the other Contracting Party and used by its armed services, provided either that the vehicle, vessel or aircraft causing the damage was being used in connexion with the operation of the North Atlantic Treaty, or

d'assurer sur son territoire la sócuritć et la protection des installations, du matóriel, des
propriótós, des archives et des documents officiels des autres Parties Contractantes ainsi que la rópression des infractions a cette lógislation.
Article VIII
1. Chaque Partie Contractante renonce a toute demande d'indemnitć a |encontre d'une autre Partie Contractante pour les dommages causós aux biens de I'Etat qui sont utilisćs par ses forces armóes de terre, de mer et de I'air,
(i) sile dommage est causć parun membre des forces armóes de I'autre Partie Contractante, ou par un employć de celle-ci, dans I'exercice de ses fonctions dans le cadre du Traitć de I'Atlantique Nord;

2. (a) W przypadku szkody spowodowanej lub wynikłej zgodnie z ust. 1 w odniesieniu do innego mienia należącego do Umawiającej się Strony i znajdującego się na jej terytorium, odpowiedzialność jakiejkolwiek innej Umawiającej się Strony zostanie określona i rozmiar szkody zostanie oszacowany przez arbitra wybranego zgodnie z lit. b) niniejszego ustępu, o ile zainteresowane "Umawiające się Strony nie postanowią inaczej. Arbiter będzie także rozstrzygał wszelkie roszczenia wzajemne wynikające z tego samego zdarzenia.
(b) Arbiter, o którym mowa w lit. (a)
niniejszego ustępu, zostanie wybrany na mocy porozumienia między zainteresowanymi Umawiającymi się Stronami spośród obywateli Państwa przyjmującego, którzy zajmowali lub zajmują wysokie stanowisko w organach wymiaru sprawiedliwości. Jeżeli zainteresowane Umawiające się Strony w terminie dwóch miesięcy nie osiągną porozumienia co do wyboru arbitra, każda z nich może zwrócić się do Przewodniczącego Północnoatlantyckiej Rady Zastępców”) o dokonanie wyboru osoby posiadającej wyżej wymienione kwalifikacje.
(c) Każde orzeczenie arbitra będzie

Claims for maritime salvage by one Contracting Party against any other Contracting Party shall be waived, provided that the vessel or cargo salved was owned by a Contracting Party and being used by its armed services in connexion with the operation of the North Atlantic Treaty.
2. —(a) Inthe case of damage caused or arising as stated in paragraph 1 to other property owned by a Contracting Party and located in its territory, the issue of the liability of any other Contracting Party shall be determined and the amount of damage shall be assessed, unless the Contracting Parties concerned agree otherwise, by a sole arbitrator selected in accordance with sub-paragraph (b) of this paragraph. The arbitrator shall also decide any counter- -claims arising out of the same incident.
(b) The arbitrator referred to in
sub-paragraph (a) above shall be selected by agreement between the Contracting Parties concerned from amongst the nationals of the receiving State who hold or have held high judicial office. If the Contracting Parties concerned are unable, within two months, to agree upon the arbitrator, either may request the Chairman of the North Atlantic Council Deputies to select a person with the aforesaid qualifications.
(c) Any decision taken by the arbitrator shall be binding and conclusive upon the Contracting Parties.
(d) The amount of any compensation awarded by the arbitrator shall be distributed in accor-

W przypadku istotnych wahań kursów wymiany między tymi walutami Umawiające się Strony zgodzą się na odpowiednie uaktualnienie tych kwot.
3. Dla potrzeb ustępów 1 i 2 niniejszego artykułu wyrażenie „należące do Umawiającej się Strony” użyte w odniesieniu do okrętów dotyczy również okrętów wyczarterowanych przez Umawiającą się Stronę lub zarekwirowanych na warunkach czarteru samego okrętu lub zajętych w charakterze pryzy (z wyjątkiem sytuacji, w których ryzyko utraty lub odpowiedzialności ponosi osoba inna niż Umawiająca się Strona).
4. Każda z Umawiających się Stron zrzeka się wszelkich roszczeń przeciwko innej Umawiającej się Stronie z tytułu zranienia lub śmierci poniesionej przez jakiegokolwiek członka swoich sit zbrojnych w trak-

Any other Contracting Party whose property has been damaged in the same incident shall also waive its claim up to the above amount. In the case of considerable variation in the rates of exchange between these currencies the Contracting Parties shall agree on the appropriate adjustments of these amounts.
3. For the purposes of paragraphs 1 and 2 of this Article the expression "owned by a Contracting Party” in the case of a vessel includes a vessel on bare boat charter to that Contracting Party or requisitioned by it on bare boat terms or seized by it prize (except to the extent that the risk of loss or liabiility is borne by some person other than such Contracting Party).
4. Each Contracting Party waives all its claims against any other Contracting Party for injury or death suffered by any member of its armed services while such member was engaged in the performance of
paragraphe 5 (e) (i), (ii) et (iii) ci-dessous;

3. Les dispositions des paragraphes 1 et 2 du prósent article s'appliquent a tout navire affrótć en coque nue par une Partie Contractante, ou róquisitionnć par elle avec un contrat d'affretement en coque nue, ou de bonne prise (sauf en ce qui concerne la partie du risque de perte et de la responsabilitć supportóe par une autre personne que cette Partie Contractante).
4. Chaque Partie Contractante renonce a demander une indemnitć a une autre Partie Contractante dans le cas ou un membre des ses forces armćes a subi des blessures ou est mort dans |I'exócution du

5. Roszczenia (inne niż roszczenia umowne i te, do których mają zastosowanie ust. 6 lub 7 niniejszego artykułu) wynikające z działania lub zaniechania członków sit zbrojnych lub ich personelu cywilnego podczas wykonywania obowiązków służbowych albo wynikające z jakiegokolwiek innego działania, zaniechania lub zdarzenia, za które siły zbrojne lub ich personel cywilny ponoszą prawną odpowiedzialność, i powodującego szkodę na terytorium Państwa przyjmującego w odniesieniu do stron trzecich innych niż Umawiające się Strony, powinny być załatwiane przez Państwo przyjmujące zgodnie z następującymi zasadami:
(a) Roszczenia będą wnoszone, rozpatrywane i zaspokajane lub zasądzane zgodnie z przepisami prawa Państwa przyjmującego, dotyczącymi roszczeń wynikających z działalności jego własnych sit zbrojnych.
(b) Państwo przyjmujące może zaspokoić każde takie roszczenie, a zapłata kwoty uzgodnionej lub określonej na mocy orzeczenia o zasądzeniu zostanie dokonana przez Państwo przyjmujące w jego walucie.
(c) Zapłata taka, dokonana na mocy ugody lub osądzenia sprawy przez kompetentny sąd państwa przyjmującego, albo ostateczna odmowa przyznania takiej płatności orzeczona przez taki sąd będzie obowiązująca i ostateczna w stosunku do Umawiających się Stron.
(d) Każde roszczenie uregulowane przez Państwo przyjmujące będzie notyfikowane zainteresowanemu Państwu wysyłającemu tącznie z wszelkimi szczegółami oraz proponowanym podziałem kosztów zgodnie z lit. (e) (i), (ii) i (iii). W przypadku braku odpowiedzi w terminie dwóch miesięcy proponowany podział kosztów będzie uważany za przyjęty.
(e) Koszty wynikłe przy zaspokajaniu roszczeń zgodnie z postanowieniami powyższych liter oraz ust. 2 niniejszego artykułu zostaną rozdzielone między

5. Claims (other than contractual claims and those to which paragraphs 6 or 7 of this Article apply) arising out of acts or omissions of members of a force or civilian component done in the performance of official duty, or out of any other act, omission or occurrence for which a force or civilian component is legally responsible, and causing damage in the territory of the receiving State to third parties, other than any of the Contracting Parties, shall be dealt with by the receiving State in accordance with the following provisions: —
(a) Claims shall be filed, considered and settled or adjudicated in accordance with the laws and regulations of the receiving State with respect to claims arising from the activities of its own armed forces.
(b) The receiving State may settle any such claims, and payment of the amount agreed upon or determined by adjudication shall be made by the receiving State in its currency.
(c) Such payment, whether made pursuant to a settlement or to adjudication of the case by a competent tribunal of the receiving State, or the final adjudication by such a tribunal denying payment, shall be binding and conclusive upon the Contracting Parties.
(d) Every claim paid by the receiving State shall be communicated to the sending States concerned together with full particulars and a proposed distribution in conformity with sub-paragraphs (e) (i), (ii) and (iii) below. In default of a reply within two months, the proposed distribution shall be regarded as accepted.
(e) The cost incurred in satisfying claims pursuant to the preceding sub-paragraphs and paragraph 2 of this Article shall be distributed between the Con-
service.
5. Les demandes d'indemnitó (autres que celles rósultant de I'application d'un contrat et que celles auxquelles les paragraphes 6 ou 7 du prósent article sont applicables) du chef d'actes ou de nógligences dont un membre d'une force ou un óćlóćment civil est responsable dans lI'exócution du service ou du chef de tout autre acte, nógligence ou incident dont une force ou un ćlóment civil est lógalement responsable et qui ont causć sur le territoire de I'Etat de sćjour des dommages a un tiers autre que [une des Parties Contractantes, seront róglóes par I'Etat de sćjour conformóment aux dispositions suivantes:

(b) L'Etat de sćjour peut statuer sur ces dommages; il procede au paiement des indemnitćs allouśes dans sa propre monnaie;
(c) Ce paiement, qu'il rósulte du reglement direct de I'affaire ou d'une dócision de la juridiction compótente de I'Etat de sćjour, ou la dócision de la meme juridiction dóboutant le demandeur, lie dófinitivement les Parties Contractantes;
(d) Toute indemnitć payće par I'Etat de sćjour sera portóe a la connaissance des Etats d'origine intóróssćs qui recevront en móme temps un rapport circonstancić et une proposition de rópartition ćtablie conformóment aux alinćas (e) (i), (ii) et (iii) cidessous. A dófaut de róponse dans les deux mois, la proposition sera considóróe comme acceptóće;
(e)La charge des indemnitós versćes pour la róparation des dommages visćs aux alinćas prócódents et au paragraphe 2 du prósent article sera rópartie

W sytuacji gdy odpowiedzialność ponosi wyłącznie Państwo wysyłające, przyznana lub zasądzona kwota zostanie podzielona w stosunku 25 procent płatnych przez Państwo przyjmujące i 75 procent płatnych przez Państwo wysyłające;
Gdy z tytułu wyrządzenia szkody jest odpowiedzialne więcej niż jedno Państwo, przyznana lub zasądzona kwota zostanie podzielona w równych częściach między nie, jednakże gdy Państwo przyjmujące nie jest jednym z państw ponoszących odpowiedzialność za szkodę, jego udział będzie wynosić połowę udziału każdego z Państw wysyłających;
(iii) W sytuacji gdy szkoda została spowodowana przez siły zbrojne Umawiających się Stron i nie jest możliwe obciążenie odpowiedzialnością sit zbrojnych jednej lub kilku Stron, przyznana lub zasądzona kwota zostanie podzielona w równych częściach między wspomniane Umawiające się Strony; jednakże gdy Państwo przyjmujące nie jest jednym z Państw, których siły zbrojne spowodowały szkodę, jego udział będzie wynosić połowę udziału każdego z Państw wysyłających;
(iv) Co pół roku oświadczenie
o kwotach wypłaconych w ciągu minionego półrocza przez Państwo przyjmujące w każdej sprawie, co do której proponowany podział procentowy został przyjęty, wysłane będzie zainteresowanym Państwom wysyłającym wraz z wnioskiem o refundację. Refundacja ta będzie dokonywana w możliwie najkrótszym czasie w walucie Państwa przyjmującego.
(f) W przypadkach gdy stosowanie postanowień liter (b) i (e) niniejszego ustępu mogłoby

Where one sending State alone is responsible, the amount awarded or adjudged shall be distributed in the proportion of 25 per cent. chargeable to the receiving State and 75 per cent. chargeable to the sending State;
Where more than one State is responsible for the damage, the amount awarded or adjudged shall be distributed equally among them: however, if the receiving State is not one of the States responsible, its contribution shall be half that of each of the sending States.
(iii) Where the damage was
caused by the armed services of the Contracting Parties and it is not possible to attribute it specifically to one or more ofthose armed services, the amount awarded or adjudged shall be distributed equally among the Contracting Parties concerned: however, if the receiving State is not one of the States by whose armed services the damage was caused, its contribution shall be half that of each of the sending States concerned.
(iv) Every half-year, a statement
of the sums paid by the receiving State in the course of the half-yearly period in respect of every case regarding which the proposed distribution on a percentage basis has been accepted, shall be sent to the sending States concerned, together with a request for reimbursement. Such reimbursement shall be made within the shortest possible time, in the currency of the receiving State.
(f) In cases where the application
of the provisions of sub-paragraphs (b) and (e) of this para-

plusieurs de ces forces armóes, le montant de Iindemnitć sera róparti ćgalement entre les Parties Contractantes intóressćes; toutefois, si 'Etat de sćjour n'est pas un des Etats dont les forces armóes ont causć le dommage, sa part sera la moitić de celle de chacun des Etats d'origine;
(iv) Semestriellement, un ćtat
des sommes payćes par I'Etat de sćjour au cours du semestre prócódent pour les affaires pour lesquelles une rópartition en pourcentage a ćtć admise, sera adressć aux Etats d'origine intóressćs accompagnó d'une demande de remboursement. Le remboursement sera fait dans les plus brefs dólais, dans la monnaie de I'Etat de sćjour;
(f) Dans le cas ou, par suite de
I'application des dispositions des alinćas (b) et (e) ci-dessus,

spowodować poważne trudności dla Umawiającej się Strony, może ona zwrócić się do Rady Północnoatlantyckiej o rozstrzygnięcie sprawy w inny sposób.
(g) Członek sił zbrojnych lub ich personelu cywilnego nie będzie podlegat jakiemukolwiek postępowaniu mającemu na celu wykonanie jakiegokolwiek orzeczenia wydanego na jego niekorzyść w Państwie przyjmującym w sprawach wynikających z wykonywania przez niego obowiązków służbowych.
(h) Poza zakresem, w jakim lit. (e) niniejszego ustępu stosuje się do roszczeń, o których mowa w ust. 2 niniejszego artykułu, postanowienia niniejszego ustępu nie będą mieć zastosowania do jakichkolwiek roszczeń wynikających lub związanych z nawigacją lub eksploatacją statku albo załadunkiem, przewozem i wyładunkiem towaru, innych niż roszczenia z tytułu śmierci lub obrażeń ciała, do których ustęp 4 niniejszego artykułu nie ma zastosowania.
6. Roszczenia przeciwko członkom sił zbrojnych lub ich personelu cywilnego wynikające z niedozwolonych działań lub zaniechań w Państwie przyjmującym, nie związanych z wykonywaniem obowiązków służbowych, będą rozpatrywane w następujący sposób:
(a) Organy Państwa przyjmującego rzetelnie i sprawiedliwie rozpatrzą roszczenie i przyznają odszkodowanie występującemu z roszczeniem, biorąc pod uwagę wszelkie okoliczności sprawy, tącznie z postępowaniem osoby poszkodowanej, oraz przygotują raport w tej sprawie;
(b) Raport zostanie przedłożony organom Państwa wysyłającego, które zadecydują wówczas niezwłocznie, czy są gotowe zaspokoić roszczenie „ex gratia”, a jeśli tak, to w jakim wymiarze;
graph would cause a Contracting Party serious hardship, it may request the North Atlantic Council to arrange a settlement of a different nature.
(g) A member of a force or civilian component not be subject to any proceedings for the enforcement of any judgment given against him in the receiving State in a matter arising from the performance of his official duties.
(h) Except in so far as sub-paragraph (e) of this paragraph applies to claims covered by paragraph 2 of this Article, the provisions of this paragraph shall not apply to any claim arising out of or in connexion with the navigation or operation of a ship or the loading, carriage, or discharge of a cargo, other than claims for death or personal injury to which paragraph 4 of this Article does not apply.
6. Claims against members of a force or civilian component arising out of tortious acts or omissions in the receiving State not done inthe performance ofofficial duty shall be dealt with in the following manner: —
(a) The authorities ofthe receiving State shall consider the claim and assess compensation to the claimant in a fair and just manner, taking into account all the circumstances of the case, including the conduct of the injured person, and shall prepare a report on the matter.
(b) The report shall be delivered to the authorities of the sending State, who shall then decide without delay whether they will offer an ex gratia payment, and if so, of what amount.

couvertes par le paragraphe 2 du prósent article, les dispositions du present paragraphe ne s'appliquent pas dans le cas de navigation, d'exploitation d'un navire, de chargement ou de dóchargement ou de transport d'une cargaison, saufs'ilyaeu mort ou blessure d'une personne et que le paragraphe 4 ne soit pas applicable.
6. Les demandes d'indemnitó contre les membres d'une force armóe ou dun ćlóćment civil fondóes sur des actes dommageables ou des nógligences qui n'ont pas ćtć accomplis dans I'exócution du service sont róglóes de la fagon suivante:
(a) Les autoritós de I'Etat de sćjour
instruisent la demande d'indemnitć et fixent d'une maniere juste et óćquitable
I'indemnitć due au demandeur, en tenant compte de toutes les circonstances de la cause, y compris la conduite et le comportement de la personne lósóe, et elles ótablissent un rapport sur l'affaire;
(b) Ce rapport est envoyć aux autorites de I'Etat d'origine qui dócident alors sans dólai si elles procóderont a une indemnisation a titre gracieux, et dans ce cas, en fixant le montant;

(c) Jeżeli złożona oferta zapłaty „ex gratia” zostanie przyjęta przez występującego z roszczeniem w charakterze pełnego zaspokojenia jego roszczenia, organy Państwa wysyłającego same dokonają wypłaty, informując organy Państwa przyjmującego o odnośnej decyzji oraz o wypłaconej kwocie;
(d) Żadne z postanowień niniejszego ustępu nie narusza jurysdykcji sądów Państwa przyjmującego w zakresie podejmowania działań przeciwko członkowi sił zbrojnych lub ich personelu cywilnego, aż do czasu pełnego zaspokojenia roszczenia w drodze zapłaty.
7. Roszczenia wynikające z niedozwolonego użycia jakiegokolwiek pojazdu sił zbrojnych Państwa wysyłającego będą rozpatrywane zgodnie z ust. 6 niniejszego artykułu, z wyjątkiem sytuacji, gdy odpowiedzialność prawną ponoszą siły zbrojne lub ich personel cywilny.
8. W przypadku powstania sporu odnośnie do tego, czy niedozwolone działanie lub zaniechanie ze strony członka sit zbrojnych lub ich personelu cywilnego miało miejsce podczas wykonywania obowiązków służbowych albo też czy użycie jakiegoś pojazdu sił zbrojnych Państwa wysyłającego było niedozwolone, kwestia ta zostanie przekazana arbitrowi powołanemu zgodnie z ust. 2(b) niniejszego artykułu, którego decyzja w tym względzie będzie ostateczna i wiążąca.
9. Państwo wysyłające nie będzie domagać się wyłączenia spod jurysdykcji sądów Państwa przyjmującego członków sił zbrojnych lub ich personelu cywilnego, w odniesieniu do jurysdykcji cywilnej sądów Państwa przyjmującego, z wyjątkiem sytuacji, o której mowa w ust. 5 (g) niniejszego artykułu.
10. Organy Państwa wysyłającego i przyjmującego będą współpracować w celu dostarczenia dowodów niezbędnych dla rzetelnego przeprowadzenia rozprawy i zaspokojenia roszczenia, którym Uma-
(c) If an offer of ex gratia payment is made, and accepted by the claimant in full satisfaction of his claim, the authorities of the sending State shall make the payment themselves and inform the authorities of the receiving State of their decision and of the sum paid.
(d) Nothing in this paragraph shall affect the jurisdiction of the courts of the receiving State to entertain an action against a member of a force or of acivilian component unless and until there has been payment in full satisfaction of the claim.
7. Claims arising out of the unauthorised use of any vehicle of the armed services of a sending State shall be dealt with in accordance with paragraph 6 of this Article, except in so far as the force or civilian component is legally responsible.
8. If a dispute arises as to whether a tortious act or omission of a member of a force or civilian component was done in the performance of official duty or as to whether the use of any vehicle of the armed services of a sending State was unauthorised, the question shall be submitted to an arbitrator appointed in accordance with paragraph 2 (b) of this Article, whose decision on this point shall be final and conclusive.
9. The sending State shall not claim immunity from the jurisdiction of the courts of the receiving State for members of a force or civilian component in respect of the civil jurisdiction of the courts of the receiving State except to the extent provided in paragraph 5 (g) of this Article.
10. The authorities of the sending State and of the receiving State shall co-operate in the procurement of evidence for a fair hearing and disposal of claims in regard to which the Contracting Parties are

7. Les demandes d'indemnitó fondćes sur I' usage non autorisć de tout vćhicule des forces armóes d'un Etat d'origine seront traitóćes conformóment aux dispositions du paragraphe 6 du prósent article sauf dans le cas ou la force elle- -meme ou [óćlóćment civil est lśgalement responsable.
8. S'il y a contestation sur le point ść de savoir si l'acte dommageable ou la nógligence d'un membre d'une force ou d'un ćlóćment civil ont śtć accomplis dans I'exócution du service ou sur le point de savoir si l['utilisation d'un vćhicule appartenant aux forces armóes d'un Etat d'origine n'avait pas ćtć autorisće, I'affaire est portóe devant un arbitre dósignó conformóment au paragraphe 2 (b) du prósent article, qui dócide souverainement sur ce point.
9. Artykuł IX
1. Członkowie sił zbrojnych lub ich personelu cywilnego oraz członkowie ich rodzin mogą nabywać na miejscu towary na użytek własny, jak również niezbędne usługi na tych samych zasadach, co obywatele Państwa przyjmującego.
2. Towary miejscowe, niezbędne dla utrzymania sił zbrojnych lub ich personelu cywilnego, będą z zasady nabywane przez te same organy, które dokonują zakupów takich towarów na potrzeby sił zbrojnych Państwa przyjmującego. W celu uniknięcia niekorzystnego wpływu takich zakupów na gospodarkę Państwa przyjmującego odnośne organy tego Państwa wskażą, o ile zajdzie taka konieczność, towary, których zakup ma być ograniczony lub zakazany.
3. Z uwzględnieniem aktualnie obowiązujących porozumień lub porozumień, które mogą zostać zawarte w przyszłości między upoważnionymi przedstawicielami Państwa wysyłającego i przyjmującego, organy Państwa przyjmującego biorą na siebie wyłączną odpowiedzialność za podjęcie odpowiednich działań mających na celu udostępnienie siłom zbrojnym lub ich personelowi cywilnemu niezbędnych budynków i gruntów, jak również urządzeń i usług z tym związanych. Takie porozumienia i działania powinny być, o ile jest to możliwe, zgodne z przepisami dotyczącymi zakwaterowania i obciążania kosztami analogicznego personelu Państwa przyjmującego. O ile szczegółowa umowa nie stanowi inaczej, przepisy Państwa przyjmującego określą prawa i obowiązki wynikające z zajmowania lub korzystania z takich budynków, gruntów, urządzeń lub usług.
4. Zapotrzebowanie sił zbrojnych lub ich personelu cywilnego na miejscową cywilną siłę roboczą zaspokajane będzie w ten sam sposób, co analogiczne potrzeby Państwa przyjmującego i przy pomocy

Article IX
1. Members of a force orofacivilian component and their dependents may purchase locally goods necessary for their own consumption, and such services as they need, under the same conditions as the nationals of the receiving State.
2. Goods which are required from local sources for the subsistence of a force or civilian component shall normally be purchased through the authorities which purchase such goods for the armed services of the receiving State. In order to avoid such purchases having any adverse effect on the economy of the receiving State, the competent authorities of that State shall indicate, when necessary, any articles the purchase of which should be restricted or forbidden.
3. Subject to agreements already in force or which may hereafter be made between the authorised representatives of the sending and receiving States, the authorities of the receiving State shall assume sole responsibility for making suitable arrangements to make available to a force or a civilian component the buildings and grounds which it requires, as well as facilities and services connected therewith. These agreements and arrangements shall be, as far as possible, in accordance with the regulations governing the accommodation and billeting of similar personnel of the receiving State. In the absence of a specific contract to the contrary, the laws of the receiving State shall determine the rights and obligations arising out of the occupation or use of the buildings, grounds, facilities or services.
4. Local civilian labour requirements of a force or civilian component shall be satisfied in the same way as the comparable requirements of the receiving State and with the assistance of the authori-

Article IX

Pour ćviter que ces achats n'aient un effet dommageable pour I'ćconomie de I'Etat de sćjour, les autoritós compótentes de ce dernier dćsigneront les articles qu'il conviendrait, le cas ćchćant, d'exclure totalement ou partiellement desdits achats.
3. Sous róserve de I'application des accords en vigueur ou qui pourront 6tre conclus par les autoritós compótentes des Etats de sćjour et d'origine, les autoritós de I'Etat de sćjour prennent seules les mesures approprićes pour que soient mis a la disposition d'une force ou d'un ćlćment civil, les immeubles ainsi que les services y
affórents dont ceux-ci peuvent avoir besoin. Ces accords et arrangements seront dans la
mesure du possible conformes aux reglements concernant le logement et le cantonnement du personnel similaire de I'Etat de sćjour. A dófaut de convention stipulant le contraire, les droits et obligations naissant de |l'occupation ou de l'utilisation d'un immeuble ainsi que de lusage des services et servitudes y affórents sont rógis par les lois de I'Etat de sćjour.
4. Les besoins locaux en main d'oeuvre civile d'une force ou d'un ćlóćment civil sont satisfaits de la meme maniere que ceux des services analogues de |I'Etat de sćjour, avec leur assistance et par

organów Państwa przyjmującego poprzez wymianę pracowniczą. Warunki zatrudnienia i pracy, a w szczególności pensje, dodatkowe płatności i warunki ochrony pracowników określają przepisy Państwa przyjmującego. Pracownicy cywilni zatrudnieni przez siły zbrojne lub ich personel cywilny nie będą uważani dla jakichkolwiek celów za członków tych sit zbrojnych lub ich personelu cywilnego.
5. W sytuacji, kiedy siły zbrojne lub ich personel cywilny stacjonują w miejscu pozbawionym odpowiedniego zaplecza medycznego lub stomatologicznego, ich cztonkowie wraz z rodzinami mogą korzystać z pomocy medycznej i stomatologicznej, łącznie z hospitalizacją, na tych samych warunkach, co analogiczny personel Państwa przyjmującego.
6. Państwo przyjmujące rozpatrzy przychylnie wnioski o przyznanie członkom sił zbrojnych lub personelu cywilnego ułatwień w podróżowaniu oraz zniżek przy opłatach za przejazd. Takie ułatwienia i zniżki zostaną określone na mocy szczegółowych uzgodnień dokonanych przez rządy zainteresowanych Państw.
7. Z uwzględnieniem wszelkich ogólnych i szczegółowych postanowień finansowych uzgodnionych przez Umawiające się Strony organy sił zbrojnych dokonają niezwłocznie zapłaty w walucie miejscowej za towary, zakwaterowanie i usługi nabyte zgodnie z ust. 2,3i4 oraz, jeśli to konieczne, z ust. 5i6 niniejszego artykułu.
8. Ani siły zbrojne, ani ich personel cywilny, ani też ich członkowie czy też członkowie ich rodzin nie będą na mocy niniejszego artykułu korzystać z jakichkolwiek zwolnień od podatków i opłat za zakup towarów i ustug, należnych zgodnie z przepisami podatkowymi Państwa przyjmującego.
Artykuł X
1. Jeżeli jakakolwiek forma opodatkowania w Państwie przyjmującym zależy od pobytu lub zamieszkania, okres, podczas którego członek sit zbrojnych lub ich personelu cywilnego przebywa na terytorium
ties of the receiving State through the employment exchanges. The conditions of employment and work, in particular wages, supplementary payments and conditions for the protection of workers, shall be those laid down by the legislation of the receiving State. Such civilian workers employed by a force or civilian component shall not be regarded for any purpose as being members of that force or civilian component.
5. When a force or a civilian component has at the place where it is stationed inadequate medical or dental facilities, its members and their dependents may receive medical and dental care, including hospitalisation, under the same conditions as comparable personnel of the receiving State.
6. The receiving State shall give the most favourable consideration to requests for the grant to members of a force or of a civilian component of travelling facilities and concessions with regard to fares. These facilities and concessions will be the subject of special arrangments to be made between the Governments concerned.
7. Subject to any general or particular financial arrangements between the Contracting Parties, payment in local currency for goods, accommodation and services furnished under paragraphs 2, 3, 4 and, if necessary, 5 and 6, of this Article shall be made promptly by the authorities of the force.
8. Neither a force, nor a civilian component, nor the members thereof, nor their dependents, shall by reason of this Article enjoy any exemption from taxes or duties relating to purchases and services chargeable under the fiscal regulations of the receiving State.
Article X
1. Where the legal incidence of any form of taxation in the receiving State depends upon residence or domicile, periods during which a member of a force or civilian component is in the territo-

6. L'Etat de sćjour examinera avec bienveillance les demandes de facilitós de circulation et de róductions de tarifs qu'il peut accorder aux membres d'une force armće ou d'un ćlóćment civil. Ces facilitós et róductions feront I'objet de dispositions particulieres entre les gouvernements intóressós.
7. Sous róserve de tout accord financier gónćral ou particulier entre les parties contractantes, les paiements en monnaie locale pour les marchandises, le logement et les services próvus aux paragraphes 2, 3, 4 et si nócessaire 5 et 6 du prósent article seront effectuśs sans dólai par les autoritós de la force.
8. Une force, un ćlóment civil, leurs membres, ou les personnes a leur charge ne peuvent se próvaloir du prósent article pour revendiquer une exonćration d'impóts ou taxes applicables aux achats de biens et aux prestations de services en vertu de la róglementation fiscale de I'Etat de sćjour.
Article X
1. Si, dans IEtat de sćjour, I'6tablissement d'un impót quelconque est fonction de la rósidence ou du domicile du redevable, les póriodes au cours desquelles un membre d'une force

tego Państwa wyłącznie z powodu przynależności do takich sit zbrojnych lub ich personelu cywilnego, nie będzie uważany za okres pobytu wpływający na zmianę miejsca pobytu lub zamieszkania dla celów takiego opodatkowania. Cztonkowie sił zbrojnych lub ich personelu cywilnego będą zwolnieni od opodatkowania w Państwie przyjmującym w odniesieniu do wynagrodzenia i dodatków wypłacanych im ztego tytułu przez Państwo wysyłające lub w stosunku do mienia ruchomego, które znajduje się na terytorium Państwa przyjmującego wyłącznie w związku z ich czasowym pobytem w tym Państwie.
2. Zadne z postanowień niniejszego artykułu nie uprawnia do zwolnienia z opodatkowania członka sit zbrojnych lub ich personelu cywilnego w odniesieniu do jakiejkolwiek działalności zarobkowej poza działalnością ' wykonywaną w charakterze cztonka tych sit, jaką mogą podejmować w Państwie przyjmującym, jak również, z wyłączeniem ich wynagrodzeń, dodatków i mienia ruchomego określonego w ust. 1, żadne z postanowień niniejszego artykułu nie uprawnia do zwolnienia z opodatkowania, któremu członkowie sił zbrojnych i personelu cywilnego podlegają zgodnie z prawem tego Państwa, nawet jeśli uważani są za osoby przebywające lub zamieszkałe poza terytorium Państwa przyjmującego.
3. Zadne z postanowień niniejszego artykułu nie wpływa na definicję „cto” określoną w ust. 12 art. XI.
4. Dla celów niniejszego artykułu wyrażenie „członek sił zbrojnych” nie dotyczy jakiejkolwiek osoby, która jest obywatelem Państwa przyjmującego.
Artykuł XI
1. O ile niniejsza umowa nie stanowi wyraźnie inaczej, członkowie sił zbrojnych i ich personelu cywilnego, jak również członkowie ich rodzin podlegają przepisom prawnym stosowanym przez organy celne Państwa przyjmującego. W szczególności organy celne Państwa przyjmującego będą miały
ry of that State by reason solely of his being a member of such force or civilian component shall not be considered as periods of residence therein, or as creating a change of residence or domicile, for the purposes of such taxation. Members of a force or civilian component shall be exempt from taxation in the receiving State on the salary and emoluments paid to them as such members by the sending State or on any tangible movable property the presence of which in the receiving State is due solely to their temporary presence there.
2. Nothing in this Article shall prevent taxation of a member of a force or civilian component with respect to any profitable enterprise, other than his employment as such member, in which he may engage in the receiving State, and, except as regards his salary and emoluments and the tangible movable property referred to in paragraph 1, nothing in this Article shall prevent taxation to which, even if regarded as having his residence or domicile outside the territory of the receiving State, such a member is liable under the law of that State.
3. Nothing in this Article shall apply to "duty" as defined in paragraph 12 of Article XI.
4. For the purposes of this Article the term "member of a force” shall not include any person who is a national of the receiving State.
Article XI
1. Save as provided expressly to the contrary in this Agreement, members of aforce and ofacivilian component as well as their dependents shall be subject to the laws and regulations administered by the customs authorities of the receiving State. In particular the customs authorities of the receiving

2. Le prósent article n'exonćrera en aucune fagon le membre d'une force ou d'un ćlóćment civil des impóts affóćrents aux activitós gónćratrices de profits, autres que celles qu'il exerce en cette qualitć, auxquelles il pourrait se livrer dans I'Etat de sćjour. Sauf en ce qui
concerne le traitement, les ćmoluments, ainsi que les biens meubles corporels, visós au
paragraphe 1, les dispositions du prósent article ne s'opposent en rien a la perception des impóts auxquels ledit membre est assujetti en vertu de la loi de I'Etat de sćjour, meme s'il est considćrć comme ayant sa rósidence ou son domicile hors du territoire de cet Etat.
3. Les dispositions du prósent article ne sont pas applicables aux „droits” tels qu'ils sont dófinis au paragraphe 12 de I'article XI.
4. Au regard des dispositions du present article, I' expression „membre d'une force” ne sapplique pas a une personne ayant la nationalitć de I'Etat de sćjour.
Article XI
1. Sous róserve des dćrogations ćtablies par la prósente Convention, les membres d'une force ou d'un ćlóćmentcivil ainsi que les personnes a leur charge sont soumis aux lois et reglements dont I'application est confióe a I'administration des douanes de I'Etat de sćjour. Les agents de cette

prawo, na ogólnych warunkach określonych przez ustawodawstwo Państwa przyjmującego, do przeszukania członków sił zbrojnych lub ich personelu cywilnego oraz członków ich rodzin, a także ich bagażu i pojazdów, jak również do zajęcia przedmiotów zgodnie z wyżej wymienionymi przepisami.
2. (a) Wwóz na czas określony oraz ponowny wywóz pojazdów służbowych sił zbrojnych lub ich personelu cywilnego, znajdujących się w ich dyspozycji, będzie zwolniony z cła po przedstawieniu formularza w formie wskazanej w załączniku do niniejszej umowy.
(b) Wwóz na czas określony takich pojazdów nie znajdujących się w dyspozycji sit zbrojnych lub ich personelu cywilnego będzie podlegał postanowieniom ustępu 4 niniejszego artykułu, a powrotny wywóz — postanowieniom ustępu 8.
(c) Pojazdy służbowe sił zbrojnych lub ich personelu cywilnego będą zwolnione z wszelkich podatków związanych z korzystaniem z dróg.
3. Dokumenty urzędowe opatrzone urzędową pieczęcią nie będą podlegać kontroli celnej. Kurierzy przewożący takie dokumenty, niezależnie od ich statusu, powinni posiadać indywidualny rozkaz wyjazdu wystawiony zgodnie z art. III ust. 2(b). Taki rozkaz wyjazdu powinien wskazywać ilość przewożonych przesyłek i stwierdzać, że zawierają one tylko dokumenty urzędowe.
4. Sity zbrojne mogą wwozić bez cła wyposażenie na użytek sił zbrojnych oraz uzasadnione ilości żywności, zaopatrzenia i innych towarów do wyłącznego użytku sił zbrojnych i, w przypadku gdy jest to dozwolone przez Państwo przyjmujące, również ich personelu cywilnego i członków rodzin. Wwóz na
State shall have the right, underthe general conditions laid down by the laws and regulations of the receiving State, to search members of a force or civilian component and their dependents and to examine their luggage and vehicles, and to seize articles pursuant to such laws and regulations.
2.— (a) The temporary importation and the re-exportation of service vehicles of a force or civilian component under their own power shall be authorised free of duty on presentation of a triptyque in the form shown in the Appendix to this Agreement.
(b) The temporary importation of such vehicles not under their own power shall be governed by paragraph 4 of this Article and the re-exportation thereof by paragraph 8.
(c) Service vehicles of a force or civilian component shall be exempt from any tax payable in respect ofthe use ofvehicles on the roads.
3. Official documents under official seal shall not be subject to customs inspection. Couriers, whatever their status, carrying these documents must be in possession of an individual movement order, issued in accordance with paragraph 2 (b) of Article III. This movement order shall show the number of despatches carried and certify that they contain only official documents.
4. A force may import free of duty the equipment for the force and reasonable quantities of provisions, supplies and other goods for the exclusive use of the force and, in cases where such use is permitted by the receiving State, its civilian component and dependents. This duty-free importation shall be

(b) L'importation temporaire de vćhicules 'immatriculós a I'armóe, ne circulant pas par leurs propres moyens, se fera dans les conditions fixóes au paragraphe 4 et leur róexportation dans les conditions fixóes au paragraphe 8 du prósent article.
(c) Les vćhicules immatriculós a Iarmóe appartenant a une force ou a un ćlóćment civil bónóficient ćgalement de I'exemption des taxes qui pourraient E€tre dues en raison de la circulation des vćhicules sur les routes.
3. Les documents officiels sous pli scellść d'un sceau officiel ne sont pas soumis a la visite et au contróle de la douane. Les courriers qui en effectuent le transport doivent €tre munis, quelle que soit leur qualitć, d'un ordre de mission individuel dólivrć „dans les conditions indiqućes a I'article III, paragraphe 2 (b). Cet ordre de mission doit mentionner le nombre de plis et certifier que ceux-ci ne contiennent que des documents officiels.
4. Une force peut importer en franchise de droits son ćquipement et des quantitós raisonnables d'approvisionnement, matóriels et autres marchandises destinós a l'lusage exclusif de cette force ou, dans les cas ou cela est autorisć par lEtat de sćjour, a lusage de I'ćlóśment civil et des personnes a

zasadach bezcłowych będzie wymagał przedłożenia organom celnym w odpowiednim przejściu granicznym, obok uzgodnionych dokumentów celnych, zaświadczenia w formie uzgodnionej między Państwem przyjmującym a Państwem wysyłającym, podpisanego przez osobę do tego upoważnioną przez Państwo wysyłające. Pełnomocnictwo osoby upoważnionej do wydania wyżej wymienionego zaświadczenia oraz wzory podpisów i pieczęci, które będą używane w tym celu, zostaną przesłane organom celnym Państwa przyjmującego.
5. Członek sił zbrojnych lub ich personelu cywilnego może, wjeżdżając po raz pierwszy do Państwa przyjmującego w celu podjęcia służby albo przy pierwszym przyjeździe członka jego rodziny w celu spotkania z nim, wwieźć bezcłowo swoje rzeczy osobiste i meble, z których będzie korzystać przez okres swojej służby.
6. Członkowie sił zbrojnych lub ich personelu cywilnego mogą wwozić bezcłowo na czas określony swoje prywatne pojazdy mechaniczne na użytek własny i członków swoich rodzin. Niniejszy przepis nie oznacza obowiązku zwolnienia pojazdów prywatnych z podatków z tytułu korzystania z dróg.
7. Wwóz mienia przez organy sił zbrojnych w innym celu niż do wyłącznego użytku sił zbrojnych lub ich personelu cywilnego oraz wwóz na innych zasadach niż przewidziane w ust. 5 i 6 niniejszego artykułu, dokonany przez członków sit zbrojnych lub ich personelu cywilnego, nie zwalniają, na mocy niniejszego artykułu, z jakichkolwiek opłat lub innych warunków.
8. Towary wwiezione bezctowo zgodnie z ust. 2(b), 4, 5 lub 6 niniejszego artykułu:
(a) mogą być dowolnie wywiezione pod warunkiem, że w przypadku towarów wwiezionych zgodnie z ust. 4 zaświadczenie wystawione zgodnie z powołanym ustępem zostanie przed-
subject to the deposit, at the customs office for the place of entry, together with such customs documents as shall be agreed, of a certificate in a form agreed between the receiving State and the sending State signed by a person authorised by the sending State for that purpose. The designation of the person authorised to sign the certificates as well as specimens of the signatures and stamps to be used, shall be sent to the customs administration of the receiving State.
5. A member of a force or civilian component may, at the time of his first arrival to take up service in the receiving State or at the time of the first arrival of any dependent to join him, import his personal effects and furniture free of duty for the term of such service.
6. Members of a force or civilian component may import temporarily free of duty their private motor vehicles for the personal use of themselves and their dependents. There is no obligation under this Article to grant exemption from taxes payable in respect of the use of roads by private vehicles.
7. lmports made by the authorities of a force other than for the exclusive use of that force and its civilian component, and imports, other than those dealt with in paragraphs 5 and 6 ofthis Article, effected by members of a force or civilian component are not, by reason of this Article, entitled to any exemption from duty or other conditions.
8. Goods which have been imported duty-free under paragraphs 2 (b), 4, 5 or 6 above —
(a) may be re-exported freely, provided that, in the case of goods imported under paragraph 4, a certificate, issued in accordance with that paragraph, is presented to the customs offi-
charge. Un membre d'une force ou d'un ćlóćment civil peut, a [occasion de sa premiere arrivće en vue de prendre son service dans I'Etat de sćjour, ou a loccasion de la premiere arrivće d'une personne a sa charge venue [y rejoindre, importer ses effets et son mobilier personnels en franchise de droits pour la duróe de son sćjour.
6. Les membres d'une force ou d'un ćlćment civil peuvent bónćficier de la franchise temporaire des droits en cas d'importation temporaire de wvćhicules a moteur privós destinós a leur usage personnel et a celui des personnes a leur charge. Cette disposition n'entraine pas I'obligation d'exemption des taxes qui pourraient 6tre dues pour l'usage des routes par les vćhicules privćs.
7. Les importations faites par les autoritós d'une force pour des fins autres que |la satisfactiion des besoins exclusifs de cette force ou de son ćlćment civil, ainsi que les importations, autres que celles visóes aux paragraphes 5 et 6 du prósent article, effectuśes par les membres d'une force armóe ou d'un ćlćment civil, ne bónóficient, en application du prósent article, d'aucune exemption de droits ni d'aucune dispense de formalitćs.
8. Les marchandises admises en franchise en application des dispositions des paragraphes 2 (b), 4,5 ou 6 ci-dessus:
(a) Peuvent €tre róexportóes librement a condition que, en ce qui concerne les marchandises importóes en application du paragraphe 4, soit remise au Bureau des douanes une attestation

Jednakże w szczególnych przypadkach takie zbywanie może zostać dokonane na warunkach określonych przez organy Państwa przyjmującego (np. po opłaceniu cła i podatku oraz po spełnieniu wymogów odnośnie do kontroli handlu i dewizowej).
9. Towary zakupione w Państwie przyjmującym mogą być z niego wywiezione tylko w zgodzie z obowiązującymi przepisami tego Państwa.
10. Organy celne mogą zastosować szczególny tryb przekraczania granicy w odniesieniu do regularnych oddziałów lub formacji, pod warunkiem że organy te zostaną odpowiednio wcześniej powiadomione o takim zamiarze.
11. Wodniesieniu do paliw, olejów i smarów używanych w służbowych pojazdach, statkach powietrznych i okrętach sił zbrojnych lub ich personelu cywilnego Państwo przyjmujące podejmie szczególne działania mające na celu zwolnienie ich z cła i podatków.
12. W ustępach od 1 do 10 niniejszego artykułu:
„cto” oznacza opłaty celne oraz wszelkie inne opłaty i podatki płatne przy wwozie lub wywozie, w zależności od sytuacji, poza opłatami i podatkami, które nie są niczym innym jak optatami za korzystanie z usług;

ce: the customs authorities, however, may verify that goods re-exported are as described in the certificate, if any, and have in fact been imported under the conditions of paragraphs 2 (b), 4, 5 or 6 as the case may be;
(b) shall not normally be disposed of in the receiving State by way of either sale or gift: however, in particular cases such disposal may be authorised on conditions imposed by the authorities concerned of the receiving State (for instance, on payment of duty and tax and compliance with the requirements of the controls of trade and exchange).
9. Goods purchased in the receiving State shall be exported therefrom only in accordance with the regulations in force in the receiving State.
10. Special arrangements for crossing frontiers shall be granted by the customs authorities to regularly constituted units or formations, provided that the customs authorities concerned have been duly notified in advance.
11. Special arrangements shall be made by the receiving State so that fuel, oil and lubricants for use in service vehicles, aircraft and vessels of a force or civilian component, may be delivered free of all duties and taxes.
12. In paragraphs 1—10 of this Article —
"duty” means customs duties and all other duties and taxes payable on importation or exportation, as the case may be, except dues and taxes which are no more than charges for services rendered;
"importation” includes withdrawal from customs wareho-

9. Les exportations de marchandises achetćes dans I'Etat de sćjour sont soumises a la róglementation en vigueur sur le territoire dudit Etat.
10. Des facilitós particulieres sont accordóes par les autoritós douanieres pour le passage des frontieres par des unitós ou formations rógulierement encadróes, a condition que les autoritćs douanieres intóressćes aient recu la notification appropriće en temps utile.
11. Des dispositions spóciales seront prises par I'Etat de sćjour afin que les carburants et lubrifiants destinós a l'usage des vćhicules immatriculós a I'armóe, des aćronefs et bateaux militaires d'une force ou d'un óćlćment civil soient livrós exempts de tous droits et taxes.
12. Pour I'application des dix premiers paragraphes du prósent article, le mot
„droit” s'entend des droits de douane et de tous autres droits et taxes frappant, suivant le cas, I'importation ou I'exportation, a l' exception des droits et taxes qui constituent un remboursement de frais pour service rendu. Le mot

13. Postanowienia niniejszego artykutu mają zastosowanie do danych towarów nie tylko wtedy, gdy są one wwożone lub wywożone z Państwa przyjmującego, lecz także wówczas, gdy są one przewożone przez terytorium Umawiającej się Strony, i w takim przypadku pojęcie „Państwo przyjmujące” użyte w niniejszym artykule będzie także obejmować każdą Umawiającą się Stronę, przez której terytorium towary są przewożone.
Artykuł XII
1. Organy celne i skarbowe Państwa przyjmującego jako warunek przyznania jakichkolwiek zwolnień celnych lub podatkowych przewidzianych w niniejszej umowie mogą żądać przestrzegania warunków, jakie uznają za konieczne w celu przeciwdziałania nadużyciom.
2. Wyżej wspomniane organy mogą odmówić udzielenia jakiegokolwiek zwolnienia przewidzianego w niniejszej umowie w odniesieniu do wwozu do Państwa przyjmującego towarów i produktów wyhodowanych, wyprodukowanych lub wytworzonych w tym Państwie, które zostały wywiezione bez uiszczenia albo bez zwrotu podatków lub cet, które są wymagane przy takim wywozie. Towary pobierane ze składów celnych będą traktowane jako przedmioty wwiezione, jeżeli uważało się je za towary wywiezione z powodu ich zdeponowania w składzie.
Artykuł XIII
1. W celu zapobieżenia przestępstwom celnym i skarbowym organy Państwa przyjmującego i Państwa wysyłającego będą udzielać sobie wzajemnie pomocy przy prowadzeniu odpowiednich dochodzeń oraz zbieraniu dowodów.

13. The provisions of this Article shall apply to the goods concerned not only when they are imported into or exported from the receiving State, but also when they are in transit through the territory of a Contracting Party, and for this purpose the expression "receiving State” in this Article shall be regarded as including any Contracting Party through whose territory the goods are passing in transit.
Article XII
1. The customs or fiscal authorities of the receiving State may, as a condition of the grant of any customs or fiscal exemption or concession provided for in this Agreement, require such conditions to be observed as they may deem necessary to prevent abuse.
2. These authorities may refuse any exemption provided for by this Agreement in respect of the importation into the receiving State of articles grown, produced or manufactured in that State which have been exported therefrom without payment of, or upon repayment of, taxes or duties which would have been chargeable but for such exportation. Goods removed from a customs warehouse shall be deemed to be imported if they were regarded as having been exported by reason of being deposited in the warehouse.
Article XIII
1. In order to prevent offences against customs and fiscal laws and regulations, the authorities of the receiving and of the sending States shall assist each other in the conduct of enquiries and the collection of evidence.
2. The authorities of a force shall render all assistance within their power to ensure that articles liable to seizure by, or on behalf of, the customs or fiscal authorities of

2. Les memes autoritós peuvent dócider que ne bónóficieront pas des exemptions próvues par le prósent accord les importations de produits rócoltós, fabriqućs ou maunfacturós dans I'Etat de sćjour et exportós au próalable en franchise ou moyennant restitution des droits et taxes qui ótaient dus dans le cas ou ces produits n'auraient pas ćtć exportós. Article XIII
1. En vue de la rópression des infractions aux lois et reglements douaniers et fiscaux, les autoritós des Etats de sćjour et d'origine se pretent un mutuel concours pour procóder aux enqućtes et a la recherche des preuves.

Artykuł XIV
1. Sity zbrojne, personel cywilny, ich członkowie, jak również członkowie ich rodzin podlegają przepisom Państwa wysyłającego w odniesieniu do wymiany dewiz, a także przepisom obowiązującym w Państwie przyjmującym.
2. Właściwe organy Państwa przyjmującego i Państwa wysyłającego mogą wydać szczególne przepisy obowiązujące siły zbrojne lub personel cywilny, ich członków oraz członków ich rodzin, dotyczące wymiany dewiz.
Artykuł XV
1. Z zastrzeżeniem postanowień ust. 2 niniejszego artykułu niniejsza umowa pozostaje w mocy w przypadku działań zbrojnych, w stosunku do których ma zastosowanie Traktat Północnoatlantycki, jednakże postanowienia umowy dotyczące zaspokajania roszczeń określone w ust. 2 i 5 art. VIII nie będą mieć zastosowania do szkód wojennych oraz postanowienia umowy wynikające w szczególności z art. III i VII zostaną niezwłocznie zmienione przez zainteresowane Umawiające się Strony, które mogą uzgodnić wprowadzenie zmian dotyczących stosowania umowy między nimi, jakie uznają za konieczne.

3. The authorities of a force shall render all assistance within their power to ensure the payment of duties, taxes and penalties payable by members of the force or civilian component or their dependents.
4. Service vehicles and articles belonging to a force or to its civilian component, and not to a member of such force or civilian component, seized by the authorities of the receiving State in connexion with an offence against its customs or fiscal laws or regulations shall be handed over to the appropriate authorities of the force concerned.
Article XIV
1. Aforce, a civilian component and the members thereof, as well as their dependents, shall remain subject to the foreign exchange regulations of the sending State and shall also be subject to the regulations of the receiving State.
2. The foreign exchange authorities of the sending and the receiving States may issue special regulations applicable to a force or civilian component or the members thereof as well as to their dependents.
Article XV
1. Subject to paragraph 2 of this Article, this Agreement shall remain in force in the event of hostilities to which the North Atlantic Treaty applies, except that the provisions for settling claims in paragraphs 2and5ofArticle VIII shall not apply to war damage, and that the provisions of the Agreement, and, in particular of Articles III and VII, shall immediately be reviewed by the Contracting Parties concerned, who may agree to such modifications as they may consider desirable regarding the application of the Agreement between them.

Article XIV
1. Une force, un ćlóćment civil, leurs membres, ainsi que les personnes a leur charge, demeurent assujettis aux regles du contróle des changes de [Etat d'origine et doivent se conformer aux reglements de I'Etat de sćjour.
2. Les autoritós chargóes du contróle des changes des Etats d'origjne et de sćjour peuvent mettre en vigueur des dispositions spóciales applicables a une force, a son óćlóment civil ou a leurs membres ainsi qu' aux personnes a leur charge.
Article XV
1. Sous róserve des dispositions du paragraphe 2 ci-dessous, la prósente Convention reste en vigueur en cas d'hostilitćs entrainant l'application des dispositions du Traitć de I'Atlantique Nord. Toutefois, les dispositions relatives au reglement des dommages contenues dans les paragraphes 2 et 5 de "article VIII ne s'appliquent pas aux dommages de guerre et les dispositions de la prósente Convention, notamment celles des articles III et VII, font immódiatement |I'objet d'un nouvel examen par les Parties Contractantes intóressćes. Celles-ci peuvent óćventuellement convenir des modifications qui apparaitraient dósirables en ce qui concerne I'application de la Convention entre elles.

2. W przypadku działań zbrojnych, o których mowa wyżej, każda z Umawiających się Stron ma prawo, pod warunkiem zawiadomienia o tym pozostałych Umawiających się Stron z sześćdziesięciodniowym wyprzedzeniem, zawiesić stosowanie jakiegokolwiek z postanowień niniejszej umowy w odniesieniu do tej Strony. W przypadku skorzystania z tego prawa Umawiające się Strony niezwłocznie przystąpią do konsultacji w celu uzgodnienia odpowiednich uregulowań, które zastąpią zawieszone postanowienia.
Artykuł XVI
Wszelkie spory między Umawiającymi się Stronami dotyczące interpretacji i stosowania niniejszej umowy będą rozstrzygane w drodze negocjacji między nimi bez odwoływania się do jakiejkolwiek zewnętrznej jurysdykcji. O ile postanowienia niniejszej umowy wyraźnie nie stanowią inaczej, spory, które nie mogą być rozstrzygnięte w drodze bezpośrednich negocjacji, będą przedstawione Radzie Północnoatlantyckiej.
Artykut XVII
Każda z Umawiających się Stron może w każdym czasie wystąpić z wnioskiem o zmianę jakiegokolwiek artykułu niniejszej umowy. Wnioski takie kierowane będą do Rady Północnoatlantyckiej.
Artykuł XVIII
1. Niniejsza umowa podlega ratyfikacji. Dokumenty ratyfikacji zostaną złożone w jak najkrótszym czasie Rządowi Stanów Zjednoczonych Ameryki, który poinformuje każde z Państw-Sygnatariuszy o dacie ich złożenia.
2. Niniejsza umowa wejdzie w życie trzydzieści dni po złożeniu dokumentów ratyfikacji przez cztery Państwa-Sygnatariuszy umowy i będzie obowiązywać w stosunkach między tymi Państwami-Sygnatariuszami. W stosunku do innych Państw-Sygnatariuszy wejdzie ona w życie trzydzieści dni po złożeniu przez nich dokumentów ratyfikacji.
3. Po wejściu w życie niniejszej umowy będzie ona pod warunkiem zgody Rady Północnoatlantyckiej

In the event of such hostilities, each of the Contracting Parties shall have the right, by giving 60 days' notice to the other Contracting Parties, to suspend the application of any of the provisions of this Agreement so far as it isconcerned. If this right is exercised, the Contracting Parties shall immediately consult with a view to agreeing on suitable provisions to replace the provisions suspended.
Article XVI
AII differences between the Contracting Parties relating to the interpretation or application of this Agreement shall be settled by negotiation between them without recourse to any outside jurisdiction. Except where express provision is made to the contrary in this Agreement, differences which cannot be settled by direct negotiation shall be referred to the North Atlantic Council.
Article XVII
Any Contracting Party may at any time request the revision ofany Article of this Agreement. The request shall be addressed to the North Atlantic Council.
Article XVIII
1. The present Agreement shall be ratified and the instruments of ratification shall be deposited as soon as possible with the Government of the United States of America, which shall notify each signatory State of the date of deposit thereof.
2. Thirty days after four signatory States have deposited their instruments of ratification the present Agreement shall come into force between them. It shall come into force for each other signatory State thirty days after the deposit of its instrument of ratification.
3. After it has come into force, the present Agreement shall, subject to the approval of the North

Sauf dans les cas ou la prósente Convention contient une disposition contraire, les contestations qui ne peuvent pas €tre róglóes par negociations directes, seront portóes devant le Conseil de "Atlantique Nord.
Article XVII
Chaque Partie Contractante peut a tout moment demander la róvision de tout article de la prósente Convention. La demande sera adressóe au Conseil de "Atlantique Nord.
Article XVIII
1. La prósente Convention sera ratifiśóe et les instruments de ratification seront dćposćs aussitót que possible aupres du gouvernement des Etats-Unis d'Amórique qui notifiera la date de ces dópóts a chaque Etat signataire.
2. La prósente Convention entrera en vigueur trente jours apres le dópót par quatre Etats signataires de leurs instruments de ratification. Elle entrera en vigueur pour chacun des autres Etats signataires trente jours apres le dópót de son instrument de ratification.
3. Apres son entrće en vigueur, la prósente Convention, sous róserve de I'approbation du Conseil

Przystąpienie następuje przez złożenie dokumentu przystąpienia Rządowi Stanów Zjednoczonych Ameryki, który poinformuje każde Państwo-Sygnatariusza i Państwo przystępujące o dacie złożenia takiego dokumentu. W odniesieniu do każdego Państwa, w imieniu którego został złożony dokument przystąpienia, niniejsza umowa wejdzie w życie trzydzieści dni po złożeniu wyżej wymienionego dokumentu.
Artykuł XIX
1. Niniejsza umowa może być wypowiedziana przez każdą z Umawiających się Stron po upływie czterech lat od daty jej wejścia w życie.
2. Wypowiedzenie umowy przez Umawiającą się Stronę będzie dokonywane w drodze pisemnej notyfikacji skierowanej przez tę Umawiającą się Stronę do Rządu Stanów Zjednoczonych Ameryki, który notyfikuje wszystkim pozostatym Umawiającym się Stronom fakt złożenia takiej notyfikacji oraz informuje o dacie jej złożenia.
3. Wypowiedzenie staje się skuteczne po upływie roku od dnia otrzymania wyżej wymienionej notyfikacji przez Rząd Stanów Zjednoczonych Ameryki. Po upływie tego okresu umowa straci moc w odniesieniu do Umawiającej się Strony, która ją wypowiedziała, lecz pozostanie w mocy w stosunku do pozostałych Umawiających się Stron.
Artykuł XX
1. Z zastrzeżeniem postanowień ust. 2 i 3 niniejszego artykułu umowa będzie mieć zastosowanie jedynie wobec terytorium metropolii Umawiającej się Strony.
2. Niezależnie od powyższego każde Państwo może, w chwili złożenia dokumentu ratyfikacji lub przystąpienia albo w dowolnym czasie, notyfikować Rządowi Stanów Zjednoczonych Ameryki, że umowa niniejsza będzie stosowana (z zastrzeżeniem zawarcia specjalnego porozumienia między tym
Atlantic Council and to such conditions as it may decide, be open to accession on behalf of any State which accedes to the North Atlantic Treaty. Accession shall be effected by the deposit of an instrument of accession with the Government of the United States of America, which shall notify each signatory and acceding State of the date of deposit thereof. In respect of any State on behalf of which an instrument of accession is deposited, the present Agreement shall come into force thirty days after the date of the deposit of such instrument.
Article XIX
1. The present Agreement may be denouced by any Contracting Party after the expiration of a period of four years from the date on which the Agreement comes into force.
2. The denunciation of the Agreement by any Contracting Party shall be effected by a written notification addressed by that Contracting Party to the Government of the United States of America which shall notify all the other Contracting Parties of each such notification and the date of receipt thereof.
3. The denunciation shall take effect one year after the receipt of the notification by the Government of the United States of America. After the expiration of this period of one year, the Agreement shall cease to be in force as regards the Contracting Party which denounces it, but shall continue in force for the remaining Contracting Parties.
Article XX
1. Subject to the provisions of paragraphs 2 and 3 of this Article, the present Agreement shall apply only to the metropolitan territory of a Contracting Party.
2. Any State may, however, at the time of the deposit of its instrument of ratification or accession or at any time thereafter, declare by notification given to the Government of the United States of America that the present Agreement shall extend (subject, if the State making the declaration considers it to be

Article XIX
1. La prósente Convention pourra €tre dóćnoncóe par chaque Partie Contractante apres I'expiration d'un dólai de quatre ans a dater de son entróe en vigueur.
2. La dónonciation de la Convention par une Partie Contractante se fera par notification ćcrite adressóe par cette Partie au gouvernement des Etats-Unis d'Amórique qui informera toutes les autres Parties Contractantes de cette notification et de la date de sa róception.
3. La dćnonciation prendra effet un an apres róception de sa notification par le gouvernement des Etats-Unis d Amórique. Apres I'expiration de cette póriode d'un an, la Convention cessera d'etre en vigueur pour la Partie qui laura dónoncće, mais restera en vigueur
entre les autres Parties Contractantes. Article XX
1. Sous róserve des dispositions des paragraphes 2 et 3 ci-dessous, la prósente Convention s'applique uniquement au territoire mótropolitain d'une Partie Contractante.
2. Toutefois un Etat peut, lors du dópót de ses instruments de ratification ou d'accession, ou ultórieurement, dóclarer, par notification au gouvernement des Etats-Unis, que la prósente Convention s'ćtendra a tous les territoires ou a tels des territoires dont les relations internationales sont assuróes par lui dans la

Państwem a każdym z zainteresowanych Państw wysyłających, o ile uzna takie porozumienie za niezbędne) wobec wszystkich lub któregokolwiek z terytoriów, za których politykę zagraniczną Państwo to ponosi odpowiedzialność w ramach obszaru działania Traktatu Północnoatlantyckiego. Wtedy to niniejsza umowa zacznie obowiązywać wobec takiego terytorium lub takich terytoriów po upływie trzydziestu dni od otrzymania przez Rząd Stanów Zjednoczonych Ameryki takiej notyfikacji lub po upływie trzydziestu dni od zawarcia specjalnych porozumień, jeśli są one konieczne, albo od dnia jej wejścia w życie na mocy art. XVIII, w zależności od tego, który z tych terminów jest późniejszy.
3. Państwo, które złożyto deklarację zgodnie z ust. 2 niniejszego artykułu w sprawie rozciągnięcia mocy niniejszej umowy na terytorium, za którego politykę zagraniczną jest ono odpowiedzialne, może wypowiedzieć umowę oddzielnie w odniesieniu do tego terytorium, zgodnie z postanowieniami art. XIX.
Na dowód czego niżej podpisani pełnomocnicy podpisali niniejszą umowę.
Sporządzono w Londynie dnia 19 czerwca 1951 r. w językach angielskim i francuskim, przy czym obydwa teksty są jednakowo autentyczne, w jednym egzemplarzu, który zostanie złożony w archiwach Rządu Stanów Zjednoczonych Ameryki. Rząd Stanów Zjednoczonych Ameryki przekaże wszystkim Sygnatariuszom i Państwom przystępującym uwierzytelnione kopie niniejszej umowy.
* Zgodnie z uzgodnieniem przyjętym w Londynie dnia 4 kwietnia 1952 r. funkcja Przewodniczącego Rady Zastępców zostaje zniesiona w związku ze zmianą struktury Organizacji Traktatu Północnoatlantyckiego. Od dnia 4 kwietnia 1952 r. funkcję przewodniczącego Rady Zastępców wykonuje Sekretarz Generalny Organizacji lub, w razie jego nieobecności, zastępca lub jakakolwiek inna osoba wyznaczona przez Radę Północnoatlantycką.
necessary, to the conclusion of a special agreement between that State and each of the sending States concerned), to all or any of the territories for whose international relations it is responsible in the North Atlantic Treaty area. The present Agreement shall then extend to the territory or territories named therein thirty days after the receipt by the Government of the United States of America of the notification, or thirty days after the conclusion of the special agreements if required, or when it has come into force under Article XVIII, whichever is the later.
3. A State which has made a declaration under paragraph 2 of this Article extending the present Agreement to any territory for whose international relations it is responsible may denounce the Agreement separately in respect of that territory in accordance with the provisions of Article XIX.

3. Un Etat qui a fait la dóclaration próvue au paragraphe (2) ci-dessus du prósent article en vue d'ćtendre la Convention a un territoire dont il assure les relations internationales, peut dónoncer la Convention dans les Conditions próvues a ['article XIX en ce qui concerne ce seul territoire.
En foi de quoi les Plónipotentiaires ci-dessous dósignós ont signć la prósente Convention.

w sprawie ratyfikacji Umowy między Państwami-Stronami Traktatu Północnoatlantyckiego dotyczącej statusu ich sił zbrojnych, sporządzonej w Londynie dnia 19 czerwca 1951 r.
1. Podaje się niniejszym do wiadomości, że zgodnie z art. XVIII ust. 3 Umowy między Państwami-Stronami Traktatu Północnoatlantyckiego dotyczącej statusu ich sił zbrojnych, sporządzonej w Londynie dnia 19 czerwca 1951 r., został złożony dnia 21 września 1999 r. Rządowi Stanów Zjednoczonych Ameryki dokument przystąpienia Rzeczypospolitej Polskiej do wyżej wymienionej umowy.
Zgodnie z art. XVIII ust. 3 umowy weszła ona w życie w stosunku do Rzeczypospolitej Polskiej dnia 21 października 1999 r.
2. Zgodnie z art. XVIII ust. 2 umowy weszła ona w życie dnia 23 sierpnia 1953 r.
